11 CALIFORNIA LEGISLATURE 20192020 REGULAR SESSION Senate Bill No. 510Introduced by Senator JonesFebruary 21, 2019 An act to add Section 266m to the Penal Code, relating to crimes. LEGISLATIVE COUNSEL'S DIGESTSB 510, as introduced, Jones. Human trafficking: additional term of sentence.Existing law makes human trafficking a crime, and imposes specified penalties when that offense is committed against a minor, including, at a minimum, 5, 8, or 12 years in state prison and a fine of not more than $500,000. Existing law also makes it a felony to take a person under 18 years of age from the parent or guardian, without their consent, for the purpose of prostitution. This bill would require a person convicted of a human trafficking offense against a minor or of taking a minor for the purpose of prostitution, when any part of the violation takes place upon the grounds of, or within 1,000 feet of, a public or private elementary, vocational, junior high, or high school during the hours that the school is open for classes or school-related programs, or at any time when minors are using the facility, to receive, in addition to any other penalty imposed, an additional term of one year in state prison. By imposing a new enhancement to the penalty of a crime, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.Digest Key Vote: MAJORITY Appropriation: NO Fiscal Committee: YES Local Program: YES Bill TextThe people of the State of California do enact as follows:SECTION 1.
