9-ONCERNING MODIFICATIONS TO THE COLORADO WORKS PROGRAM , AND, IN
10-CONNECTION THEREWITH
11-, MAKING AN APPROPRIATION.
12-Be it enacted by the General Assembly of the State of Colorado:
13-SECTION 1. Legislative declaration. (1) The general assembly
14-finds and declares that:
15-(a) "Temporary Assistance for Needy Families" (TANF), known as
16-the "Colorado Works Program" (works program), provides financial
17-assistance and work supports to families living far below the federal poverty
18-level. The works program should promote family safety, stability, and
19-self-sufficiency by assisting with job preparation and supporting career
20-goals and employment. As of fiscal year 2021-22, a parent with two
21-children must make less than $421 per month in income to qualify for a

30-pandemic brought unprecedented hardships and changes to both families
31-and the works program. Even before the COVID-19 pandemic, families
32-enrolled in the works program were facing the greatest barriers to financial
33-security and well-being.
34-(b) Families enrolled in the works program are eligible to receive
35-cash assistance to help meet the family's ongoing basic needs, such as
36-diapers, food, bus passes, and school supplies. Cash assistance payments
37-were not adequate at the start of the works program in 1996 and since
38-payments have not adjusted for inflation, cash assistance has eroded even
39-further and failed to keep up with the cost of living in Colorado. In 1996,
40-the amount of Colorado's cash assistance was 32.9% of the federal poverty
41-level, but by 2021 it had fallen to 27.8% with the maximum amount of cash
42-assistance for a parent with two children at $508 per month.
43-(c) Families can often face a "cliff effect" when the family receives
44-more income through employment or a raise and then abruptly has its public
45-assistance reduced or discontinued. Too often families are left without
46-supports right when they begin to get their feet underneath them. Reducing
47-the "cliff effect" will incentivize work, help parents stay employed, and
48-create a smoother off-ramp toward employment, self-sufficiency, and
49-economic security.
50-(d) Families can be better supported in the works program by
51-reducing punitive sanctions and overly burdensome work requirements.
52-While sanctions and work requirements are required by the federal
53-government, states have some discretion on how to administer those
54-requirements. Colorado has made some strides in easing these requirements
55-and can do more to be responsive to families' circumstances and needs.
56-Sanctions, or financial penalties that are issued when a participant does not
57-meet the work requirements of the works program, are disproportionately
58-applied to certain families, including families of color, do not achieve the
59-intended outcome of connecting families to sustainable employment, and
60-increase the administrative burden on case managers and counties.
61-Moreover, families who receive sanctions face the most significant barriers
62-to employment and economic security, such as a child being hospitalized,
63-domestic violence, lack of a vehicle, or less work experience.
64-(e) Colorado receives federal TANF funds each year and the state
65-PAGE 2-HOUSE BILL 22-1259 is permitted to retain a certain amount of unexpended funds for future use
66-in the event of an economic downturn or caseload growth. Colorado has two
67-sets of TANF reserves: A state TANF long-term reserve and a TANF
68-reserve in each county. Although there was severe economic downturn,
69-including historic unemployment, during the COVID-19 pandemic, the
70-amount of money in the reserves actually increased in Colorado. The
71-beginning fiscal year 2021-22 balance of all county TANF reserves was
72-$61.2 million and the balance in the state TANF long-term reserve, which
73-has a mandatory floor of $33 million, was $76.2 million. In total, there was
74-more than $137 million in TANF reserves in Colorado at the end of the
75-2020-21 fiscal year.
76-(f) To support the economic recovery from the COVID-19
77-pandemic, the department of human services may receive additional money
78-to support subsidized training and employment. The money may be used to
79-support current Colorado works participants and individuals who are
80-eligible for short-term non-recurrent assistance and other assistance, as
81-defined by the state board of human services, whose income does not
82-exceed 200% of the federal poverty level.
83-(2) Therefore, the general assembly declares that Colorado must
84-prioritize strategies and investments to remove barriers to employment and
85-economic security for families and children experiencing extreme poverty
86-in the state. Colorado should ensure a basic cash assistance amount
87-sufficient enough to lift families out of extreme poverty and ensure that it
88-keeps with the rising cost of living; make improvements in the way the
89-works program serves families, including reducing the "cliff effect"; elevate
90-family voices in the works program; and improve outreach and
91-communication about the works program.
92-(3) The general assembly further finds and declares that the increase
93-in basic cash assistance grants and funding for subsidized employment
94-established in this act are critical government services.
95-SECTION 2. In Colorado Revised Statutes, 26-2-705, amend (2)(a)
96-and (2)(e) as follows:

