18-Be it enacted by the General Assembly of the State of Colorado:
19-SECTION 1. Continuation of the satellite monitoring system -
20-operation and maintenance - appropriation. (1) For the 2022-23 state
21-fiscal year, $380,000 is appropriated to the department of natural resources
22-for use by the division of water resources. This appropriation is from the
23-Colorado water conservation board construction fund created in section
24-37-60-121, C.R.S. To implement this section, the division of water

33-stations; replacement of outdated collection platforms; lysimeter support,
34-data collection, and maintenance; upgrading of transmission components of
35-the satellite monitoring system established and operated pursuant to section
36-37-80-102 (10), C.R.S.; stream gauge flood hardening projects; and data
37-collection efforts related to flood forecasting and warning.
38-(2) The money appropriated in subsection (1) of this section remains
39-available for the designated purposes until it is fully expended.
40-SECTION 2. Continuation of the Colorado floodplain map
41-modernization program - appropriation. (1) For the 2022-23 state fiscal
42-year, $500,000 is appropriated to the department of natural resources for use
43-by the Colorado water conservation board. This appropriation is from the
44-Colorado water conservation board construction fund created in section
45-37-60-121, C.R.S. To implement this section, the Colorado water
46-conservation board may use this appropriation to continue to assist with the
47-preparation of revised and improved floodplain studies and maps for
48-communities throughout Colorado and participate in federally sponsored
49-floodplain map modernization activities.
50-(2) The money appropriated in subsection (1) of this section remains
51-available for the designated purposes until it is fully expended.
52-SECTION 3. Continuation of the weather modification
53-permitting program - appropriation. (1) For the 2022-23 state fiscal
54-year, $350,000 is appropriated to the department of natural resources for use
55-by the Colorado water conservation board. This appropriation is from the
56-Colorado water conservation board construction fund created in section
57-37-60-121, C.R.S. To implement this section, the Colorado water
58-conservation board may use this appropriation to continue to assist water
59-conservation districts, water conservancy districts, and other water
60-providers and their fiscal agents with the development of cloud seeding
61-programs that provide benefits to recreation, streams, and reservoirs through
62-snowpack enhancement.
63-(2) The money appropriated in subsection (1) of this section remains
64-available for the designated purposes until it is fully expended.
65-SECTION 4. Continuation of technical assistance for federal
66-PAGE 2-HOUSE BILL 22-1316 cost-share programs - appropriation. (1) For the 2022-23 state fiscal
67-year, $300,000 is appropriated to the department of natural resources for use
68-by the Colorado water conservation board. This appropriation is from the
69-Colorado water conservation board construction fund created in section
70-37-60-121, C.R.S. To implement this section, the Colorado water
71-conservation board may use this appropriation to continue to provide
72-technical assistance for applicants seeking competitive grants from federal
73-water infrastructure, quality, and delivery programs, such as the United
74-States department of agriculture's regional conservation partnership
75-program, the Colorado river basin salinity control program, and the
76-Gunnison selenium management program.
77-(2) The money appropriated in subsection (1) of this section remains
78-available for the designated purposes until it is fully expended.
79-SECTION 5. Restoration of litigation fund cash balance -
80-transfer. On July 1, 2022, the state treasurer shall transfer the sum of
81-$2,000,000, or so much thereof as may be necessary to restore the balance
82-of the litigation fund to $2,000,000, from the unreserved cash in the
83-Colorado water conservation board construction fund created in section
84-37-60-121, C.R.S., to the litigation fund created in section 37-60-121 (2.5),
85-C.R.S., to assist in addressing legal issues associated with compact
86-compliance or any other litigation activities as specified under section
87-37-60-121, C.R.S.
88-SECTION 6. Continuation of the Arkansas river decision
89-support system - appropriation. (1) For the 2022-23 state fiscal year,
90-$500,000 is appropriated to the department of natural resources for use by
91-the Colorado water conservation board. This appropriation is from the
92-Colorado water conservation board construction fund created in section
93-37-60-121, C.R.S. To implement this section, the Colorado water
94-conservation board may use this appropriation to continue implementation
95-of the Arkansas river decision support system (ArkDSS), as identified in the
96-ArkDSS feasibility study completed in December 2011.
