26+The bill creates the Colorado jail standards commission
27+(commission) in the department of public safety. The commission creates
28+standards for the operation of Colorado's county jails (jails) and updates
29+the standards as necessary. The commission consists of the following 20

64+! One non-law-enforcement person with experience working
65+in a jail, appointed by the executive director of the
66+department of public safety;
67+! The state public defender or the state public defender's
68+designee;
69+! One district attorney, appointed by the Colorado district
70+attorneys' council; and
71+! One person representing the department of public safety
72+with expertise in jail operations.
73+The commission shall develop standards for all aspects of jail
74+operations as follows:
75+! Reception and release;
76+! Classification of inmates;
77+! Security;
78+! Housing;
79+! Sanitation and environmental conditions;
80+! Communication;
81+! Visitation;
82+! Health care, mental and behavioral health care, and dental
83+care;
84+! Food service;
85+! Recreation and programming;
86+! Inmate disciplinary processes;
87+! Restrictive housing;
88+! Inmate grievances;
89+! Staffing; and
90+! Inmates' prerogatives.
91+The commission shall establish standards regarding oversight of
92+the standards; compliance with the standards, including a requirement for

94+-2- a biennial compliance inspection of each jail; a complaint process and
95+investigation process; and possible sanctions for noncompliance with or
96+violations of the standards. The department of public safety shall
97+promulgate rules adopting the standards and possible sanctions.
98+The department of public safety shall provide oversight of the
99+implementation of the standards. The commission shall evaluate the
100+effectiveness of the standards after implementation and make any needed
101+changes to the standards.
102+The bill sunsets the commission on September 1, 2029.

115+HOUSE OF REPRESENTATIVES SHALL APPOINT THE MEMBERS OF THE13

117+(I) THE PRESIDENT OF THE SENATE SHALL APPOINT TWO SENATORS15

953-Section 4. Effective date. This act takes effect upon passage; except

956-section 2 of this act takes effect on January 1, 2022.
957-SECTION 3. Appropriation. For the 2022-23 state fiscal year,
958-$96,039 is appropriated to the legislative department. This appropriation is
959-from the general fund. To implement this act, the department may use this
960-appropriation as follows:

962-on an assumption that the council will require an additional 0.9 FTE; and
963-(b) $5,660 for use by the general assembly.

966-preservation of the public peace, health, or safety.
