The bill requires the installation of aircraft detection lighting systems on wind-powered 
generation facilities. It may increase local government revenue and expenditures 
beginning in FY 2022-23.

Summary of Legislation 
The bill requires the owner or operator of any wind-powered energy generation facility subject to 
land-use permitting requirements to install an aircraft detection lighting system at their own cost by 
September 1, 2024.  Local governments that issue land-use permits for such facilities may revoke or 
refuse to renew a permit for an applicant who is out of compliance.  The bill authorizes a board of 
county commissioners to impose by ordinance a civil penalty for violations.  Any contiguous counties 
and any municipalities in those counties may enter into an intergovernmental agreement for a shared 
ordinance. 
Local Government  
Beginning in FY 2022-23, expenditures may increase in local governments that elect to adopt 
ordinances, enter into intergovernmental agreements, or to inspect wind-powered generation 
facilities, as allowed by the bill.  To the extent that violations occur, revenue will increase to local 
governments from civil penalties.

Effective Date 
The bill takes effect 90 days following adjournment of the General Assembly sine die, assuming no 
referendum petition is filed.
