 BILL NUMBER: SB 609AMENDED BILL TEXT AMENDED IN SENATE APRIL 21, 2015 INTRODUCED BY Senator Stone FEBRUARY 27, 2015 An act to amend Section  120100   11839.2  of the Health and Safety Code, relating to  communicable disease.   controlled substances.  LEGISLATIVE COUNSEL'S DIGEST SB 609, as amended, Stone.  Communicable disease: prevention and control.   Controlled substances: narcotic replacement treatment.   Existing law specifies the controlled substances that may be used in narcotic replacement therapy by licensed narcotic treatment programs, including federally approved controlled substances used for the purpose of narcotic replacement treatment, and requires the State Department of Public Health to establish guidelines for narcotic treatment programs, including dosage requirements.   This bill would, instead, authorize the use of federally approved controlled substances used for the purpose of substance use disorder treatment.   Existing law, the Communicable Disease Prevention and Control Act, imposes various functions and duties on the State Department of Public Health and local health officers with respect to the prevention and control of communicable diseases. The act provides that a health officer includes county, city, and district health officers, and city and district health boards, but not advisory health boards.   This bill would make a technical, nonsubstantive change to this provision.  Vote: majority. Appropriation: no. Fiscal committee:  no   yes  . State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:  SECTION 1.   Section 11839.2 of the   Health and Safety Code   is amended to read:  11839.2. The following controlled substances are authorized for use in narcotic replacement therapy by licensed narcotic treatment programs: (a) Methadone. (b) Levoalphacetylmethadol (LAAM) as specified in paragraph (10) of subdivision (c) of Section 11055. (c) Buprenorphine products or combination of products approved by the federal Food and Drug Administration for maintenance or detoxification of opioid dependence. (d) Any other federally  approved,   approved  controlled substances used for the purpose of  narcotic replacement   substance use disorder  treatment.  SECTION 1.   Section 120100 of the Health and Safety Code is amended to read: 120100. "Health officer," as used in the Communicable Disease Prevention and Control Act as set forth in Section 27, includes county, city, and district health officers, and city and district health boards, but does not include advisory health boards.
