4747 SECTION 1. In Colorado Revised Statutes, 2-3-1201, amend (1)2

5151 membership. (1) (a) At the convening of the first regular session of each

5353 general assembly, the speaker of the house of representatives and the7
5454 president of the senate shall each designate one or more house8
5555 committees of reference for even-numbered years and one or more senate9
5656 committees of reference for odd-numbered years to perform the duties10
5757 and functions assigned to it relating to the termination of each division,11
5858 board, or agency pursuant to the provisions of section 24-34-104, C.R.S.,12

138138 and functions for repeal, continuation, or reestablishment - legislative6
139139 declaration - repeal. (6) (a) Before the repeal, continuation, or7
140140 reestablishment of an agency or function, a legislative committee of8
141141 reference designated THE COMMITTEE FOR SUNRISE AND SUNSET REVIEW9
142142 CREATED in section 2-3-1201, C.R.S., REFERRED TO IN THIS SECTION AS10

144144 THE COMMITTEE", shall hold public hearings to receive testimony from11
145145 the public, the executive director of the department of regulatory12
146146 agencies, and the agencies involved. In the hearing, each agency has the13
147147 burden of demonstrating that there is a public need for the continued14
148148 existence of the agency or function and that its regulation is the least15
149149 restrictive regulation consistent with the public interest.16
150150 (c) A legislative committee of reference that conducts
151151 IN17
152152 CONDUCTING a review pursuant to paragraph (a) of this subsection (6)18
153153 SUBSECTION (6)(a) OF THIS SECTION, THE COMMITTEE shall determine19
154154 whether an agency or function should be repealed, continued, or20
155155 reestablished and whether its functions should be revised and, if21
156156 advisable, may recommend the consideration of a proposed bill to carry22
157157 out its recommendations.23
158158 (d) (I) If a legislative committee of reference THE COMMITTEE24
159159 recommends a bill for consideration pursuant to paragraph (c) of this25
160160 subsection (6), the bill must be introduced in the house of representatives26
161161 in even-numbered years and in the senate in odd-numbered years27

163163 -5- SUBSECTION (6)(c) OF THIS SECTION, the chair of each legislative1
164164 committee of reference that recommends a bill for consideration THE2
165165 COMMITTEE shall assign the proposed bill for sponsorship as follows:3
166166 (A) To one or more of the members of the committee; of4
167167 reference; or5
168168 (B) To one or more of the members of the general assembly who6
169169 are not members of the committee of reference if a majority of the7
170170 committee's members vote to approve the sponsorship.8
171171 (III) The speaker of the house of representatives shall assign the9
172172 proposed bill to a representative for sponsorship in the house of10
173173 representatives in odd-numbered years. The president of the senate shall11
174174 assign the proposed bill to a senator for sponsorship in the senate in12
175175 even-numbered years.13
176176 (e) A bill recommended for consideration by a committee of14
177177 reference THE COMMITTEE pursuant to paragraph (c) of this subsection (6)15
178178 SUBSECTION (6)(c) OF THIS SECTION does not count against the number of16
179179 bills to which members of the general assembly are limited by law or joint17
180180 rule of the senate and house of representatives.18
181181 (f) Before the repeal, continuation, reestablishment, or revision of19
182182 an agency's functions, a committee of reference in each house of the20
183183 general assembly designated by section 2-3-1201, C.R.S., THE21
184184 COMMITTEE shall hold a public hearing to consider the report from the22
185185 department of regulatory agencies and any bill recommended for23
186186 consideration pursuant to paragraph (c) of this subsection (6) SUBSECTION24

194194 -6- (7) (a) Pursuant to the process established in this section, a1
195195 committee of reference THE COMMITTEE may not continue, reestablish, or2
196196 amend the functions of more than one division, board, or agency in any3
197197 one bill for an act, and the title of the bill must include the name of the4
198198 division, board, or agency. This paragraph (a) SUBSECTION (7)(a) does not5
199199 apply to requirements for periodic reports to the general assembly.6
200200 SECTION 5. In Colorado Revised Statutes, 24-34-104.1, amend7
201201 (2)(a) introductory portion, (2)(b), (3)(a), (3)(b)(I) introductory portion,8
202202 (3)(b)(II), (3)(c), and (6)(b); and add (4)(a.5) and (5.5) as follows: 9
203203 24-34-104.1. General assembly sunrise review of new10
204204 regulation of occupations and professions - repeal. (2) (a) For11
205205 proposals submitted on or after July 1, 2012 THE EFFECTIVE DATE OF THIS12
206206 SECTION, AS AMENDED, any professional or occupational group or13
207207 organization, any individual, or any other interested party that proposes14
208208 the regulation of any unregulated professional or occupational group shall15
209209 submit the following information to the department of regulatory agencies16
210210 COMMITTEE FOR SUNRISE AND SUNSET REVIEW CREATED IN SECTION17
211211 2-3-1201,
212212 REFERRED TO IN THIS SECTION AS "THE COMMITTEE", no later18
213213 than December 1 of any year for analysis and evaluation during the

215215 following year TWELVE DAYS AFTER THE C ONVENING OF THE REGULAR20
216216 SESSION OF THE GENERAL ASSEMBLY :21
217217 (b) The department COMMITTEE shall review a proposal to regulate22
218218 a professional or occupational group only when the party requesting the23
219219 review files a statement of support for the proposed regulation that has24
220220 been signed by at least ten members of the professional or occupational25
221221 group for which regulation is being sought or at least ten individuals who26
222222 are not members of the professional or occupational group.27

224224 -7- (3) (a) Except as provided in paragraph (b) or (c) of this1
225225 subsection (3) SUBSECTION (3)(b) OR (3)(c) OF THIS SECTION, NO LATER2
226226 THAN TWENTY DAYS AFTER THE CONVENING OF THE REGULAR SESSION OF3
227227 THE GENERAL ASSEMBLY, THE COMMITTEE SHALL REQUEST the department4
228228 of regulatory agencies shall TO conduct an analysis and evaluation of any5
229229 proposed regulation. submitted on or after July 1, 2012. The DEPARTMENT6

231231 be based upon the criteria listed in paragraph (b) of subsection (4)8

267267 professional or occupational group poses an imminent threat to public8
268268 health, safety, or welfare, the department
269269 COMMITTEE shall promptly9
270270 notify the proponents of the proposed regulation and the legislative10
271271 council of the general assembly of the imminent threat and shall submit11
272272 to the legislative council the documentation on which it bases its finding12
273273 of imminent threat. Within thirty days after receipt of the notice and13
274274 documentation from the department COMMITTEE, the legislative council14
275275 shall conduct a hearing to examine the documentation and determine15
276276 whether it concurs with the department's COMMITTEE'S finding that an16
277277 imminent threat exists. In conducting its examination, the legislative17
278278 council shall consider whether regulation of the professional or18
279279 occupational group without first obtaining an analysis and evaluation19
280280 pursuant to paragraph (a) of this subsection (3) SUBSECTION (3)(a) OF THIS20
281281 SECTION will substantially alter the impact on public health, safety, or21
282282 welfare. The department may forego the analysis and evaluation only if22
283283 the legislative council notifies the
284284 COMMITTEE AND THE department that23
285285 the legislative council concurs with the department's
286286 finding of imminent24
287287 threat to public health, safety, and welfare.25

346346 SECTION 6. Safety clause. The general assembly hereby finds,16
347347 determines, and declares that this act is necessary for the immediate17
348348 preservation of the public peace, health, or safety.18
