4848 be targeted to communities that currently face barriers to
4949 accessing existing state and federal funding for supportive
5050 housing programs.
5151 ! Establishing a predevelopment grant program that provides
5252 funding to entities working to develop supportive housing
5353 interventions for individuals who have behavioral, mental
5454 health, or substance use disorders who are homeless or at
5555 risk of becoming homeless and who have contact with the
5656 criminal or juvenile justice system. The grant money can be
5757 used to add new or additional staff capacity to allow the
5858 development and implementation of such programs. The
5959 division is required to prioritize applicants that will serve
6060 rural or frontier communities and to provide hands-on
6161 technical assistance to grant recipients. The division is
6262 required to consult with the office of behavioral health in
6363 the department of human services in implementing the
6464 grant.
6565 ! Establishing a supportive housing services and
6666 homelessness prevention grant program. Grant money can
6767 be used to cover the costs of providing supportive housing
6868 services that are currently not eligible for reimbursement
6969 through the state's medical assistance program. It can also
7070 be used to fund homelessness prevention projects for
7171 individuals who have behavioral, mental health, or
7272 substance use disorders who are homeless or at risk of
7373 becoming homeless and who have contact with the criminal
7474 or juvenile justice system. The division is required to
7575 prioritize applicants that will serve rural or frontier
7676 communities and provide hands-on technical assistance to

7878 -2- grant recipients. The division is required to consult with the
7979 office of behavioral health in implementing the grant.
8080 ! Developing a plan to increase participation in regional
8181 homeless data systems, support accurate data reporting, and
8282 assess housing-related needs. The division must work with
8383 regional continuums of care to evaluate how to increase
8484 participation in data systems in communities across the
8585 state, identify technical needs and associated costs for
8686 doing so, and work with the office of behavioral health and
8787 other stakeholders to integrate or develop an integrated user
8888 interface for various data systems related to housing and
8989 supportive services. It must also enhance information about
9090 best practices and training materials available to
9191 communities across the state.
9292 Be it enacted by the General Assembly of the State of Colorado:1
9393 SECTION 1. Legislative declaration. (1) The general assembly2
9494 hereby finds and declares that:3
9595 (a) Colorado is experiencing a homelessness crisis. The 20204
9696 point-in-time estimate of homelessness by the United States department5
9797 of housing and urban development reported nearly ten thousand people6
9898 experiencing homelessness in Colorado. According to the Colorado7
9999 department of education, over twenty-one thousand students in Colorado8
100100 schools experienced homelessness at some point during the 2019-209
101101 school year. Even more Colorado residents lack stable housing and are on10
102102 the verge of homelessness.11
103103 (b) The experience of homelessness can be both a cause and a12
104104 consequence of mental illness, including substance use disorders, and13
105105 incarceration and is intricately related to both issues. The intersection of14
106106 homelessness, mental illness, and contact with the criminal justice system15
107107 is extremely costly to communities both in terms of the financial burdens16
108108 and the humanitarian toll it imposes on individuals and their communities.17
109109 SB22-231-3- These impacts are particularly acute in communities that have a shortage1
110110 of behavioral and mental health care providers and services.2
111111 (c) According to a 2018 study of homelessness in Colorado jails3
112112 by the Colorado department of public safety, eighty percent of4
113113 respondents across facilities reported experiencing homelessness in the5
114114 year prior, and nearly forty percent reported that they will be homeless6
115115 after their release from jail;7
116116 (d) Of the respondents experiencing homelessness, over sixty8
117117 percent reported needing mental health treatment, compared with9
118118 forty-five percent of nonhomeless respondents;10
119119 (e) Similarly, the Colorado department of corrections reported in11
120120 2017 that over seventy-eight percent of the female inmate population and12
121121 over forty-three percent of the male inmate population had moderate to13
122122 severe mental health needs, and the Colorado department of adult parole14
123123 reported in 2019 that over one thousand individuals were paroling to15
124124 "unsheltered homelessness" or to "short term, temporary housing";16
125125 (f) Studies also show that being homeless is linked to sustained17
126126 deterioration of mental and physical health and that homelessness can be18
127127 both a cause and a consequence of having a criminal record;19
128128 (g) Safe and stable housing is a foundation for individuals to20
129129 engage in the process of reentry from the criminal justice system, and21
130130 provides a base from which individuals can seek employment, focus on22
131131 treatment, establish a social network, and comply with community23
132132 supervision;24
133133 (h) Supportive housing programs combine affordable housing25
134134 with access to supportive services tailored to an individual's needs,26
135135 including, for example, in-reach and outreach, housing search and27

137137 -4- counseling support, engagement, vocational or occupational training,1
138138 clinical services, support with daily living activities, and other ongoing2
139139 supports. Supportive housing can reduce the cycling of individuals with3
140140 behavioral or mental health disorders, including substance use disorders,4
141141 between prison, jail, homelessness, and other public services.5
142142 (i) Colorado has made significant investments in nationally6
143143 recognized housing best practices, including supportive housing;7
144144 (j) Unfortunately, not all communities across the state are able to8
145145 take advantage of the available state and federal funding for supportive9
146146 housing services due to various barriers;10
147147 (k) While the department of health care policy and financing has11
148148 limited funds for supportive services, current restrictions do not allow the12
149149 department to cover all the services needed to secure and maintain13
150150 housing, and it is unable to reimburse nonclinical providers for providing14
151151 those services;15
152152 (l) As a result, communities are not able to provide sustainable,16
153153 long-term services to the most vulnerable individuals to keep them safely17
154154 housed; and18
155155 (m) Many communities, particularly in rural and frontier areas, do19
156156 not have nonprofit organizations experienced in applying for grants and20
157157 implementing supportive housing programs, do not have the21
158158 programmatic or staff capacity to do so, and need technical assistance to22
159159 develop evidence-based, innovative solutions that are scaled and tailored23
160160 to their specific community needs.24
161161 (2) The general assembly further finds and declares that it is25
162162 therefore in Colorado's best interest to provide assistance and create26
163163 opportunities for communities across the state that are currently unable27

165165 -5- to access federal and state housing and supportive service funds through1
166166 training, technical assistance, and grant funding to support the2
167167 development and implementation of supportive housing and homelessness3
168168 prevention services for individuals with behavioral, mental health, and4
169169 substance use disorders who have been involved with or are at risk of5
170170 falling into the criminal or juvenile justice system.6
