14-Be it enacted by the General Assembly of the State of Colorado:
15-SECTION 1. In Colorado Revised Statutes, 24-75-226, amend
16-(4)(a), (4)(d), (5)(a), (5)(f), and (6); and add (1)(a.5), (1)(f), (3)(d), and
17-(5)(g) as follows:
18-24-75-226. "American Rescue Plan Act of 2021" cash fund -
19-creation - recipient funds - limitations - reporting - legislative
20-declaration - definitions - repeal. (1) As used in this section, unless the
21-context otherwise requires:

48+requirements established by the United States department of the treasury
49+(treasury), the general assembly established administrative requirements
50+related to the expenditure of this federal money. Section 1 of the bill
51+modifies these requirements by:
52+! Establishing deadlines for a subrecipient, which is a person
53+that carries out a program or project on behalf of the state,
54+to expend or obligate this money, and if not, to return this
55+money to the state for the state to either expend or return to
56+treasury, depending on the timing;
57+! Requiring the state controller to transmit to treasury any
58+money that was obligated by December 31, 2024, but not
59+expended by December 31, 2026;
60+! Requiring the department of revenue to provide the state
61+controller with any information about any increases in the
62+state's net tax revenue, which is necessary for calculating
63+the state's revenue reductions for 2022 and 2023;
64+! Clarifying that the compliance, reporting, record-keeping,
65+and program evaluation requirements established by the
66+office of state planning and budgeting and the state
67+controller apply to a person regardless of whether the
68+person is a beneficiary or a subrecipient and regardless of
69+whether the person receives the money directly from a
70+department or from a subrecipient; and
71+! Permitting the state controller to report any expenditures to
72+treasury as a government service to the extent of the
73+reduction in the state's revenue due to the COVID-19
74+public health emergency relative to the revenues the state
75+collected for the state fiscal year 2018-19. Sections 3
76+through 6 make conforming amendments related to this
77+change.
78+The bill also substitutes money from the general fund or from a
79+cash fund that included money that originated from the general fund for
80+money that was allocated in 2021 legislation from the federal coronavirus
81+state fiscal recovery fund, as follows:
82+! $29.5 million from the housing development grant fund
83+(section 7);
84+! $36.5 million from the highway users tax fund that was
85+distributed to counties, cities, and incorporated towns,
86+which is accomplished by replenishing and reclassifying
87+the federal funds that were initially used (section 8);
88+! $10 million from the Colorado startup loan program fund
89+(section 9), with the freed up federal funds being
90+transferred to the revenue loss restoration cash fund
91+(section 6); and

94+ownership cash fund (section 10).
95+Sections 2 and 6 include conforming amendments related to the
96+reclassification of the money paid to the counties, cities, and incorporated
97+towns.

42-(4) (a) The general assembly shall not appropriate money from the
43-fund. The general assembly may transfer money in the fund to another cash
44-fund that is established for the purpose of using the money from the federal
45-coronavirus state fiscal recovery fund. Transfers from the fund to the
46-general fund are prohibited. If there is any of the money transferred to the
47-fund under subsection (3)(a) of this section remaining in the fund after any
48-transfers from the fund required by bills enacted during the 2021 regular
49-legislative session, then, of the remainder in the fund, the lesser of three
50-hundred million dollars or the remainder is continuously appropriated to any
51-department designated by the governor for any allowable purpose under the
52-"American Rescue Plan Act of 2021". T

625+authorized in section 24-75-229 (3), C.R.S. Any money appropriated in2
626+this subsection that is not expended or encumbered at the end of the3
627+2021-22 state fiscal year remains available for expenditure in subsequent4
628+fiscal years without further appropriation. subject to the requirements for5
629+obligating and expending money received under the federal "American6
630+Rescue Plan Act of 2021", Pub. L. 117-2, as the act may be subsequently7
631+amended as specified in section 24-75-226 (4)(d), C.R.S.8
632+SECTION 23. Amend section 3 of House Bill 22-1379 as9
633+follows:10
634+SECTION 3. Appropriation. For the 2022-23 state fiscal year,11
635+$15,000,000 is appropriated to the department of natural resources for use12
636+by the Colorado water conservation board. This appropriation is from the13
637+Colorado water conservation board construction fund created in section14
638+37-60-121 (1)(a), C.R.S. To implement this act, the board may use this15
639+appropriation for watershed restoration and flood mitigation project16
640+grants FOR THE PURPOSES SET FORTH IN SECTION 37-60-121 (12), (13), AND17
641+(14),
642+ C.R.S. Any money appropriated in this section not expended prior

644+to July 1, 2023, is further appropriated to the board from July 1, 2023,19
645+through December 30, 2024, for the same purpose.20
646+SECTION 24. Effective date. (1) This act takes effect upon21
647+passage; except that:22

649+law, in which case section 11 takes effect upon the effective date of this24
