The bill defines the term "assault weapon" and prohibits a person from manufacturing, importing, purchasing, selling, offering to sell, or transferring ownership of an assault weapon. The bill further prohibits a person from possessing a rapid-fire trigger activator. A person in violation of the prohibitions will be assessed a first-time penalty of $250,000 and $500,000 for each subsequent violation. A member of the United States armed forces, a peace officer, or other government officer or agent, to the extent that the person is otherwise authorized to acquire or possess an assault weapon and does so while acting within the scope of the person's duties; ! The manufacture, sale, or transfer of an assault weapon by a licensed firearms manufacturer to any branch of the United States armed forces, or to an entity that employs peace officers, for use by that entity or its employees; ! The transfer of an assault weapon to a licensed firearms dealer or gunsmith for the purposes of maintenance, repair, or modification, and the subsequent return of the assault weapon to the lawful owner; ! Any federal, state, or local historical society, museum, or institutional collection that is open to the public, provided that the assault weapon is securely housed and unloaded; ! A forensic laboratory, or any authorized agent or employee of the laboratory, for use exclusively in the course and scope of authorized activities; ! An entity that operates an armored vehicle business and an authorized employee of the entity while in the course and scope of employment; ! A licensed gun dealer who has remaining inventory of assault weapons as of August 1, 2024, and sells or transfers the remaining inventory only to a non-Colorado resident and the sale or transfer takes place out of state; or ! A peace officer. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. In Colorado Revised Statutes, add part 6 to article2 12 of title 18 as follows:3 PART 64 ASSAULT WEAPONS5 18-12-601. Legislative declaration. (1) T HE GENERAL ASSEMBLY6 FINDS AND DECLARES THAT:7 (a) M ASS SHOOTINGS ARE A SIGNIFICANT COMPONENT OF THE8 DISTINCTLY AMERICAN EPIDEMIC OF GUN VIOLENCE . GUN VIOLENCE OF9 1292-2- ALL TYPES ARE AN ONGOING AND GROWING THREAT TO THE PUBLIC1 HEALTH AND SAFETY OF ALL COLORADANS.2 (b) A S PREVENTABLE GUN DEATH FROM ALL TYPES CONTINUE TO3 DEVASTATE FAMILIES AND COMMUNITIES , IN THE FORM OF STATE4 VIOLENCE, COMPLETED SUICIDES , INTERPERSONAL VIOLENCE , AND5 ACCIDENTAL DEATHS, ASSAULT WEAPONS REMAIN A PREEMINENT FACTOR6 IN THE DEVASTATING CRISIS OF GUN