97-(2) The money appropriated in subsection (1) of this section remains
98-available for the designated purposes until the ArkDSS is completed.
99-SECTION 7. Continuation of the Colorado Mesonet project -
100-appropriation. (1) For the 2022-23 state fiscal year, $150,000 is
101-PAGE 3-HOUSE BILL 22-1316 appropriated to the department of natural resources for use by the Colorado
102-water conservation board. This appropriation is from the Colorado water
103-conservation board construction fund created in section 37-60-121, C.R.S.
104-To implement this section, the Colorado water conservation board may use
105-this appropriation to support the Colorado Mesonet, including for the
106-following activities: Operation, maintenance, travel, communications, and
107-database and website management for temperature and precipitation
108-stations.
109-(2) The money appropriated in subsection (1) of this section remains
110-available for the designated purposes until it is fully expended.
111-SECTION 8. Continuation of the water forecasting partnership
112-project - appropriation. (1) For the 2022-23 state fiscal year, $450,000
113-is appropriated to the department of natural resources for use by the
114-Colorado water conservation board. This appropriation is from the Colorado
115-water conservation board construction fund created in section 37-60-121,
116-C.R.S. To implement this section, the Colorado water conservation board
117-may use this appropriation to support the development of new ground and
118-aerial remote sensing data and equipment and hydrologic modeling, to
119-provide reliable volumetric water supply forecasting, and to provide better
120-characterization of snowpack.
121-(2) The money appropriated in subsection (1) of this section remains
122-available for the designated purposes until it is fully expended.
123-SECTION 9. Modeling and data analyses for the upper
124-Colorado river commission - appropriation. (1) For the 2022-23 state
125-fiscal year, $200,000 is appropriated to the department of natural resources
126-for use by the Colorado water conservation board. This appropriation is
127-from the Colorado water conservation board construction fund created in
128-section 37-60-121, C.R.S. To implement this section, the Colorado water
129-conservation board may use this appropriation to provide support to the
130-upper Colorado river commission's interstate planning and negotiation
131-efforts, including the following modeling and data analyses: Streamgaging
132-and streamflow, runoff forecasting, consumptive use, reservoir operations
133-and evaporation, and drought contingency planning.
134-(2) The money appropriated in subsection (1) of this section remains
135-available for the designated purposes until it is fully expended.
136-PAGE 4-HOUSE BILL 22-1316 SECTION 10. Grant-making for projects that assist in
137-implementing the state water plan - transfer. On July 1, 2022, the state
138-treasurer shall transfer the sum of $1,000,000 from the unreserved cash in
139-the Colorado water conservation board construction fund created in section
140-37-60-121, C.R.S., to the water plan implementation cash fund created in
141-section 37-60-123.3 (1)(a), C.R.S.
142-SECTION 11. Reservoir enlargement assessment project -
143-appropriation. (1) For the 2022-23 state fiscal year, $250,000 is
144-appropriated to the department of natural resources for use by the division
145-of water resources. This appropriation is from the Colorado water
146-conservation board construction fund created in section 37-60-121, C.R.S.
147-To implement this section, the division of water resources may use this
148-appropriation to conduct comprehensive dam safety evaluations on existing
149-dams that have a potential consideration for enlargement.
150-(2) The money appropriated in subsection (1) of this section remains
151-available for the designated purposes until it is fully expended.
152-SECTION 12. Platte river recovery implementation program -
153-appropriation. (1) For the 2022-23 state fiscal year, $3,800,000 is
154-appropriated to the department of natural resources for use by the Colorado
155-water conservation board. This appropriation is from the Colorado water
156-conservation board construction fund created in section 37-60-121, C.R.S.
157-To implement this section, the Colorado water conservation board may use
158-this appropriation to support the Platte river recovery implementation
159-program, which implements certain aspects of the United States fish and
160-wildlife service's recovery plans for the whooping crane, pallid sturgeon,
161-and piping plover and provides compliance with the "Endangered Species
162-Act of 1973", 16 U.S.C. sec. 1531, et seq., as amended, for Colorado water
163-projects.
