49+! Reimburse school food authorities that choose to
50+participate in the program (participating school food
51+authorities) for free meals provided to students who are not
52+eligible for free or reduced-price meals under the federal
53+school meals programs;
54+! Provide local food purchasing grants to eligible
55+participating school food authorities;
56+! Provide funding to participating school food authorities to
57+increase the wages or provide stipends for individuals
58+employed to prepare and serve food; and
59+! Provide assistance to participating school food authorities
60+through the local school food purchasing technical
61+assistance and education grant program.
62+The portion of the program that provides reimbursement for school
63+meals begins operating in the 2023-24 budget year. The remaining
64+portions of the program begin operating in the first full budget year after
65+the state of Colorado begins participating in the federal demonstration
66+project to use medicaid eligibility to identify students who are eligible for
67+the federal school meals programs (demonstration project).
68+A participating school food authority must:
69+! Provide free meals to all students enrolled in the public
70+schools that the participating school food authority serves
71+and that participate in the national school lunch program or
72+national school breakfast program;
73+! Provide to the department annual notice of participation;
74+and
75+! Maximize the amount of federal reimbursement by
76+participating in the federal community eligibility provision
77+to identify students who are eligible for the federal school
78+meals programs.
79+The amount of reimbursement distributed pursuant to the program
80+is equal to the federal free reimbursement rate multiplied by the total
81+number of meals served minus any other federal or state reimbursement
82+the school food authority receives for providing meals.
83+The bill requires the department to:
84+! Participate in the federal community eligibility provision
85+for the state as a whole, if that option is available; and
86+! Apply to participate in the demonstration project.
87+Under the bill, a participating school food authority that creates a
88+parent and student committee to advise on food purchasing (advisory
89+committee) is eligible to receive a local food purchasing grant (grant) to
90+purchase Colorado grown, raised, or processed products for school meals.

92+-2- Each eligible participating school food authority must comply with
93+reporting requirements. The bill establishes the amount of the grants,
94+limits on how the grant money may be spent, and the required
95+membership of the advisory committee. The department must annually
96+review a sample of the invoices for purchases made using grant money to
97+ensure compliance with purchasing requirements.
98+The bill creates the local school food purchasing technical
99+assistance and education grant program (grant program) under which a
100+statewide nonprofit organization distributes grants to promote the
101+purchase of Colorado grown, raised, or processed products by
102+participating school food authorities and to assist participating school
103+food authorities in preparing meals using basic ingredients rather than
104+processed products. The nonprofit organization must report annually to
105+the department concerning implementation of the grant program.
106+The department must submit to committees of the general
107+assembly a biennial report concerning implementation of the program.
108+The department must contract with an independent auditor to conduct a
109+biennial financial and performance audit of the program. The report and
110+the audit must include implementation of the program, implementation of
111+the local food purchasing grants, use of the additional amount for
112+increasing wages or providing stipends, and implementation of the grant
113+program.
114+The bill directs the general assembly to appropriate annually, by
115+line item in the annual appropriation bill, the amount necessary to
116+implement the program, including a specified amount for the grant
117+program.
118+Current law caps state income tax itemized deductions for
119+taxpayers who have federal adjusted gross income of $400,000 or more
120+at $30,000 for single filers and $60,000 for joint filers. The bill applies
121+the cap to both itemized and standard income tax deductions for taxpayers
122+who have federal adjusted gross income of $300,000 or more and lowers
123+the cap to $12,000 for single filers and $16,000 for joint filers. The
124+amount of revenue generated by the changes to the cap must be
125+appropriated to fund the program. If the program is repealed, the changes
126+to the cap no longer apply.
127+The bill takes effect only if it is approved by the voters at the
128+November 2022 general election. This approval is a voter-approved
129+revenue change that allows the state to retain and spend all revenue
130+generated by the changes to the cap on state income tax deductions.