FATALITIES;7 (c) I N RECENT YEARS , AMERICANS HAVE ENDURED AN8 UNFATHOMABLE AVERAGE OF MORE THAN ONE MASS SHOOTING PER DAY .9 C ONSISTENTLY, THE DEADLIEST MASS SHOOTING INCIDENTS IN THE10 U NITED STATES INVOLVED THE USE OF ASSAULT WEAPONS OR11 HIGH-CAPACITY MAGAZINES. SUCH INSTRUMENTS HAVE NO PLACE IN A12 CIVILIZED SOCIETY.13 (d) E VEN AS COLORADO HAS UNDERTAKEN CONCERTED COMMON14 SENSE EFFORTS TO DECREASE GUN VIOLENCE , COLORADO HAS STILL BEEN15 THE LOCATION OF SEVERAL MASS SHOOTINGS PERPETRATED WITH AN16 ASSAULT WEAPON;17 (e) W ELL-KNOWN PLACES THAT SHOULD HAVE ONLY EVER BEEN18 KNOWN AS SITES SAFE FOR JOY, LEARNING, COMMERCE, AND CARE ARE19 INSTEAD FOREVER ASSOCIATED WITH TRAGEDY OF MASS SHOOTINGS20 PERPETRATED BY WEAPONS WHICH SHOULD NEVER HAVE BEEN AVAILABLE21 FOR USE;22 (f) C OLORADO LOCATIONS THAT BECAME HOUSEHOLD NAMES23 BECAUSE OF MASS SHOOTINGS INCLUDE COLUMBINE HIGH SCHOOL24 (L ITTLETON); CENTURY THEATER (AURORA); KING SOOPERS (BOULDER);25 AND PLANNED PARENTHOOD, HALLOWEEN EVE, AND CLUB Q (ALL IN26 C OLORADO SPRINGS);27 1292 -3- (g) ASSAULT WEAPONS AND HIGH -CAPACITY MAGAZINES ARE1 DISPROPORTIONATELY USED IN PUBLIC MASS SHOOTINGS , AND THE2 REASONS ARE BOTH OBVIOUS AND IRREFUTABLE . ASSAULT WEAPONS ARE3 UNIQUELY LETHAL BY DESIGN . THEY ENTAIL TACTICAL FEATURES4 DESIGNED FOR WARFARE, REFINED TO MAXIMIZE KILLING LARGE NUMBERS5 OF PEOPLE QUICKLY AND EFFICIENTLY.6 (h) T HE TACTICAL FEATURES ON ASSAULT WEAPONS ARE NOT7 MERELY COSMETIC, AND THEY ARE NOT MINOR . THEY DIFFERENTIATE8 ASSAULT WEAPONS FROM OTHER FIREARMS BY ALLOWING A SHOOTER TO9 BETTER CONCEAL WEAPONS , MAKE IT EASIER TO FIRE A HIGH VOLUME OF10 AMMUNITION IN A SHORT PERIOD OF TIME WHILE MAINTAINING ACCURACY ,11 MAXIMIZING CATASTROPHIC INJURY , AND PROVIDING EASE OF USE FOR12 LESS THAN EXPERT USERS.13 (2) T HE GENERAL ASSEMBLY FURTHER FINDS THAT :14 (a) A SSAULT WEAPONS ARE NOT SUITABLE FOR SELF DEFENSE AND15 ARE NOT WELL-SUITED FOR HUNTING, SPORTING, OR ANY PURPOSE OTHER16 THAN MASS KILLING;17 (b) T HE FIREARMS INDUSTRY HAS SPECIFICALLY MARKETED18 ASSAULT WEAPONS AS TACTICAL , HYPER MASCULINE, AND MILITARY19 STYLE IN A MANNER THAT OVERTLY APPEALS TO THE VERY PEOPLE MOST20 LIKELY TO ACQUIRE SUCH WEAPONS AS A MEANS TO GAIN INFAMY AS A21 MASS SHOOTER;22 (c) I T IS CRITICAL TO LIMIT THE PROSPECTIVE SALE OF ASSAULT23 WEAPONS AND ACCESSORIES, WHILE PERMITTING EXISTING LEGAL OWNERS24 TO RETAIN THE ASSAULT WEAPONS THEY CURRENTLY OWN ;25 (d) J UST AS THE DESIGN OF ASSAULT WEAPONS MAXIMIZES THEIR26 LETHALITY, POLICY DESIGNED TO INTERRUPT THE PROLIFERATION OF27 1292 -4- THESE WEAPONS HAS BEEN SHOWN TO BE JUST AS SUCCESSFUL IN1 DECREASING DEATHS;2 (e) B ANNING ASSAULT WEAPONS LEADS TO A DROP IN MASS3 SHOOTINGS AND GUN MASSACRES . IN THE TEN YEARS THAT ASSAULT4 WEAPONS WERE LIMITED BY A FEDERAL BAN , GUN MASSACRES DROPPED5 DRASTICALLY, BY AT LEAST THIRTY-SEVEN PERCENT. CONVERSELY, AFTER6 THE FEDERAL ASSAULT WEAPON BAN EXPIRED IN 2004, GUN MASSACRES7 SKYROCKETED BY APPROXIMATELY ONE HUNDRED AND EIGHTY -THREE8 PERCENT.9 (f) F EDERAL PROHIBITIONS ARE NOT ALONE IN CURTAILING MASS10 SHOOTINGS. INDEED, STATE PROHIBITIONS OF ASSAULT WEAPONS ARE11 ASSOCIATED WITH A LOWER LIKELIHOOD OF A MASS SHOOTING EVENT ,12 LOWER LIKELIHOOD OF DEATH DUE TO A MASS SHOOTING EVENT , AND13 LOWER GUN DEATH RATES OVERALL .14 (3) T HEREFORE, THE GENERAL ASSEMBLY DETERMINES THAT A15 BAN ON KNOWINGLY MANUFACTURING , IMPORTING, PURCHASING, SELLING,16 OFFERING TO SELL, OR TRANSFERRING OWNERSHIP OF AN ASSAULT17 WEAPON, CAUSING THE MANUFACTURE , IMPORTATION, PURCHASE, SALE,18 OFFER TO SELL, OR TRANSFER OF OWNERSHIP OF ASSAULT WEAPONS IN19 C OLORADO IS IN THE BEST INTERESTS OF THE CITIZENS AND GUESTS OF20 OUR GREAT STATE.21 18-12-602. Definitions. A S USED IN THIS PART 6, UNLESS THE22 CONTEXT OTHERWISE REQUIRES :23 (1) ".50 CALIBER RIFLE" MEANS A CENTER FIRE RIFLE CAPABLE OF24 FIRING A .50 CALIBER CARTRIDGE. "FIXED MAGAZINE" DOES NOT INCLUDE AN2 ATTACHED TUBULAR DEVICE DESIGNED TO ACCEPT , AND CAPABLE OF3 OPERATING ONLY WITH, .22 CALIBER RIMFIRE AMMUNITION.4 (6) "G UN SHOW VENDOR" MEANS ANY PERSON WHO EXHIBITS ,5 SELLS, OFFERS FOR SALE, TRANSFERS, OR EXCHANGES ANY FIREARM ,6 INCLUDING AN ASSAULT WEAPON , AT A GUN SHOW, REGARDLESS OF7 WHETHER THE PERSON ARRANGES WITH A GUN SHOW PROMOTER FOR A8 FIXED LOCATION FROM WHICH TO EXHIBIT , SELL, OFFER FOR SALE,9 TRANSFER, OR EXCHANGE ANY FIREARM, INCLUDING AN ASSAULT WEAPON.10 (7) "L ICENSED GUN DEALER" OR "LICENSED FIREARMS DEALER"11 MEANS ANY PERSON WHO IS A LICENSED IMPORTER , LICENSED12 MANUFACTURER, OR DEALER WHO IS LICENSED PURSUANT TO 18 U.S.C.13 SEC. 923, AS AMENDED, AS A FEDERALLY LICENSED FIREARMS DEALER .14 (8) "P EACE OFFICER" HAS THE SAME MEANING AS SET FORTH IN15 SECTION 16-2.5-101.16 (9) "R APID-FIRE TRIGGER ACTIVATOR" MEANS:17 (a) A NY MANUAL, POWER-DRIVEN, OR ELECTRONIC DEVICE THAT18 IS DESIGNED AND FUNCTIONS TO INCREASE THE RATE OF FIRE OF A19 SEMIAUTOMATIC FIREARM WHEN THE DEVICE IS ATTACHED TO THE20 FIREARM;21 (b) A NY PART OF A SEMIAUTOMATIC FIREARM OR COMBINATION OF22 PARTS THAT IS DESIGNED AND FUNCTIONS TO INCREASE THE RATE OF FIRE23 OF A SEMIAUTOMATIC