The number of members of the board of directors shall be increased as follows:(a) (1) Each member entity that is annexed after initial formation of the district as set out in Section 102100.2 may appoint one member to the board, except as specified in paragraph (2).(2) Notwithstanding paragraph (1), for so long as the City of Elk Grove remains annexed into the district, the City of Elk Grove may appoint two members to the board.(b) A city or county that is not annexed to the district may become a participating entity that may appoint at least one member to the board if the participating entity enters into an agreement with the district that provides for all of the following:(1) The participating entity agrees to pay its proportionate share of the districts cost to provide rail or other districtwide transit services.(2) The district agrees to maintain a specified level of rail or other districtwide transit services.(3) The district is not obligated to provide transit services to any particular location or along any particular route.SEC. 2. The Legislature finds and declares that a special statute is necessary and that a general statute cannot be made applicable within the meaning of Section 16 of Article IV of the California Constitution because of the unique circumstances applicable to the City of Elk Grove: In 2000 when the City of Elk Grove was incorporated, the city had a population of 81,663, and, as part of its incorporation, the city was given one seat on the Sacramento Regional Transit Districts board of directors; however, 23 years later, the city is now uniquely situated because the citys population has grown to 178,997, according to the 2021 census, and, given that population increase, the city should have additional representation on the board.
