63 | 63 | | the department of human services in implementing the |
---|
64 | 64 | | grant. |
---|

66 | 66 | | homelessness prevention grant program. Grant money can |
---|
67 | 67 | | be used to cover the costs of providing supportive housing |
---|
68 | 68 | | services that are currently not eligible for reimbursement |

69 | 69 | | through the state's medical assistance program. It can also |

70 | 70 | | be used to fund homelessness prevention projects for |
---|
71 | 71 | | individuals who have behavioral, mental health, or |
---|
72 | 72 | | substance use disorders who are homeless or at risk of |
---|
73 | 73 | | becoming homeless and who have contact with the criminal |
---|
74 | 74 | | or juvenile justice system. The division is required to |
---|
75 | 75 | | prioritize applicants that will serve rural or frontier |

76 | 76 | | communities and provide hands-on technical assistance to |

81 | 81 | | homeless data systems, support accurate data reporting, and |
---|
82 | 82 | | assess housing-related needs. The division must work with |
---|
83 | 83 | | regional continuums of care to evaluate how to increase |
---|
84 | 84 | | participation in data systems in communities across the |
---|
85 | 85 | | state, identify technical needs and associated costs for |
---|
86 | 86 | | doing so, and work with the office of behavioral health and |
---|
87 | 87 | | other stakeholders to integrate or develop an integrated user |
---|
88 | 88 | | interface for various data systems related to housing and |
---|
89 | 89 | | supportive services. It must also enhance information about |
---|
90 | 90 | | best practices and training materials available to |
---|
91 | 91 | | communities across the state. |
---|
92 | 92 | | Be it enacted by the General Assembly of the State of Colorado:1 |
---|
93 | 93 | | SECTION 1. Legislative declaration. (1) The general assembly2 |
---|
94 | 94 | | hereby finds and declares that:3 |
---|
95 | 95 | | (a) Colorado is experiencing a homelessness crisis. The 20204 |
---|
96 | 96 | | point-in-time estimate of homelessness by the United States department5 |
---|
97 | 97 | | of housing and urban development reported nearly ten thousand people6 |
---|
98 | 98 | | experiencing homelessness in Colorado. According to the Colorado7 |
---|
99 | 99 | | department of education, over twenty-one thousand students in Colorado8 |
---|
100 | 100 | | schools experienced homelessness at some point during the 2019-209 |
---|
101 | 101 | | school year. Even more Colorado residents lack stable housing and are on10 |
---|
102 | 102 | | the verge of homelessness.11 |
---|
103 | 103 | | (b) The experience of homelessness can be both a cause and a12 |
---|
104 | 104 | | consequence of mental illness, including substance use disorders, and13 |
---|
105 | 105 | | incarceration and is intricately related to both issues. The intersection of14 |
---|
106 | 106 | | homelessness, mental illness, and contact with the criminal justice system15 |
---|
107 | 107 | | is extremely costly to communities both in terms of the financial burdens16 |
---|
108 | 108 | | and the humanitarian toll it imposes on individuals and their communities.17 |
---|
109 | 109 | | SB22-231-3- These impacts are particularly acute in communities that have a shortage1 |
---|
110 | 110 | | of behavioral and mental health care providers and services.2 |
---|
111 | 111 | | (c) According to a 2018 study of homelessness in Colorado jails3 |
---|
112 | 112 | | by the Colorado department of public safety, eighty percent of4 |
---|
113 | 113 | | respondents across facilities reported experiencing homelessness in the5 |
---|
114 | 114 | | year prior, and nearly forty percent reported that they will be homeless6 |
---|
115 | 115 | | after their release from jail;7 |
---|
116 | 116 | | (d) Of the respondents experiencing homelessness, over sixty8 |
---|
117 | 117 | | percent reported needing mental health treatment, compared with9 |
---|
118 | 118 | | forty-five percent of nonhomeless respondents;10 |
---|
119 | 119 | | (e) Similarly, the Colorado department of corrections reported in11 |
---|
120 | 120 | | 2017 that over seventy-eight percent of the female inmate population and12 |
---|
121 | 121 | | over forty-three percent of the male inmate population had moderate to13 |
---|
122 | 122 | | severe mental health needs, and the Colorado department of adult parole14 |
---|
123 | 123 | | reported in 2019 that over one thousand individuals were paroling to15 |
---|
124 | 124 | | "unsheltered homelessness" or to "short term, temporary housing";16 |
---|
125 | 125 | | (f) Studies also show that being homeless is linked to sustained17 |
---|
126 | 126 | | deterioration of mental and physical health and that homelessness can be18 |
---|
127 | 127 | | both a cause and a consequence of having a criminal record;19 |
---|
128 | 128 | | (g) Safe and stable housing is a foundation for individuals to20 |
---|
129 | 129 | | engage in the process of reentry from the criminal justice system, and21 |
---|
130 | 130 | | provides a base from which individuals can seek employment, focus on22 |
---|
131 | 131 | | treatment, establish a social network, and comply with community23 |
---|
132 | 132 | | supervision;24 |
---|
133 | 133 | | (h) Supportive housing programs combine affordable housing25 |
---|
134 | 134 | | with access to supportive services tailored to an individual's needs,26 |
---|
135 | 135 | | including, for example, in-reach and outreach, housing search and27 |
---|

---|
137 | 137 | | -4- counseling support, engagement, vocational or occupational training,1 |
---|
138 | 138 | | clinical services, support with daily living activities, and other ongoing2 |
---|
139 | 139 | | supports. Supportive housing can reduce the cycling of individuals with3 |
---|
140 | 140 | | behavioral or mental health disorders, including substance use disorders,4 |
---|
141 | 141 | | between prison, jail, homelessness, and other public services.5 |
---|
142 | 142 | | (i) Colorado has made significant investments in nationally6 |
---|
143 | 143 | | recognized housing best practices, including supportive housing;7 |
---|
144 | 144 | | (j) Unfortunately, not all communities across the state are able to8 |
---|
145 | 145 | | take advantage of the available state and federal funding for supportive9 |
---|
146 | 146 | | housing services due to various barriers;10 |
---|
147 | 147 | | (k) While the department of health care policy and financing has11 |
---|
148 | 148 | | limited funds for supportive services, current restrictions do not allow the12 |
---|
149 | 149 | | department to cover all the services needed to secure and maintain13 |
---|
150 | 150 | | housing, and it is unable to reimburse nonclinical providers for providing14 |
---|
151 | 151 | | those services;15 |
---|
152 | 152 | | (l) As a result, communities are not able to provide sustainable,16 |
---|
153 | 153 | | long-term services to the most vulnerable individuals to keep them safely17 |
---|
154 | 154 | | housed; and18 |
---|
155 | 155 | | (m) Many communities, particularly in rural and frontier areas, do19 |
---|
156 | 156 | | not have nonprofit organizations experienced in applying for grants and20 |
---|
157 | 157 | | implementing supportive housing programs, do not have the21 |
---|
158 | 158 | | programmatic or staff capacity to do so, and need technical assistance to22 |
---|
159 | 159 | | develop evidence-based, innovative solutions that are scaled and tailored23 |
---|
160 | 160 | | to their specific community needs.24 |
---|
161 | 161 | | (2) The general assembly further finds and declares that it is25 |
---|
162 | 162 | | therefore in Colorado's best interest to provide assistance and create26 |
---|
163 | 163 | | opportunities for communities across the state that are currently unable27 |