FIREARM BY ELIMINATING THE NEED FOR THE24 OPERATOR OF THE FIREARM TO MAKE A SEPARATE MOVEMENT FOR EACH25 INDIVIDUAL FUNCTION OF THE TRIGGER; OR26 (c) A NY OTHER DEVICE, PART, OR COMBINATION OF PARTS THAT IS27 1292 -12- DESIGNED AND FUNCTIONS TO SUBSTANTIALLY INCREASE THE RATE OF1 FIRE OF A SEMIAUTOMATIC FIREARM ABOVE THE STANDARD RATE OF FIRE2 FOR A SEMIAUTOMATIC FIREARM THAT IS NOT EQUIPPED WITH THAT3 DEVICE, PART, OR COMBINATION OF PARTS.4 18-12-603. Manufacture, import, purchase, sale, offer to sell,5 and transfer of ownership of assault weapons prohibited -6 exemptions - penalties. (1) E XCEPT AS OTHERWISE PROVIDED IN7 SUBSECTIONS (2) AND (3) OF THIS SECTION, A PERSON SHALL NOT8 KNOWINGLY MANUFACTURE , IMPORT, PURCHASE, SELL, OFFER TO SELL, OR9 TRANSFER OWNERSHIP OF, OR KNOWINGLY CAUSE THE MANUFACTURE ,10 IMPORTATION, PURCHASE, SALE, OFFER OF SALE, OR TRANSFER OF11 OWNERSHIP OF, AN ASSAULT WEAPON.12 (2) T HE PROHIBITION DESCRIBED IN THIS SECTION DOES NOT APPLY13 TO:14 (a) A PERSON WHO IS AN ACTIVE MEMBER OF THE UNITED STATES15 ARMED FORCES WHILE ON DUTY AND SERVING IN CONFORMANCE WITH THE16 POLICIES OF THE UNITED STATES ARMED FORCES;17 (b) THE MANUFACTURE, SALE, OR TRANSFER OF AN ASSAULT18 WEAPON BY A LICENSED FIREARMS MANUFACTURER TO A PEACE OFFICER,19 OR TO AN ENTITY THAT EMPLOYS PEACE OFFICERS ; AND20 (c) THE MANUFACTURE, SALE, OR TRANSFER OF RAPID-FIRE21 TRIGGER ACTIVATORS BY A LICENSED FIREARMS MANUFACTURER TO A22 PEACE OFFICER, OR TO AN ENTITY THAT EMPLOYS PEACE OFFICERS .23 (d) THE MANUFACTURE, SALE, OR TRANSFER OF AN ASSAULT24 WEAPON BY A LICENSED FIREARMS MANUFACTURER TO ANY BRANCH OF25 THE UNITED STATES ARMED FORCES;26 (e) THE TRANSFER OF AN ASSAULT WEAPON TO A LICENSED27 1292 -13- FIREARMS DEALER FOR TEMPORARY STORAGE OR PERMANENT DISPOSAL ,1 OR TO A GUNSMITH FOR THE PURPOSES OF MAINTENANCE , REPAIR,2 MODIFICATION, AND THE SUBSEQUENT RETURN OF THE ASSAULT WEAPON3 TO THE LAWFUL OWNER , PROVIDED THE LAWFUL OWNER IS NOT4 OTHERWISE PROHIBITED BY STATUTE ;5 (f) ANY FEDERAL, STATE, OR LOCAL HISTORICAL SOCIETY ,6 MUSEUM, OR INSTITUTIONAL COLLECTION THAT IS OPEN TO THE PUBLIC ,7 PROVIDED THAT THE ASSAULT WEAPON IS SECURELY HOUSED AND8 UNLOADED;9 (g) A FORENSIC LABORATORY, OR ANY AUTHORIZED AGENT OR10 EMPLOYEE OF THE LABORATORY , FOR USE EXCLUSIVELY IN THE COURSE11 AND SCOPE OF AUTHORIZED ACTIVITIES;12 (h) AN ENTITY THAT OPERATES AN ARMORED VEHICLE BUSINESS13 AND AN AUTHORIZED EMPLOYEE OF THE ENTITY WHILE IN THE COURSE AND14 SCOPE OF EMPLOYMENT;15 (i) A LICENSED GUN DEALER WHO HAS REMAINING INVENTORY OF16 ASSAULT