18-Be it enacted by the General Assembly of the State of Colorado:
19-SECTION 1. Legislative declaration. (1) The general assembly
20-finds and declares that:
21-(a) During the COVID-19 pandemic, adults with behavioral health
22-needs have faced unprecedented challenges;
23-NOTE: This bill has been prepared for the signatures of the appropriate legislative
24-officers and the Governor. To determine whether the Governor has signed the bill
25-or taken other action on it, please consult the legislative status sheet, the legislative
26-history, or the Session Laws.

30-the act. (b) During this time, adults and their families have needed increased
31-availability of behavioral and mental health care, including residential beds;
32-(c) At least one hundred twenty-five additional residential beds for
33-adults with severe mental illness or urgent behavioral health needs that
34-require long-term services and supports or immediate intervention must be
35-created statewide and made available as long as necessary for stabilization;
36-(d) The Colorado mental health institute at Fort Logan needs sixteen
37-additional beds to serve adults in need of competency services and adults
38-with serious mental illness or chronic behavioral health needs in need of
39-civil commitment;
40-(e) The federal government enacted the "American Rescue Plan Act
41-of 2021" to enable state, local, and tribal governments to provide critical
42-government services in response to the adverse impacts of the COVID-19
43-pandemic;
44-(f) People with serious mental illness are in need of longer-term
45-treatment and stabilization services in their communities;
46-(g) The residential beds funded by this act are appropriate uses of
47-the federal money transferred to Colorado under the "American Rescue Plan
48-Act". This funding will expand access to residential beds; and
49-(h) The services described in this act are critical government
50-services.

52+The bill also directs the department and the department of health
53+care policy and financing to create, develop, or contract to add at least
54+125 additional beds at mental health residential treatment facilities
55+(treatment facilities) throughout the state for adults in need of ongoing
56+supportive services. The bill requires treatment facilities to be licensed by
57+the department of public health and environment as an assisted living
58+facility or by the department as a behavioral health entity during the
59+2022-23 state fiscal year. Starting in the 2023-24 state fiscal year, the
60+treatment facilities must be licensed by the behavioral health
61+administration.
62+The bill appropriates $65 million for the renovation of the building
63+and the creation, development, or contracting for the new beds at
64+treatment facilities.

335-amount is based on an assumption that the department will require 3.3 FTE
336-in the 2022-23 state fiscal year and 3.3 FTE in the 2023-24 state fiscal year;
337-(b) $346,040 for operating expenses related to administration; and
338-(c) $9,992 for vehicle lease payments.
339-(2) For the 2022-23 state fiscal year, $9,992 is appropriated to the
340-department of personnel for use by the division of capital assets. This
341-appropriation is from reappropriated funds received from the department of
342-human services under subsection (1)(c) of this section. To implement this
343-act, the department of personnel may use this appropriation to provide
344-vehicles to the department of human services. Any money appropriated in
345-this section not expended prior to July 1, 2023, is further appropriated to the

367-SECTION 6. Appropriation. For the 2022-23 state fiscal year,
368-$6,578,266 is appropriated to the department of human services for use by
369-the office of behavioral health. This appropriation is from the behavioral
370-and mental health cash fund created in section 24-75-230 (2)(a), C.R.S., and
371-is of money the state received from the federal coronavirus state fiscal
372-recovery fund. The office may use this appropriation for costs associated
373-with the operation of additional beds at the Colorado mental health institute
374-at Fort Logan established pursuant to section 27-94-107, C.R.S. Any money
375-appropriated in this section not expended prior to July 1, 2023, is further
376-appropriated to the office from July 1, 2023, through December 30, 2024,
377-for the same purpose. These appropriations are based on the assumption that
378-the office will require an additional 59.2 FTE in the 2023-24 state fiscal
379-year to implement this act.
380-SECTION 7. Capital construction appropriation. For the
381-2022-23 state fiscal year, $6,991,567 is appropriated to the department of
382-human services. This appropriation is from the behavioral and mental health
383-cash fund created in section 24-75-230 (2)(a), C.R.S. To implement this act,
384-the department may use this appropriation for capital construction related
385-to the renovation for additional inpatient beds at the Colorado mental health
386-institute at Fort Logan. Any money appropriated in this section not
387-expended prior to July 1, 2023, is further appropriated to the department
388-from July 1, 2023, through December 30, 2024, for the same purpose.
389-SECTION 8. Capital construction appropriation. For the
390-2022-23 state fiscal year, $3,692,111 is appropriated to the department of
391-human services. This appropriation is from the behavioral and mental health
392-cash fund created in section 24-75-230 (2)(a), C.R.S. To implement this act,