51+income to a monthly amount using the lowest ratio or methodology that
52+results in the lowest monthly income amount allowable under federal law.
53+Current law prohibits a person convicted of a drug-related felony
54+offense from being eligible for assistance under the works program unless
55+the person is determined by a county department of human or social
56+services to have taken action toward rehabilitation. The bill removes the
57+ban on eligibility.
58+The bill requires the state board to promulgate rules establishing
59+statewide standards and procedures that require counties to offer an
60+extension:
61+! Beyond the 60-month lifetime maximum for all households
62+that demonstrate good cause, which includes an applicant
63+or participant who is a child-only case, the head of a single
64+parent household and has a child under one year of age,
65+experiencing hardship, or addressing family or medical
66+needs; and
67+! From work requirements to all households that demonstrate
68+good cause, which includes for an applicant or participant
69+who is the head of a single-parent household and has a
70+child under one year of age, experiencing hardship, or
71+addressing family or medical needs.
72+The bill requires the state department to annually review and
73+promulgate rules as necessary to update the standard of need to ensure the
74+standard of need is equitable, promotes economic mobility and
75+self-sufficiency, and reflects the current economic status of the state.
76+The bill requires the state department to disregard any earned
77+income for at least the first 6 months an applicant or participant is
78+employed while enrolled in the works program. The bill requires that the
79+state department determine the amount of earned income that must be
80+disregarded after the first 6 months and ensure a gradual step down of the
81+amount of earned income disregarded and that the appropriate work
82+supports are made available to the applicant or participant.
83+Current law requires the state department to ensure the amount of
84+a basic cash assistance grant that an applicant or participant receives is
85+equal to or exceeds 102% of the need standard for a participant in a
86+similarly sized household on January 1, 2008. By the 2027-28 state fiscal
87+year, and each state fiscal year thereafter, the bill requires the amount of
88+the basic cash assistance grant to equal or exceed 50% of the federal
89+poverty guidelines established by the federal department of health and
90+human services for a similarly sized household for that fiscal year.
91+No later than January 1, 2023, the bill requires the state department
92+to begin phasing in the increase in basic cash assistance that is equal to or
93+exceeds 50% of the federal poverty guidelines.
94+The bill requires a county department to attempt to contact each
95+1259
96+-2- participant using each method of communication provided by the
97+participant in order to conduct exit and follow-up interviews upon case
98+closure. The bill expands the purpose of the exit and follow-up interviews
99+to include evaluating the participant's experience with the works program,
100+how well the program met the participant's needs and assisted the
101+participant in meeting the participant's goals, and informing the state
102+department of any changes to rules that are needed to improve the
103+participant's experience.
104+The bill requires the state department to monitor impacts to
105+counties' workload in the works program and consult with counties
106+regarding additional need for money to administer the works program.
107+Beginning January 2023, and each January thereafter, the state
108+department is required to submit a report to the general assembly on the
109+effectiveness of the works program.
110+Current law requires the state board to promulgate rules that
111+require a percentage reduction in the basic cash assistance grant upon the
112+imposition of a sanction affecting the grant, with the percentage to be
113+specified in the rules but not to be less than 25%. The bill requires the
114+percentage not to exceed one dollar.
115+No later than September 30, 2022, the bill requires the state
116+department to develop an outreach and engagement plan to promote
117+access to the works program for eligible persons.

784+payments - interest - appropriations - records - rules. (2) (d) The19
785+following amounts constitute fiscal year spending for purposes of section20
786+20 of article X of the state constitution:21
787+(III) Any money that is credited to the housing development grant22
788+fund created in section 24-32-721 (1) as required by subsection (3.5) of23
789+this section; and24
790+(IV) Any money that is transferred to the general fund as required25

817-SECTION 14. Appropriation. For the 2022-23 state fiscal year,
818-$3,500,000 is appropriated to the department of human services for use by
819-the office of economic security. This appropriation is from the economic
820-recovery and relief cash fund created in section 24-75-228, C.R.S., and is
821-of money the state received from the federal coronavirus state fiscal
822-recovery fund. To implement this act, the office may use this appropriation
823-for the employment opportunities with wages program. Any money
824-appropriated in this section not expended prior to July 1, 2023, is further
825-appropriated to the office from July 1, 2023, through December 30, 2024,
826-for the same purpose.
827-SECTION 15. Appropriation. (1) For the 2022-23 state fiscal
828-year, $9,849,303 is appropriated to the department of human services. This
829-appropriation is from the Colorado long-term works reserve created in
830-section 26-2-721 (1), C.R.S. To implement this act, the department may use
831-this appropriation as follows:
832-(a) $382,903 for use by the office of economic security for
833-administration related to the employment and benefits division, which
834-amount is based on an assumption that the division will require an
835-additional 5.0 FTE;
836-(b) $8,400,000 for use by the office of economic security for county
837-block grants; and
838-(c) $1,066,400 for use by the office of economic security for
839-operating and contract expenses related to the Colorado benefits
840-management system.
841-(2) For the 2022-23 state fiscal year, $1,066,400 is appropriated to
842-the office of the governor for use by the office of information technology.
843-This appropriation is from reappropriated funds received from the
844-department of human services under subsection (1)(c) of this section. To
845-implement this act, the office may use this appropriation to provide
846-information technology services for the department of human services.
847-SECTION 16. Safety clause. The general assembly hereby finds,

849-preservation of the public peace, health, or safety.