WEAPONS ON OR AFTER AUGUST 1, 2024, AND SELLS OR17 TRANSFERS THE REMAINING INVENTORY ONLY TO A NON -COLORADO18 RESIDENT AND THE SALE OR TRANSFER TAKES PLACE OUT OF STATE . A19 SALE OR TRANSFER OF INVENTORY REMAINING ON OR AFTER AUGUST 1,20 2024, TO A COLORADO RESIDENT OR IN THIS STATE IS A VIOLATION OF THIS21 SECTION.22 (j) A PEACE OFFICER; AND23 (k) AN ENTITY THAT EMPLOYS PEACE OFFICERS FOR USE BY THAT24 ENTITY OR ITS EMPLOYEES.25 (3) AN ASSAULT WEAPON SHALL NOT BE SOLD OR TRANSFERRED BY26 AN INDIVIDUAL ON OR AFTER JULY 1, 2024, TO ANYONE WITHIN THE STATE,27 1292 -14- EXCEPT TO:1 (a) AN HEIR BY BEQUEST OR INTESTATE SUCCESSION ; OR2 (b) A LICENSED GUN OR FIREARMS DEALER, WHO SHALL RENDER3 THE WEAPON INOPERABLE WITHIN NINETY DAYS OF THE TRANSFER .4 (4) (a) AN INDIVIDUAL OR ENTITY THAT DOES NOT HAVE A PERMIT5 TO SELL FIREARMS BUT SELLS OR ATTEMPTS TO MAKE A PRIVATE SALE OF6 AN ASSAULT WEAPON IN VIOLATION OF SUBSECTION (1) OF THIS SECTION7 ON OR AFTER JULY 1, 2025, SHALL BE ASSESSED A CIVIL PENALTY IN THE8 AMOUNT OF SEVEN HUNDRED AND FIFTY DOLLARS .9 (b) A LICENSED GUN DEALER, LICENSED FIREARMS DEALER, GUN10 SHOW VENDOR, OR OTHER PERSON THAT HAS A PERMIT TO SELL FIREARMS11 WHO SELLS OR ATTEMPTS TO SELL AN ASSAULT WEAPON IN VIOLATION OF12 SUBSECTION (1) OF THIS SECTION ON OR AFTER JULY 1, 2025, SHALL BE13 REPORTED TO THE DEPARTMENT OF REVENUE. THE DEPARTMENT OF14 REVENUE SHALL TAKE APPROPRIATE ACTIONS AS REQUIRED BY LAW .15 (c) A LICENSED GUN DEALER, LICENSED FIREARMS DEALER, GUN16 SHOW VENDOR, OR OTHER PERSON THAT HAS A PERMIT TO SELL FIREARMS17 THAT PURCHASES AN ASSAULT WEAPON FROM A MANUFACTURER OF18 ASSAULT WEAPONS THAT OPERATES IN COLORADO SHALL BE REPORTED TO19 THE DEPARTMENT OF REVENUE. THE DEPARTMENT OF REVENUE SHALL20 TAKE APPROPRIATE ACTIONS AS REQUIRED BY LAW .21 18-12-604. Possession of rapid-fire trigger activators22 prohibited - exemptions - penalties. (1) E XCEPT AS OTHERWISE23 PROVIDED IN SUBSECTION (2) OF THIS SECTION, A PERSON SHALL NOT24 KNOWINGLY POSSESS A RAPID-FIRE TRIGGER ACTIVATOR.25 (2) T HE PROHIBITION DESCRIBED IN THIS SECTION DOES NOT APPLY26 TO:27 1292 -15- (a) A MEMBER OF THE UNITED STATES ARMED FORCES, TO THE1 EXTENT THAT THE PERSON IS OTHERWISE AUTHORIZED TO ACQUIRE AN2 RAPID-FIRE TRIGGER ACTIVATOR AND DOES SO WHILE ACTING WITHIN THE3 SCOPE OF THE PERSON'S DUTIES;4 (b) T HE MANUFACTURE , SALE, OR TRANSFER OF RAPID -FIRE5 TRIGGER ACTIVATORS BY A LICENSED FIREARMS MANUFACTURER TO ANY6 BRANCH OF THE UNITED STATES ARMED FORCES;7 (c) A FORENSIC LABORATORY, OR ANY AUTHORIZED AGENT OR8 EMPLOYEE OF