Existing law requires the director to administer and enforce the provisions of the Vehicle Code relating to the Department of Motor Vehicles.Existing law authorizes the Director of General Services, with the consent of the Department of Motor Vehicles, to lease or exchange, for a term of years, as determined by the director, and for fair market value, specified parcels of real property that are acquired and used by the state for the benefit of the Department of Motor Vehicles, for the purpose of developing mixed public- and private use facilities, subject to specified conditions.This bill would require the Director of General Services, in consultation with the Director of Motor Vehicles and the city in which specified properties are located, to enter into a public-private partnership agreement with a housing developer for the lease for a term of years, as determined by the Director of General Services, of specified parcels of real property that are acquired and used by the state for the benefit of the Department of Motor Vehicles to develop affordable housing and new field offices for the Department of Motor Vehicles, subject to specified conditions. (a) Notwithstanding any other law, the Director of General Services, in consultation with the Director of Motor Vehicles and the city in which the properties, as described in this section, are located, shall enter into a public-private partnership agreement with a housing developer for the lease for a term of years, as determined by the Director of General Services, of portions of parcels of real property that are acquired and used by the state for the benefit of the Department of Motor Vehicles, as described in subdivision (b), for the purpose of developing affordable housing and new field offices for the Department of Motor Vehicles, subject to all of the following conditions:(1) The lease shall be at no cost to the housing developer except that the housing developer shall pay for all costs required to construct affordable housing units and a new field office for the Department of Motor Vehicles.(2) One hundred percent of the housing units developed pursuant to this section shall be offered for rent at affordable rates.(3) The Department of Motor Vehicles shall continue to provide limited services at the field office during the construction process. If the Department of Motor Vehicles is unable to provide certain in-person services, including, but not limited to, driving tests, at the field office, the Department of Motor Vehicles shall notify the public of other field offices that offer those services.(4) The developer shall construct ample parking for the use of providing services at the Department of Motor Vehicles and for the added residential uses. The Department of Motor Vehicles shall retain full control and discretion of the parking necessary for services at the Department of Motor Vehicles; the number of parking spaces constructed shall not be less than the number of spaces that exist on each of the parcels listed in subdivision (b), on January 1, 2022, unless otherwise agreed to by the Department of General Services in consultation with the Department of Motor Vehicles. (b) For purposes of this section, all of the following parcels of real properties shall be leased pursuant to subdivision (a):(1) 2235 Colorado Avenue, Santa Monica.(2) 11400 W Washington Blvd, Culver City.(3) 803 Cole Avenue, Los Angeles.(c) The Department of Motor Vehicles shall assist the Director of General Services in the fulfillment of the requirements of this section.SEC. 2. The Legislature hereby finds and declares that the lease authorized by Section 14670.23 of the Government Code as added by this bill serves the public purpose of supporting the development of affordable housing and new Department of Motor Vehicle field offices, and does not constitute a gift of public funds within the meaning of Section 6 of Article XVI of the California Constitution.
