Digest Key Fiscal Committee: NO Bill TextWHEREAS, In May of 2005, Congress passed and the President of the United States signed into law the REAL ID Act of 2005, which placed federal standards on state drivers licenses to improve security at secured federal facilities and on airlines; and WHEREAS, In 2007, the Department of Homeland Security (DHS) issued draft regulations for implementing REAL ID and in 2008 issued final regulations for implementation, setting a compliance deadline of May 10, 2011; and WHEREAS, By December of 2012, 13 states met compliance standards for REAL ID; and WHEREAS, By October of 2018, only 37 states were REAL ID compliant; and WHEREAS, After granting multiple extensions, DHS set the date by which a REAL ID will be required to board any domestic flight on or after October 1, 2020; and WHEREAS, California began issuing REAL IDs on January 1, 2018; and WHEREAS, After DHS rejected Californias REAL ID applications in October of 2016 and January of 2017, California worked with DHS to come into compliance, and all REAL IDs issued since January of 2018 were deemed compliant so long as additional paperwork was provided; and WHEREAS, As of November of 2019, there are five jurisdictions, including the States of Oregon, Oklahoma, and New Jersey, that have not received DHS approval for REAL ID; and WHEREAS, Between January of 2018 and December of 2019, over 7.2 million Californians have received a REAL ID; and WHEREAS, The American Travel Association conducted a survey in July of 2019 and found that only 16 percent of Americans believe they have a REAL ID license; and WHEREAS, That survey found that 182 million Americans (72 percent) say their drivers licenses are not a REAL ID; and WHEREAS, That survey found that nearly 100 million Americans do not have any form of identification that will be accepted on an airline starting October 1, 2020; and WHEREAS, Fifty-seven percent of Americans are unaware of the October 1, 2020, REAL ID deadline; and WHEREAS, The United States Travel Association estimates that 78,500 travelers could be turned away on the first day of REAL ID implementation, resulting in $40.3 million in lost travel spending on the first day; and WHEREAS, The United States Travel Association estimates that over 500,000 air travelers could be turned away in the first week, costing travel businesses nearly $282 million in lost spending; and WHEREAS, Drivers licenses expire in California every five years, and are permitted to expire under the REAL ID Act every eight years; and WHEREAS, If Californians continue to come into the Department of Motor Vehicles (DMV) field offices at the highest rate since implementation, only 12 million of the 26 million licensed Californians will have a REAL ID by October 1, 2020; and WHEREAS, If DHS keeps the October 1, 2020, deadline, there is the potential to disrupt Thanksgiving, Christmas, and other holiday travel for millions of Americans; and WHEREAS, If DHS extends the REAL ID deadline by three years, completing a five-year cycle of expired IDs, and Californians continue to come into DMV offices at the same monthly rate, most Californians will have a REAL ID by the end of that three-year period; and Resolved by the Assembly and the Senate of the State of California, jointly, That the Legislature calls on DHS to extend the REAL ID deadline for air travel by at least three years to ensure there is not a disruption in air travel as a result of the REAL ID deadline; andResolved, That the Chief Clerk of the Assembly transmit copies of this resolution to the President and the Vice President of the United States, The Secretary of Homeland Security, The Secretary to the Majority Leader of the Senate, to the Speaker of the House of Representatives, to each Senator and Representative from California in the Congress of the United States, and to the author for appropriate distribution.
