LEGISLATIVE COUNSEL'S DIGEST SB 960, as amended, Rubio. California State University: campus-based mandatory fees. Existing law establishes the California State University, under the administration of the Trustees of the California State University, as one of the segments of public postsecondary education in the state. Existing law authorizes the trustees by rule to require all persons to pay fees, rents, deposits, and charges for services, facilities, or materials provided by the trustees tosuchthose persons. This bill would prohibit specified California State University campus-based mandatory fees from being established, adjusted, or reallocated withoutconsideration by the applicable campus fee advisory committee and a vote of the student bodyan affirmative vote of either the student body or a campus fee advisory committee that meets specified criteria . The bill would also prohibit a rule, order, or other action of the California State University or its campuses, including, but not limited to, the university's Mandatory Catalog , from providing authority to campus presidents , or any other person, to use alternative consultation mechanisms to establish, adjust, or reallocate those campus-based mandatory fees withoutconsideration by the applicable campus fee advisory committee and a vote of the student bodyan af firmative vote of either the student body or a campus fee advisory committee that meets specified criteria . Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 89711 is added to the Education Code, to read: 89711. (a) California State University campus-based mandatory fees that are not specifically authorized by statute shall not be established withoutconsideration by the applicable campus fee advisory committee and a vote of the student bodyan affirmative vote of either the student body or a campus fee advisory committee that meets the criteria specified in subdivision (d) . (b) California State University campus-based mandatory feesthat areestablished through a vote of the student body, but not specifically authorized by statute, shall not be adjusted or reallocated withoutconsideration by the applicable campus fee advisory committee and a vote of the student bodyan affirmative vote of either the student body or a campus fee advisory committee that meets the criteria specified in subdivision (d) . (c)TheA rule, order, or other action of the California State University or its campuses, including, but not limited to, the university's Mandatory Catalog , shall not provide authority to campus presidents , or any other person, to use alternative consultation mechanisms to establish, adjust, or reallocate the campus-based mandatory fees referenced in subdivisions (a) and (b) withoutconsideration by the applicable campus fee advisory committee and a vote of the student bodyan affirmative vote of either the student body or a campus fee advisory committee that meets the criteria specified in subdivision (d) . (d) The majority of the membership of a campus fee advisory committee that votes to establish, adjust, or reallocate a campus-based mandatory fee pursuant to this section shall be comprised of student members elected by the student body who may hold other offices. The campus fee advisory committee may include nonstudent members who are appointed or elected as authorized.
