As used in this article, the following definitions apply:(a) Eligible recipient or recipient means a person to which all of the following applies:(1) The person is either currently enrolled in, or graduated within the past 12 months from, any accredited postsecondary educational institution in the state.(2) The person meets the income eligibility criteria of the Cal Grant Program under Chapter 1.7 (commencing with Section 69430).(3) The person signed a volunteer agreement to serve as an intern in an office.(4) The person serves as an intern in an office for a minimum of 15 hours per week for a period of at least one month.(5) The person is a California resident.(b) Fund means the California Pay Our Interns Fund established pursuant to subdivision (b) of Section 69827.(c) (1) Internship stipend means a monthly payment of one thousand dollars ($1,000) to each recipient working as an unpaid intern for 15 to 20 hours, inclusive, per week, adjusted annually thereafter by an amount equal to the California Necessities Index computed pursuant to Section 11453 of the Welfare and Institutions Code, and rounded to the nearest dollar.(2) Internship stipend means a monthly payment of two thousand dollars ($2,000) to a recipient working as an unpaid intern for 21 or more hours per week, adjusted annually thereafter by an amount equal to the California Necessities Index computed pursuant to Section 11453 of the Welfare and Institutions Code, and rounded to the nearest dollar.(d) Office means an office of the Legislature, the Governors office, the Lieutenant Governors office, or an office of any state agency or department.(e) Program means the California Pay Our Interns Program established in Section 69827.(f) Relocation stipend means a monthly payment of one thousand dollars ($1,000) to a recipient for up to six months, adjusted annually thereafter by an amount equal to the California Necessities Index computed pursuant to Section 11453 of the Welfare and Institutions Code, and rounded to the nearest dollar.69827. (a) The California Pay Our Interns Program is hereby established under the administration of the commission to accomplish all of the following goals:(1) Expand access to internship opportunities in state government for students from low income, marginalized communities.(2) Reduce economic burdens on student interns, resulting in all of the following benefits:(A) Providing students more productive and valuable internship experiences.(B) Improving students overall academic performance.(C) Reducing negative effects of economic stress on students physical and mental health.(3) Expand the pool of public servants to better reflect the breadth and diversity of the state, resulting in more inclusive policy decisions.(b) (1) The California Pay Our Interns Fund is hereby established as the initial depository of all moneys appropriated, donated, or otherwise received for the program. Upon appropriation by the Legislature, the commission shall distribute moneys in the fund to eligible recipients in accordance with this article. The commission shall administer the fund.(2) It is the intent of the Legislature that the sum of five million dollars ($5,000,000) be annually appropriated from the General Fund to the California Pay Our Interns Fund for purposes of the program.(3) The fund may receive funds from additional sources, including, but not limited to, the federal government, philanthropic entities, and financial institutions.(4) Money received pursuant to paragraph (3) shall not be used to supplant any appropriation by the Legislature for the program.(c) Upon appropriation by the Legislature, the commission shall distribute moneys in the fund to eligible recipients in accordance with all of the following:(1) Up to 650 internship stipends shall be approved annually for eligible applicants who are not eligible for relocation stipends. All of the following shall apply to internship stipends awarded under this paragraph:(A) The commission shall approve stipends on a first come, first served basis.(B) Recipients shall only receive stipends for up to two separate internships in their lifetime.(C) Up to 486 of the annual stipends shall be available for students performing internships in an office of the Legislature.(D) Up to 164 of the annual stipends shall be available for students performing internships in the Governors office, the Lieutenant Governors office, or an office of any state agency or department.(2) Up to 150 relocation stipends shall be approved annually for eligible applicants. All of the following shall apply to relocation stipends:(A) The commission shall approve relocation stipends on a first come, first served basis.(B) Eligible recipients shall only receive relocation stipends for up to two separate internships in their lifetime.(C) Up to 113 of the relocation stipends shall be available annually for students performing internships in an office of the Legislature.(D) Up to 37 of the relocation stipends shall be available annually for students performing internships in the Governors office, Lieutenant Governors office, or an office of any state agency or department.(d) A recipient shall not be considered an employee of the state, the commission, or any office. Receipt of the stipend shall not create an assumption of an employment relationship between the recipient and an office.(e) (1) Internship and relocation stipends shall not be considered financial aid. Stipends shall not be considered income for financial aid or other purposes and shall not negatively impact a recipients eligibility for future financial aid.(2) Internship and relocation stipends shall not be considered income for purposes of state taxation.(3) Internship and relocation stipends shall not in any way be classified as wages or earned income.(e) Up to six hundred-fifty thousand dollars ($650,000) of each annual appropriation for the program may be used for program administration and solicitation of applications.(f) On or before July 1 of each year, commencing one year following the first year in which internship stipends are awarded under the program, the commission shall submit a report of the preceding award year to the Legislature, pursuant to Section 9795 of the Government Code, and the Governor. Each report shall include all of the following information for the preceding award year:(1) The number of applicants.(2) The number of recipients of internship stipends and relocation stipends.(3) The total amount of funds distributed to each recipient.(4) Applicant and recipient demographic information including, but not limited to, race, ethnicity, sex, sexual identity, county of residence, veteran status, age, disability, postsecondary educational institution of matriculation, the office in which the internship is served, the location and length of the internship, and the recipients total annual household income.(g) The commission shall be responsible for promulgating rules and regulations governing the administration of the program and fund.

Upon appropriation by the Legislature, the commission shall distribute moneys in the fund to eligible recipients in accordance with this article. The commission shall administer the fund.(2) It is the intent of the Legislature that the sum of five million dollars ($5,000,000) be annually appropriated from the General Fund to the California Pay Our Interns Fund for purposes of the program.(3) The fund may receive funds from additional sources, including, but not limited to, the federal government, philanthropic entities, and financial institutions.(4) Money received pursuant to paragraph (3) shall not be used to supplant any appropriation by the Legislature for the program.(c) Upon appropriation by the Legislature, the commission shall distribute moneys in the fund to eligible recipients in accordance with all of the following:(1) Up to 650 internship stipends shall be approved annually for eligible applicants who are not eligible for relocation stipends.
