Chapter 5.8 (commencing with Section 11549.50) is added to Part 1 of Division 3 of Title 2 of the Government Code, to read: CHAPTER 5.8. California Geographic Information Office11549.50. As used in this chapter, the following terms have the following meanings:(a) GIS means geographic information systems.(b) Council means the California Geographic Information Advisory Council.(c) Director means the Director of Technology.(d) Office means the California Geographic Information Office.(e) Officer means the Geographic Information Officer.11549.51. (a) The California Geographic Information Office is hereby established within the Department of Technology. The purpose of the office is to coordinate the states GIS projects, promulgate standards for data collection and sharing, and manage shared data resources.(b) The California Geographic Information Office shall be under the direction of the Geographic Information Officer, who shall be appointed by, and serve at the pleasure of, the Governor. The officer shall work closely with the Director of Technology.(c) The duties of the officer include all of the following:(1) Develop and implement a state GIS strategic plan in consultation with key stakeholders, including, but not limited to, the council.(2) Analyze the geospatial data collected statewide to identify gaps or areas of duplication.(3) Develop geospatial data standards to ensure compatibility across the state enterprise and define responsibility for data stewardship and the maintenance of authoritative datasets.(4) Address legal and policy issues for use and distribution of geospatial data.(5) Coordinate the states GIS projects and identify opportunities for cross-agency partnerships for geospatial data development and sharing.(6) Work with agency partners to identify funding opportunities and price sharing schemes that encourage adoption of, and continued investment in, GIS.(7) Negotiate and manage a master contract, without prior approval from the Department of General Services, for the states GIS services to allow the state to operate as a single GIS customer, driving down costs for individual departments and agencies to purchase and apply the technology.(8) Develop and strengthen ongoing relationships with private-sector GIS providers, local governments, and other partners.(9) (A) On or before December 1, 2021, and annually each December 1 thereafter, the officer shall report to the Legislature on all of the following:(i) The number or percent of state agencies involved in using the shared resources provided by the office.(ii) The extent of the development of standards for data sharing among multiple agencies and the number of data sharing agreements in place.(iii) The number of customer data requests from state agencies and the speed of response to those requests.(B) A report submitted pursuant to this paragraph shall be submitted in compliance with Section 9795.11549.52. (a) The California Geographic Information Advisory Council is hereby established within the Department of Technology, and shall advise the officer on issues of policy and implementation.(b) The council shall consist of the following members:(1) Twenty-one members appointed by the Governor, as follows:(A) One member who represents Indian tribes, as defined in Section 21073 of the Public Resources Code.(B) One member who represents the California State Association of Counties.(C) One member who represents the League of California Cities.(D) One member who represents the California Special Districts Association.(E) One member who represents the regional governments or councils of government within the state.(F) One member who represents the California Assessors Association.(G) One member who represents the California 9-1-1 Emergency Communications Branch of the Office of Emergency Services.(H) One member who represents public higher education, as defined in subdivision (a) of Section 66010 of the Education Code.(I) One member who represents a federal agency that is concerned with collecting, managing, or disseminating geospatial framework data.(J) One member who represents a public utility within the state.(K) One member who is a GIS manager for a county or city in the state.(L) One member who represents the public and who has an interest in GIS and in enhancing geospatial data sharing among public bodies.(M) The Geographic Information Officer.(N) One member who represents a nonprofit professional organization with an interest in GIS and in enhancing geospatial data sharing among public bodies.(O) Three members from state agencies with responsibility for water, land, air quality, natural resources, or infrastructure.(P) Two members from state agencies with responsibility for public health, human services, education, or economic or community development.(Q) Two members from state agencies with responsibility for public safety or emergency management.(2) One Senator who has an interest in GIS and in enhancing geospatial framework data sharing among public bodies, appointed by the President pro Tempore of the Senate.(3) One Assembly Member who has an interest in GIS and in enhancing geospatial framework data sharing among public bodies, appointed by the Speaker of the Assembly.(c) (1) Each group or entity identified in paragraph (1) of subdivision (b) may recommend an individual from the group or entity for membership on the council.(2) Members appointed to the council pursuant to paragraph (3) or (4) of subdivision (b) are nonvoting members and may act in an advisory capacity only.(d) (1) A majority of the voting members of the council constitutes a quorum for transacting business.(2) A majority of the voting members of the council must approve the councils official actions.(e) The council shall elect one of the councils members to serve as chairperson and one member to serve as vice chairperson. The council shall specify a process by which the council selects the chairperson and vice chairperson and the terms of office for the chairperson and vice chairperson.(f) (1) The term of office for each voting member of the council is four years, but the member serves at the pleasure of the Governor.(2) Before a voting members term expires, the Governor shall appoint a successor, whose term begins on January 1 following the Governors appointment. A voting member is eligible for reappointment.(3) A nonvoting members term of office is two years. A nonvoting member is eligible for reappointment.(4) If a vacancy occurs on the council for any reason, the appointing authority shall make an appointment to become immediately effective and the new member shall serve for the remainder of the term.(g) The council shall meet at times and places that the chairperson or a majority of the voting members of the council specifies.(h) Members of the council who are not members of the Legislature may not receive compensation, but the Director of Technology, in their discretion, may reimburse council members for actual and necessary travel and other expenses the members incur in performing the members official duties, upon appropriation by the Legislature.(i) All agencies of state government shall assist the council in performing the councils duties and, to the extent permitted by laws relating to confidentiality, shall furnish information and advice the council considers necessary to perform the councils duties.(j) The council shall form an executive committee to do all of the following:(1) Recommend the scope of common data to be included in a statewide GIS platform.(2) Determine and recommend policies and rules around defining GIS data standards and responsibilities.(3) Identify strategies for sharing within a statewide GIS platform.(4) Recommend strategies for funding collaborative GIS projects.(k) The council shall form a technical committee of GIS experts and technologists to discuss agency technical needs and strategies to deploy GIS technology collaboratively.11549.53. This chapter shall remain in effect only until January 1, 2031, and as of that date is repealed. |
