4444 The bill creates a medical marijuana independent delivery license
4545 and a retail marijuana independent delivery license (licenses) to deliver
4646 and sell respective marijuana and marijuana products to consumers at
4747 permissible delivery locations. A person must have a social equity license
4848 to be issued the licenses. The department of revenue (department) is
4949 required to promulgate rules concerning the licenses.
5050 The bill creates an accelerator independent deliverer license,
5151 accelerator hospitality business license, and accelerator transporter license
5252 for social equity licensees qualified to participate in the accelerator
5353 program.
5454 The bill defines "permissible delivery locations" to establish where
5555 licensees with delivery privileges may deliver to consumers.
5656 The bill adds mandatory and permissive rule-making authority to
5757 the department concerning social-equity-related matters.
5858 The bill allows a marijuana hospitality licensee with a mobile
5959 facility to temporarily suspend its license privileges related to mobility in
6060 order to conduct non-marijuana commercial activities. The bill adds
6161 mandatory rule-making authority to the department concerning these
6262 matters.
6363 Beginning January 31, 2026, the bill requires the state licensing
6464 authority to provide an annual report to the finance committees of the
6565 house of representatives and the senate concerning active social equity or
6666 accelerator licenses and licensees, recommendations for new social equity
6767 or accelerator licenses, and recommendations for new or innovative
6868 funding sources for the social equity program. The department is required
6969 to convene a new, or utilize an existing, working group of persons to
7070 develop recommendations for the annual report.
7171 Effective April 1, 2025, the bill amends the eligibility requirements
7272 for a person to qualify as a social equity licensee. The new eligibility
7373 HB24-1061-2- requirements do not apply to licensee applications or licenses issued
7474 before April 1, 2025, except for a limited exception.
7575 The bill eliminates the $1 surcharge applied on deliveries.
7676 The bill requires the department of regulatory agencies, as part of
7777 its sunset review of the "Colorado Marijuana Code" in 2028, to review
7878 social equity licensing and the licenses.
7979 Under current law, there is the marijuana entrepreneur fund within
8080 the office of economic development that provides grants and loans to
8181 support marijuana industry entrepreneurs. The bill creates a new
8282 permissible grant for local jurisdictions that establish a social equity
8383 licensing program.
8484 The bill creates a tax credit for an accelerator-endorsed licensee
8585 who hosts and offers technical and capital support to a social equity
8686 licensee for at least 12 consecutive months. An eligible
8787 accelerator-endorsed licensee may claim up to $50,000 and may carry it
8888 forward as a credit against subsequent years' income tax liability for a
8989 period not exceeding 5 years. The tax credit may be claimed for tax years
9090 2026 through 2035.
9191 The bill amends the statutory provision concerning the retail
9292 marijuana sales tax to state that a retailer is not allowed to retain any
9393 portion of the retail marijuana sales tax collected to cover the expenses of
9494 collecting and remitting the tax.
9595 Be it enacted by the General Assembly of the State of Colorado:1
9696 SECTION 1. In Colorado Revised Statutes, 44-10-103, amend2
9797 (2), (35), (58), and (68.5); and add (2.3), (2.7), (4.7), (37.5), (46.5), and3

201201 marijuana. (2) (a) A person applying for licensure pursuant to this19
202202 article 10 must complete forms as provided by the state licensing20
203203 authority and must pay the application fee and the licensing fee, which21
204204 must be credited to the marijuana cash fund established pursuant to22
205205 section 44-10-801. The state licensing authority shall forward, within23
206206 seven days after receipt, one-half of the retail marijuana business license24
207207 application fee to the local jurisdiction unless the application is for an25
208208 accelerator cultivator, accelerator manufacturer, or accelerator store,26
209209 ACCELERATOR HOSPITALITY BUSINESS , ACCELERATOR TRANSPORTER , OR27

212212 jurisdiction has prohibited the operation of retail marijuana businesses2
213213 pursuant to section 16 (5)(f) of article XVIII of the state constitution. If3
214214 the license is denied, the state licensing authority may MUST refund only4
215215 the licensing fee to the applicant. The applicant's application fees must be5
216216 retained by the state licensing authority, and a local licensing authority6
217217 may retain the applicant's application fees.7

998998 require the individual to provide information necessary to verify the14
999999 individual is at least twenty-one years of age. The provided information15