399-SECTION 9. Appropriation. (1) For the 2022-23 state fiscal year,
400-$91,938 is appropriated to the department of health care policy and
401-financing for use by the executive director's office. This appropriation is
402-from the general fund. To implement this act, the office may use this
403-appropriation as follows:
404-(a) $84,388 for personal services, which amount is based on an
405-assumption that the office will require an additional 1.8 FTE; and
406-(b) $7,550 for operating expenses.
407-(2) For the 2022-23 state fiscal year, the general assembly
408-anticipates that the department of health care policy and financing will
409-receive $91,937 in federal funds to implement this act, which amount is
410-subject to the "(I)" notation as defined in the annual general appropriation
411-act for the same fiscal year. The appropriation in subsection (1) of this
412-section is based on the assumption that the department will receive this
413-amount of federal funds to be used as follows:

378+appropriations are based on the assumption that the office will require an24
379+additional 59.2 FTE in the 2023-24 state fiscal year to implement this act.25
380+SECTION 7. Capital construction appropriation. For the26
381+2022-23 state fiscal year, $6,991,567 is appropriated to the department of27

383+-11- human services. This appropriation is from the behavioral and mental1
384+health cash fund created in section 24-75-230 (2)(a), C.R.S. To2
385+implement this act, the department may use this appropriation for capital3
386+construction related to the renovation for additional inpatient beds at the4
387+Colorado mental health institute at Fort Logan. Any money appropriated5
388+in this section not expended prior to July 1, 2023, is further appropriated6
389+to the department from July 1, 2023, through December 30, 2024, for the7
390+same purpose.8
391+SECTION 8. Capital construction appropriation. For the9
392+2022-23 state fiscal year, $3,692,111 is appropriated to the department of10
393+human services. This appropriation is from the behavioral and mental11
394+health cash fund created in section 24-75-230 (2)(a), C.R.S. To12
395+implement this act, the department may use this appropriation for capital13
396+construction related to the renovation of three existing department14
397+properties to create mental health residential facilities pursuant to section15
398+27-71-103 (1)(a), C.R.S. Any money appropriated in this section not16
399+expended prior to July 1, 2023, is further appropriated to the department17
400+from July 1, 2023, through December 30, 2024, for the same purpose.18
401+SECTION 9. Appropriation. (1) For the 2022-23 state fiscal19
402+year, $91,938 is appropriated to the department of health care policy and20
403+financing for use by the executive director's office. This appropriation is21
404+from the general fund. To implement this act, the office may use this22
405+appropriation as follows:23
406+(a) $84,388 for personal services, which amount is based on an24
407+assumption that the office will require an additional 1.8 FTE; and25
408+(b) $7,550 for operating expenses.26
409+(2) For the 2022-23 state fiscal year, the general assembly27

411+-12- anticipates that the department of health care policy and financing will1
412+receive $91,937 in federal funds to implement this act, which amount is2
413+subject to the "(I)" notation as defined in the annual general appropriation3
414+act for the same fiscal year. The appropriation in subsection (1) of this4
415+section is based on the assumption that the department will receive this5
416+amount of federal funds to be used as follows:6
417+(a) $84,387 for personal services; and7
418+(b) $7,550 for operating expenses.8
419+SECTION 10. Safety clause. The general assembly hereby finds,9
420+determines, and declares that this act is necessary for the immediate10
421+preservation of the public peace, health, or safety.11
