The Legislature finds and declares both of the following:(a) The federal Centers for Disease Control and Prevention (CDC) found that in 2016, young adults between 13 and 24 years of age accounted for 21 percent of new HIV infections in the United States, and 17 percent of new infections occurred in adults between 20 and 24 years of age.(b) Expanding and ensuring access to preexposure prophylaxis and postexposure prophylaxis is critical in achieving Californias goal of getting to zero: zero transmission, zero HIV-related deaths, and zero HIV stigma.SEC. 2. Section 99253 is added to the Education Code, immediately following Section 99251, to read:99253. (a) The student health centers of all campuses of the University of California and the California State University shall do both of the following:(1) Have HIV postexposure prophylaxis (PEP) on hand and readily available to dispense. These student health centers shall be able to dispense PEP immediately to a student in need, upon required consultation and exams. The PEP shall be provided at low or no cost to the student. If PEP is to be dispensed to a student pursuant to the alternative set forth in subdivision (b), it shall be made available to the student in less than 24 hours.(2) Provide preexposure prophylaxis (PrEP). If PEP is to be dispensed to a student pursuant to the alternative set forth in subdivision (b), it shall be made available to the student in less than 24 hours.(2) Provide preexposure prophylaxis (PrEP). These student health centers shall provide PrEP to students in need as soon as possible or within 15 calendar days of a request.(b) A student health center or campus of the University of California or the California State University may, as an alternative to directly providing PrEP or PEP to a student in need, help the student navigate the process of obtaining PrEP or PEP through the students insurance or through other resources, such as a grant-based program or through a telehealth service, so long as the student is able to complete the necessary consultations and obtain PrEP within 15 days. The student health center shall offer to coordinate transportation, at no cost to the student, to any necessary consultations, to pick up the medication, and to engage in follow-up care with the students provider if that provider is located off-campus.(c) As used in this section:(1) CDC guidelines means:(A) With respect to PEP, the Updated Guidelines for Antiretroviral Postexposure Prophylaxis After Sexual, Injection Drug Use, or Other Nonoccupational Exposure to HIVUnited States, 2016, or any subsequent guidelines, published by the federal Centers for Disease Control and Prevention.(B) With respect to PrEP, the 2017 Preexposure Prophylaxis for the Prevention of HIV Infection in the United States 2017 Update: A Clinical Practice Guideline, or any subsequent guidelines, published by the federal Centers for Disease Control.(2) Postexposure prophylaxis (PEP) means any of the following:(A) Tenofovir disoproxil fumarate (TDF) (300 mg) with emtricitabine (FTC) (200 mg), taken once daily, in combination with either raltegravir (400 mg), taken twice daily, or dolutegravir (50 mg), taken once daily.(B) Tenofovir disoproxil fumarate (TDF) (300 mg) and emtricitabine (FTC) (200 mg), taken once daily, in combination with darunavir (800 mg) and ritonavir (100 mg), taken once daily.(C) Another drug or drug combination determined by the California State Board of Pharmacy to meet the same clinical eligibility recommendations provided in CDC guidelines.(3) Preexposure prophylaxis (PrEP) means a fixed-dose combination of tenofovir disoproxil fumarate (TDF) (300 mg) with emtricitabine (FTC) (200 mg), or another drug or drug combination determined by the California State Board of Pharmacy to meet the same clinical eligibility recommendations provided in CDC guidelines. |
