 BILL NUMBER: AB 2033INTRODUCED BILL TEXT INTRODUCED BY Assembly Member Wilk FEBRUARY 16, 2016 An act to amend Sections 11343.5 and 26803.5 of the Government Code, relating to regulations. LEGISLATIVE COUNSEL'S DIGEST AB 2033, as introduced, Wilk. Code of Regulations: distribution. Existing law requires the State Printing Office to file one copy of the published copies of the California Code of Regulations with to the county clerk in each county, to be made available for public inspection. Existing law authorizes the county clerk to delegate, to the paid county law librarian or the librarian in charge of the county law library, the duty of accepting and making the regulations available, if certain conditions are met. This bill would instead require the State Printing Office to file the latest published copies of the California Code of Regulations with the librarian in charge of the county library, to be made available for public inspection, and would make conforming changes. Because this bill would impose new duties on local officials, it would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions. Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: yes. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 11343.5 of the Government Code is amended to read: 11343.5. Within 10 days from the receipt of printed copies of the California Code of Regulations or of the California Code of Regulations Supplement from the State Printing Office, the office shall file one copy of the particular issue of the code or supplement  in the office of the county clerk of each county in this state, or if the authority to accept filings on his or her behalf has been delegated by the county clerk of any county pursuant to Section 26803.5, in the office of the person to whom that authority has been delegated.   with the librarian in charge of the county library in each county.  SEC. 2. Section 26803.5 of the Government Code is amended to read: 26803.5. Each regulation and order of repeal of a regulation filed with a  county clerk   librarian in charge of a county library  pursuant to Article 2 (commencing with Section 11380) of Chapter 4.5, Part 1, Division 3, Title 2, of this code shall be retained in an active file, available for public inspection, until receipt by the  county clerk   librarian in charge of the county library  of the next California Administrative Register or supplement to the California Administrative Code in which such regulation, order of repeal or notice thereof, is published. The  county clerk  librarian in charge of the county library  shall at all times keep a complete current set of the California Administrative Code, and the California Administrative Register available for public inspection.  If the county clerk of any county in this state is satisfied that the code and register will be maintained in accordance with the requirements of this section, he may delegate the authority to receive filings on his behalf and to maintain the code and register on his behalf to a paid county law librarian or to the librarian in charge of the county library.  SEC. 3. If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.
