(a)A motor vehicle insured pursuant to a policy of insurance issued under Section 11580.1 or 11580.2 shall not be classified as a common carrier, commercial vehicle, for-hire vehicle, permissive use vehicle, or livery solely for the reason that the named insured, who works in public social services, provides social services transportation support to an individual with special transportation needs as part of the insureds employment. insured is operating or using the insured motor vehicle to provide public social services, as defined in Section 10051 of the Welfare and Institutions Code, or social service transportation, as defined in subdivision (f) of Section 11580.1.(b)For purposes of this section, the following terms have the following meanings:(1)An individual with special transportation needs means an individual receiving social services transportation support due to a physical, mental, or behavioral condition.(2)Public social services means those activities and functions of state and local government administered or supervised by the Department of Rehabilitation, the State Department of Developmental Services, the State Department of Health Care Services, or the State Department of Social Services and involved in providing supports or services, or both, to those people of the state who, because of their physical, mental, or behavioral condition, are in need thereof and may benefit thereby.(3)Social services transportation support includes both of the following: (A)Travel by the insured to and from locations necessary to fulfill the support or care needs of an individual with special transportation needs.(B)Occasional transportation of an individual with special transportation needs by the insured to and from locations necessary to fulfill the individuals support or care needs.
