11 CALIFORNIA LEGISLATURE 20192020 REGULAR SESSION Assembly Bill No. 2589Introduced by Assembly Member MaienscheinFebruary 20, 2020 An act to amend Section 5849.2 of the Welfare and Institutions Code, relating to mental health services, and making an appropriation therefor. LEGISLATIVE COUNSEL'S DIGESTAB 2589, as introduced, Maienschein. No Place Like Home Program: permanent supportive housing. Existing law, the No Place Like Home Program (NPLH), as ratified and amended by Proposition 2, which was approved by the voters at the November 6, 2018, statewide general election, provides funding to provide permanent supportive housing for the target population, which is defined to include individuals who have a serious mental disorder and who are homeless, chronically homeless, or at risk of chronic homelessness. Existing law defines permanent supportive housing to mean housing with no limit on length of stay, that is occupied by the target population, and that is linked to onsite or offsite services, as specified. Existing law makes the Department of Housing and Community Development the administrator of the NPLH and establishes the continuously appropriated No Place Like Home Fund for purposes of the NPLH. Existing law requires the department to develop a competitive application process for the purpose of awarding moneys to counties pursuant to the NPLH, but also authorizes the department to establish an alternative process for allocating funds directly to counties with at least 5% of the states homeless population and requires the department to adopt guidelines establishing the parameters of an alternative process, if it is established. Existing law authorizes the Legislature to amend Proposition 2 by a 2/3 vote, so long as the amendment is consistent with and furthers the intent of the act.Existing law also provides for the transfer of funds from the Supportive Housing Program Subaccount of the Mental Health Services Fund, a continuously appropriated fund established for purposes of the Mental Health Services Act, an initiative measure enacted by the voters as Proposition 63 at the November 2, 2004, statewide general election, to the No Place Like Home Fund, a continuously appropriated fund.This bill would amend Proposition 2 by expanding the definition of permanent supportive housing to include specified licensed adult residential facilities, residential care facilities for the elderly, and any innovative housing solution in the mental health continuum of care. As used in this part, the following definitions shall apply:(a) At risk of chronic homelessness includes, but is not limited to, persons who are at high risk of long-term or intermittent homelessness, including persons with mental illness exiting institutionalized settings, including, but not limited to, jail and mental health facilities, who were homeless prior to admission, transition age youth experiencing homelessness or with significant barriers to housing stability, and others, as defined in program guidelines.(b) Authority means the California Health Facilities Financing Authority established pursuant to Part 7.2 (commencing with Section 15430) of Division 3 of Title 2 of the Government Code.(c) Chronically homeless has the same meaning as defined in Section 578.3 of Title 24 of the Code of Federal Regulations, as that section read on May 1, 2016.(d) Commission means the Mental Health Services Oversight and Accountability Commission established by Section 5845.(e) Committee means the No Place Like Home Program Advisory Committee established pursuant to Section 5849.3.(f) County includes, but is not limited to, a city and county, and a city receiving funds pursuant to Section 5701.5.(g) Department means the Department of Housing and Community Development.(h) Development sponsor has the same meaning as sponsor as defined in Section 50675.2 of the Health and Safety Code.(i) Fund means the No Place Like Home Fund established pursuant to Section 5849.4.(j) Homeless has the same meaning as defined in Section 578.3 of Title 24 of the Code of Federal Regulations, as that section read on May 1, 2016.(k) (1) Permanent supportive housing has the same meaning as supportive housing, as defined in Section 50675.14 of the Health and Safety Code, except that permanent supportive housing shall include associated facilities if used to provide services to housing residents. Permanent supportive housing also includes, but is not limited to, all of the following: (A) An adult residential facility licensed pursuant to Chapter 3 (commencing with Section 1500) of Division 2 of the Health and Safety Code.(B) A residential care facility for the elderly licensed pursuant to Chapter 3.2 (commencing with Section 1569) of Division 2 of the Health and Safety Code.(C) Any innovative housing solution in the mental health continuum of care that is proposed by a county.(2) The receipt of funds from the program by a licensed facility listed under paragraph (1) shall not affect the facilitys licensing.(l) Program means the process for awarding funds and distributing moneys to applicants established in Sections 5849.7, 5849.8, and 5849.9 and the ongoing monitoring and enforcement of the applicants activities pursuant to Sections 5849.8, 5849.9, and 5849.11.(1) Competitive program means that portion of the program established by Section 5849.8.(2) Distribution program means that portion of the program described in Section 5849.9.(m) Target population means individuals or households as provided in Section 5600.3 who are homeless, chronically homeless, or at risk of chronic homelessness.

8282 (k) (1) Permanent supportive housing has the same meaning as supportive housing, as defined in Section 50675.14 of the Health and Safety Code, except that permanent supportive housing shall include associated facilities if used to provide services to housing residents. Permanent supportive housing also includes, but is not limited to, all of the following:

8484 (A) An adult residential facility licensed pursuant to Chapter 3 (commencing with Section 1500) of Division 2 of the Health and Safety Code.

8888 (C) Any innovative housing solution in the mental health continuum of care that is proposed by a county.

9090 (2) The receipt of funds from the program by a licensed facility listed under paragraph (1) shall not affect the facilitys licensing.

9292 (l) Program means the process for awarding funds and distributing moneys to applicants established in Sections 5849.7, 5849.8, and 5849.9 and the ongoing monitoring and enforcement of the applicants activities pursuant to Sections 5849.8, 5849.9, and 5849.11.

9494 (1) Competitive program means that portion of the program established by Section 5849.8.