164-(2) The money appropriated in subsection (1) of this section remains
165-available for the designated purposes until it is fully expended.
166-SECTION 13. Republican river matters - appropriation. (1) For
167-the 2022-23 state fiscal year, $2,000,000 is appropriated to the department
168-of natural resources for use by the Colorado water conservation board. This
169-appropriation is from the Colorado water conservation board construction
170-fund created in section 37-60-121, C.R.S. To implement this section, the
171-PAGE 5-HOUSE BILL 22-1316 Colorado water conservation board may use this appropriation for
172-Republican river matters, including providing matching cash incentives to
173-producers to reduce irrigation and facilitate land retirement within the south
174-fork of the Republican river and assist the Republican river water
175-conservation district in meeting compact compliance obligations pursuant
176-to the Republican river compact.
177-(2) The money appropriated in subsection (1) of this section remains
178-available for the designated purposes until it is fully expended.
179-SECTION 14. Goose Pasture Tarn Dam project loan
180-authorization. (1) The Colorado water conservation board is authorized
181-to loan up to $13,130,000 from the Colorado water conservation board
182-construction fund created in section 37-60-121, C.R.S., to the town of
183-Breckenridge to rehabilitate the Goose Pasture Tarn dam, which is located
184-on the Blue river and supplies water to the town of Breckenridge.
185-(2) The money authorized in subsection (1) of this section remains
186-available for the designated purposes until it is fully expended.
187-(3) The Colorado water conservation board may make a loan for the
188-construction of the project specified in subsection (1) of this section from
189-such money as is or may become available to the Colorado water
190-conservation board construction fund. The loan must be in the amount listed
191-in subsection (1) of this section plus or minus such amounts, if any, as may
192-be justified by reason of ordinary fluctuations in construction costs or as
193-may be justified by reason of change in the plans for the project due to
194-differing or unforeseen site conditions, errors or omissions in the plans and
195-specifications, changes instituted by regulatory agencies, or changes in
196-material quantities beyond contract limits.
197-(4) Pursuant to section 37-60-120 (1), C.R.S., the Colorado water
198-conservation board shall require such terms and conditions in the loan
199-contract as will ensure repayment of money made available by it. The board
200-shall not disburse any money for a loan authorized by subsection (1) of this
201-section unless and until it is satisfied, in its sole discretion, that the recipient
202-of the loan will be able to make repayment pursuant to the terms and
203-conditions established by the board.
204-SECTION 15. Grant-making for projects that assist in
205-PAGE 6-HOUSE BILL 22-1316 implementing the state water plan - appropriation. (1) For the 2022-23
206-state fiscal year, $8,200,000 is appropriated to the department of natural
207-resources for use by the Colorado water conservation board. This
208-appropriation is from the water plan implementation cash fund created in
209-section 37-60-123.3 (1)(a), C.R.S. To implement this section, the Colorado
210-water conservation board may use this appropriation for grant-making for
211-projects that assist in the implementation of the state water plan pursuant to
212-section 37-60-106.3 (6), C.R.S., through the Colorado water conservation
213-board's application and guidelines process.
214-(2) The money appropriated in subsection (1) of this section remains
215-available for the designated purposes until it is fully expended.

217-determines, and declares that this act is necessary for the immediate
218-preservation of the public peace, health, or safety.

77+The bill directs the state treasurer to transfer the following
78+amounts on July 1, 2022:
79+! Up to $2,000,000 from the CWCB construction fund to the
80+litigation fund (section 5); and
81+! $1,000,000 from the CWCB construction fund to the water
82+plan implementation cash fund (section 10).
83+Section 14 authorizes the CWCB to make loans of up to
84+$13,130,000 from the CWCB construction fund to the town of
85+Breckenridge to rehabilitate the Goose Pasture Tarn dam.
