The bill would require the department to to, among other things, select at least 3 regional centers to participate in the pilot project, identify up to 4 types of services for which metrics and methods of data collection will be developed, and develop metrics and methods of data collection that evaluate specified indicators related to the provision of services. The bill would require regional centers that participate in the pilot project to permit its service delivery system to be used to test the metrics and methods of data collection developed by the department and to ensure that regional center employees and service providers take specified actions. The bill would authorize the department to contract for certain services to implement the pilot project and would exempt those contracts from the Public Contract Code and review by the Department of General Services. The bill would authorize the department to implement the pilot project by means of program directives or similar instruction. (a) The Legislature finds and declares all of the following:(1) Individuals with developmental disabilities have the opportunity to choose their way of life and must be offered services to support these choices.(2) It is critical that the options afforded to these individuals approximate everyday living patterns available to people without disabilities of the same age, as required by Section 4501 of the Welfare and Institutions Code, and that these options become the focus in the provision of developmental disability services.(3) California currently lacks clear and consistent service delivery outcomes for individuals with developmental disabilities and must develop a mechanism for measuring and quantifying the value of delivery outcomes.(b) It is the intent of the Legislature in enacting this act to do all of the following:(1) Initiate a pilot project within the State Department of Developmental Services that will provide stakeholders with meaningful information about service effectiveness.(2) Ensure that individual recipients are receiving quality services, and that Californias network of regional centers and service provider staff benefit from outcome-based training to implement the shift to delivery-based outcomes, as well as the development of continued service improvement.(3)Use data from the pilot project to inform service provider rate recommendations that will allow qualified staff to be hired at wages that are competitive with similar occupations within and without the developmental services system.(4)(3) Not replicate data and research performed through the National Core Indicators, but complement National Core Indicator data through a granular analysis of service provision and usage.(5)(4) Not change, limit, or otherwise alter the services provided to a consumer as a result of its participation in the pilot project.SEC. 2. Section 4648.10 is added to the Welfare and Institutions Code, immediately following Section 4648.1, to read:4648.10. (a) The department shall, on or before July 1, 2023, establish a pilot project to develop metrics and methods of data collection to evaluate the outcomes of services authorized by regional centers and provided through an approved a provider to consumers. As part of the pilot project, the department shall do all of the following:(1) Select at least three regional centers, from among those that are interested, to participate in the pilot project.(2) In consultation with stakeholders, identify up to four types of services provided to consumers by regional centers for which metrics and methods of data collection will be developed in the pilot project.(3) Develop metrics and methods of data collection that evaluate, at a minimum, outcomes related to method of service delivery, service quality, and consumer and family satisfaction with provided services.(4) Develop clear definitions of services and their specifications to allow persons with developmental disabilities to achieve and maintain access to their chosen ways of life. The department may temporarily modify service codes to align with the goals and outcomes of this pilot project. Any modification of service codes pursuant to this paragraph shall be limited to the service codes associated with the services identified pursuant to paragraph (2) and the modification shall be limited to the duration of the pilot project.(5) Use service definition and specification methods to allow an individual users race, culture, language, gender identification, and sexual orientation to be respected when using services to access their chosen way of life.(b) (1) A regional center that participates in the pilot project established pursuant to subdivision (a) shall be responsible for both of the following:(A) Permitting its service delivery system to be used to test the metrics and methods of data collection developed.(B) Ensuring that regional center employees and service providers do both of the following:(i) Participate in the necessary training to test the metrics and methods of data collection developed. The training shall include, at a minimum, data collection standards and confidentiality.(ii) Agree, in writing, to the terms of the pilot project prior to participating.(2) A regional center that participates in the pilot project established pursuant to subdivision (a) shall not change, limit, or otherwise alter the services provided to a consumer as a result of its participation in the pilot project.(c) The department may, in consultation with stakeholders, contract for technological services to support the pilot project, including information technology and technical assistance, and project management. The director department may contract on a bid or nonbid basis for these services. The contracts shall not be subject to the Public Contract Code or review by the Department of General Services.(d) Notwithstanding the rulemaking provisions of the Administrative Procedure Act (Chapter 3.5 (commencing with Section 11340) of Part 1 of Division 3 of Title 2 of the Government Code), the department may implement, interpret, or make specific this section by means of program directives or similar instructions, without taking any regulatory action. (e) This section shall remain in effect only until January 1, 2027, and as of that date is repealed.
