 BILL NUMBER: SB 1546AMENDED BILL TEXT AMENDED IN SENATE APRIL 18, 2012 INTRODUCED BY Senator Cannella FEBRUARY 24, 2012  An act to amend Section 65580 of the Government Code, relating to land use.   An act to add Section   25526.8 to the Government Code, relating to local government.  LEGISLATIVE COUNSEL'S DIGEST SB 1546, as amended, Cannella.  Land use.   Local government: real property.   Existing law authorizes a county board of supervisors to sell or lease any real property belonging to the county without a vote of the electors. Existing law requires the county board of supervisors before ordering the sale or lease of real property to adopt a resolution declaring its intention to sell or lease the property, subject to a two-thirds vote of the board. Existing law requires the sale or lease to be conducted at a fixed time at which sealed proposals to purchase or lease are received and considered. Existing law exempts specified sales or leases from these requirements.   This bill would authorize a county that owns real property on a converted military base to sell that real property or any interest therein in the manner and upon the terms and conditions approved by the board of supervisors without further compliance with the requirements set forth above.   The Planning and Zoning Law sets forth the Legislature's findings and declarations regarding the availability of housing throughout California.   This bill would make technical, nonsubstantive changes in that law.  Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:  SECTION 1.   Section 25526.8 is added to the   Government Code  , to read:   25526.8. A county that owns real property on a converted military base may sell that real property or any interest therein in the manner and upon the terms and conditions approved by the board of supervisors without complying with any other section of this article, upon a finding that the sale is in the public interest.   SECTION 1.   Section 65580 of the Government Code is amended to read: 65580. The Legislature finds and declares as follows: (a) The availability of housing is of vital statewide importance, and the early attainment of decent housing and a suitable living environment for every Californian, including farmworkers, is a priority of the highest order. (b) The early attainment of this goal requires the cooperative participation of government and the private sector in efforts to expand housing opportunities and accommodate the housing needs of Californians of all economic levels. (c) Providing housing affordable to low- and moderate-income households requires the cooperation of all levels of government. (d) Local and state governments have a responsibility to use the powers vested in them to facilitate the improvement and development of housing to make adequate provision for the housing needs of all economic segments of the community. (e) The Legislature recognizes that in carrying out this responsibility, each local government also has the responsibility to consider economic, environmental, and fiscal factors and community goals set forth in the general plan and to cooperate with other local governments and the state in addressing regional housing needs.
