14-Be it enacted by the General Assembly of the State of Colorado:
15-SECTION 1. In Colorado Revised Statutes, amend 12-300-116 as
16-follows:
17-12-300-116. Repeal of article - review of functions. This article

48+! Sections 1 and 2 of the bill continue the regulation of
49+respiratory therapy for 11 years, until September 1, 2035;
50+! The definition of respiratory therapy in current law
51+includes certain treatments of patients pursuant to a
52+prescription issued by a physician, advanced practice
53+registered nurse, or certified midwife. Section 3 expands
54+the definition to also include a prescription issued by a
55+physician assistant.
56+! Current law exempts an unregistered polysomnographic
57+technologist (technologist) who practices respiratory
58+therapy from the state regulatory requirements for
59+respiratory therapists if the technologist is practicing under
60+the supervision of a respiratory therapist, physician, or
61+certain other practitioner. Section 4 narrows this exemption
62+to practices that do not exceed oxygen titration with pulse
63+oximetry and noninvasive positive pressure ventilation
64+titration.
65+! Sections 5 and 6 repeal an obsolete provision and a
66+redundant provision.

84-(VI) Mechanical or physiological ventilatory support;
85-(VII) Bronchopulmonary hygiene;
86-(VIII) Respiratory protocol and evaluation;
87-(IX) Cardiopulmonary resuscitation;
88-(X) Maintenance of the natural airways;
89-(XI) Insertion and maintenance of artificial airways;
90-(XII) Diagnostic and testing techniques required for implementation
91-of respiratory care protocols;
92-(XIII) Collection of specimens from the respiratory tract; or
93-(XIV) Analysis of blood gases and respiratory secretions and

95-SECTION 4. In Colorado Revised Statutes, 12-300-112, amend
96-(1)(a)(III) as follows:
97-12-300-112. Exceptions. (1) This article 300 does not prohibit:
98-(a) (III) The practice of respiratory therapy by polysomnographic
99-technologists who are not registered by or do not hold credentials from a
100-nationally recognized organization, but those polysomnographic
101-technologists shall only practice under the supervision of a respiratory
102-therapist, a physician, or an individual exempted from the provisions of
103- this
104-article 300 pursuant to subsection (1)(g) of this section,

116-satisfactory proof and certifies under penalty of perjury that the applicant
117-is either:
118-(a) Eligible for licensure by endorsement pursuant to the

124+an advanced practice registered nurse, or a certified midwife:9
125+(I) Administration of medical gases, exclusive of general10
126+anesthesia;11

122-credentialing body, as determined by the director, which credentials have

167+credentialing body, as determined by the director, which credentials have22
123168 not been suspended or revoked. or
124-(c) Functioning in the capacity of a respiratory therapist as of July
125-1, 2000, and has successfully passed, no later than July 1, 2001, the
126-certification or registration examination of a national respiratory therapy
127-credentialing body, as determined by the director.
128-SECTION 6. In Colorado Revised Statutes, amend 12-300-108 as
129-follows:
130-PAGE 4-HOUSE BILL 24-1253 12-300-108. Renewal of license. (1) At least sixty calendar days
131-prior to the expiration of a license, the director shall notify the licensee of
132-the pending expiration. The director shall make an expiration notice and a
133-renewal form available to the licensee. Before the expiration date, the
134-licensee shall complete the renewal form and return it to the division with
135-the renewal fee.
136-(2) Licenses issued pursuant to this article 300 are subject to the
137-renewal, expiration, reinstatement, and delinquency fee provisions specified
138-in section 12-20-202 (1) and (2). Any person whose license has expired
139-shall be
140- IS subject to the penalties provided in this article 300 or section
141-12-20-202 (1).
142-SECTION 7. Act subject to petition - effective date. This act
143-takes effect at 12:01 a.m. on the day following the expiration of the
144-ninety-day period after final adjournment of the general assembly; except
145-that, if a referendum petition is filed pursuant to section 1 (3) of article V
146-of the state constitution against this act or an item, section, or part of this act
147-within such period, then the act, item, section, or part will not take effect
148-unless approved by the people at the general election to be held in
149-PAGE 5-HOUSE BILL 24-1253 November 2024 and, in such case, will take effect on the date of the official
150-declaration of the vote thereon by the governor.
