LEGISLATIVE COUNSEL'S DIGESTSB 1463, as introduced, Archuleta. Hydrogen fueling hub: southern California.Existing law requires the State Air Resources Board to adopt hydrogen fuel regulations to ensure, among other things, that state funding for the production and use of hydrogen fuel contributes to the reduction of emissions of greenhouse gases, criteria air pollutants, and toxic air contaminants. Existing law requires the State Energy Resources Conservation and Development Commission, in partnership with the state board, and in consultation with the State Water Resources Control Board, the Department of Food and Agriculture, and other relevant state agencies, to develop and adopt a state plan to increase the use of alternative transportation fuels, which include hydrogen. This bill would require the commission to establish a hydrogen fueling hub in southern California that would include a heavy-duty hydrogen fueling station located at either the Port of Long Beach or the Port of Los Angeles and a medium- and light-duty hydrogen fueling station located within 80 miles of the heavy-duty station. The bill would require the commission to manage those stations. This bill would make legislative findings and declarations as to the necessity of a special statute for southern California.Digest Key Vote: MAJORITY Appropriation: NO Fiscal Committee: YES Local Program: NO Bill TextThe people of the State of California do enact as follows:SECTION 1. Section 43867 of the Health and Safety Code is amended to read:43867. For the purposes of this article, the following terms have the following meanings: definitions apply:(a) Alternative fuel means a nonpetroleum fuel, including electricity, ethanol, biodiesel, hydrogen, methanol, or natural gas that, when used in vehicles, has been demonstrated, to the satisfaction of the state board, to have the ability to meet applicable vehicular emission standards. For the purpose of this section, alternative fuel may also include petroleum fuel blended with nonpetroleum constituents, such as E85 or B20.(b) Energy Commission means the State Energy Resources Conservation and Development Commission.(b)(c) Full fuel-cycle assessment means evaluating and comparing the full environmental and health impacts of each step in the life cycle of a fuel, including, but not limited to, all of the following:(1) Feedstock extraction, transport, and storage.(2) Fuel production, distribution, transport, and storage.(3) Vehicle operation, including refueling, combustion or conversion, and evaporation.SEC. 2. Section 43872 is added to the Health and Safety Code, to read:43872. (a) The Energy Commission shall establish a hydrogen fueling hub in southern California.(b) The hydrogen fueling hub shall include two hydrogen fueling stations, as follows:(1) One hydrogen fueling station shall be a heavy-duty station located at either the Port of Long Beach or the Port of Los Angeles.(2) One hydrogen fueling station shall be a medium- and light-duty station located within 80 miles of the heavy-duty station. (c) The Energy Commission shall manage the hydrogen fueling stations.SEC. 3. The Legislature finds and declares that a special statute is necessary and that a general statute cannot be made applicable within the meaning of Section 16 of Article IV of the California Constitution because southern California is uniquely positioned to support, and benefit from, a hydrogen fueling station due to its existing ports and hydrogen infrastructure. |