86+Be it enacted by the General Assembly of the State of Colorado:1

216+existing dams that have a potential consideration for enlargement.14
217+(2) The money appropriated in subsection (1) of this section15
218+remains available for the designated purposes until it is fully expended.16
219+SECTION 12. Platte river recovery implementation program17
220+- appropriation. (1) For the 2022-23 state fiscal year, $3,800,000 is18
221+appropriated to the department of natural resources for use by the19
222+Colorado water conservation board. This appropriation is from the20
223+Colorado water conservation board construction fund created in section21
224+37-60-121, C.R.S. To implement this section, the Colorado water22
225+conservation board may use this appropriation to support the Platte river23
226+recovery implementation program, which implements certain aspects of24
227+the United States fish and wildlife service's recovery plans for the25
228+whooping crane, pallid sturgeon, and piping plover and provides26
229+compliance with the "Endangered Species Act of 1973", 16 U.S.C. sec.27

231+-7- 1531, et seq., as amended, for Colorado water projects.1
232+(2) The money appropriated in subsection (1) of this section2
233+remains available for the designated purposes until it is fully expended.3
234+SECTION 13. Republican river matters - appropriation.4
235+(1) For the 2022-23 state fiscal year, $2,000,000 is appropriated to the5
236+department of natural resources for use by the Colorado water6
237+conservation board. This appropriation is from the Colorado water7
238+conservation board construction fund created in section 37-60-121,8
239+C.R.S. To implement this section, the Colorado water conservation board9
240+may use this appropriation for Republican river matters, including10
241+providing matching cash incentives to producers to reduce irrigation and11
242+facilitate land retirement within the south fork of the Republican river and12
243+assist the Republican river water conservation district in meeting compact13
244+compliance obligations pursuant to the Republican river compact.14
245+(2) The money appropriated in subsection (1) of this section15
246+remains available for the designated purposes until it is fully expended.16
247+SECTION 14. Goose Pasture Tarn Dam project loan17
248+authorization. (1) The Colorado water conservation board is authorized18
249+to loan up to $13,130,000 from the Colorado water conservation board19
250+construction fund created in section 37-60-121, C.R.S., to the town of20
251+Breckenridge to rehabilitate the Goose Pasture Tarn dam, which is21
252+located on the Blue river and supplies water to the town of Breckenridge.22
253+(2) The money authorized in subsection (1) of this section remains23
254+available for the designated purposes until it is fully expended.24
255+(3) The Colorado water conservation board may make a loan for25
256+the construction of the project specified in subsection (1) of this section26
257+from such money as is or may become available to the Colorado water27

259+-8- conservation board construction fund. The loan must be in the amount1
260+listed in subsection (1) of this section plus or minus such amounts, if any,2
261+as may be justified by reason of ordinary fluctuations in construction3
262+costs or as may be justified by reason of change in the plans for the4
263+project due to differing or unforeseen site conditions, errors or omissions5
264+in the plans and specifications, changes instituted by regulatory agencies,6
265+or changes in material quantities beyond contract limits.7
266+(4) Pursuant to section 37-60-120 (1), C.R.S., the Colorado water8
267+conservation board shall require such terms and conditions in the loan9
268+contract as will ensure repayment of money made available by it. The10
269+board shall not disburse any money for a loan authorized by subsection11
270+(1) of this section unless and until it is satisfied, in its sole discretion, that12
271+the recipient of the loan will be able to make repayment pursuant to the13
272+terms and conditions established by the board.14
273+SECTION 15. Grant-making for projects that assist in15
274+implementing the state water plan - appropriation. (1) For the16
275+2022-23 state fiscal year, $8,200,000 is appropriated to the department of17
276+natural resources for use by the Colorado water conservation board. This18
277+appropriation is from the water plan implementation cash fund created in19
278+section 37-60-123.3 (1)(a), C.R.S. To implement this section, the20
279+Colorado water conservation board may use this appropriation for21
280+grant-making for projects that assist in the implementation of the state22
281+water plan pursuant to section 37-60-106.3 (6), C.R.S., through the23
282+Colorado water conservation board's application and guidelines process.24
283+(2) The money appropriated in subsections (1) and (2) of this25
284+section remains available for the designated purposes until it is fully26
285+expended.27