THE LABORATORY , FOR USE EXCLUSIVELY IN THE COURSE9 AND SCOPE OF AUTHORIZED ACTIVITIES;10 (d) A LICENSED GUN DEALER WHO HAS REMAINING INVENTORY OF11 RAPID-FIRE TRIGGER ACTIVATORS ON OR AFTER AUGUST 1, 2024, AND12 SELLS OR TRANSFERS THE REMAINING INVENTORY ONLY TO A13 NON-COLORADO RESIDENT AND THE SALE OR TRANSFER TAKES PLACE OUT14 OF STATE. A SALE OR TRANSFER OF INVENTORY REMAINING ON OR AFTER15 A UGUST 1, 2024, TO A COLORADO RESIDENT OR IN THIS STATE IS A16 VIOLATION OF THIS SECTION.17 (e) A PEACE OFFICER; AND18 (f) A N ENTITY THAT EMPLOYS PEACE OFFICERS FOR USE BY THAT19 ENTITY OR ITS EMPLOYEES.20 (3) (a) AN INDIVIDUAL OR ENTITY THAT DOES NOT HAVE A21 PERMIT TO SELL FIREARMS BUT SELLS OR ATTEMPTS TO MAKE A PRIVATE22 SALE OF A RAPID-FIRE TRIGGER ACTIVATOR IN VIOLATION OF SUBSECTION23 (1) OF THIS SECTION ON OR AFTER JULY 1, 2025, SHALL BE ASSESSED A24 CIVIL PENALTY IN THE AMOUNT OF SEVEN HUNDRED AND FIFTY DOLLARS.25 (b) A LICENSED GUN DEALER, LICENSED FIREARMS DEALER, GUN26 SHOW VENDOR, OR OTHER PERSON THAT HAS A PERMIT TO SELL FIREARMS27 1292 -16- WHO SELLS OR ATTEMPTS TO SELL A RAPID-FIRE TRIGGER ACTIVATOR IN1 VIOLATION OF SUBSECTION (1) OF THIS SECTION ON OR AFTER JULY 1,2 2025, SHALL BE REPORTED TO THE DEPARTMENT OF REVENUE . THE3 DEPARTMENT OF REVENUE SHALL TAKE ACTIONS AS REQUIRED BY LAW .4 (c) A LICENSED GUN DEALER, LICENSED FIREARMS DEALER, GUN5 SHOW VENDOR, OR OTHER PERSON THAT HAS A PERMIT TO SELL FIREARMS6 THAT PURCHASES A RAPID-FIRE TRIGGER ACTIVATOR FROM A7 MANUFACTURER OF RAPID-FIRE TRIGGER ACTIVATORS THAT OPERATES IN8 COLORADO SHALL BE REPORTED TO THE DEPARTMENT OF REVENUE. THE9 DEPARTMENT OF REVENUE THE DEPARTMENT OF REVENUE SHALL ACTIONS10 AS REQUIRED BY LAW.11 18-12-605. Interstate transportation of assault weapons. THIS12 PART 6 DOES NOT APPLY TO THE TRANSPORTATION OF ASSAULT WEAPONS13 THROUGH THE STATE BY A PERSON WHO IS NOT OTHERWISE PROHIBITED BY14 STATE OR FEDERAL LAW FROM TRANSPORTING, SHIPPING, OR RECEIVING A15 FIREARM. A PERSON IS ENTITLED TO TRANSPORT AN ASSAULT WEAPON FOR16 ANY LAWFUL PURPOSE FROM ANY PLACE WHERE THE PERSON MAY17 LAWFULLY POSSESS AND CARRY THE ASSAULT WEAPON TO ANY OTHER18 PLACE WHERE THE PERSON MAY LAWFULLY POSSESS AND CARRY THE19 ASSAULT WEAPON, PROVIDED THAT THE ASSAULT WEAPON IS20 TRANSPORTED IN ACCORDANCE WITH THE FEDERAL REQUIREMENTS SET21 FORTH IN 18 U.S.C. SEC 926(a).22 SECTION 2. In Colorado Revised Statutes, 18-12-108.7, amend23 (3) as follows:24 18-12-108.7. Unlawfully providing or permitting a juvenile to25 possess a handgun - penalty - unlawfully providing a firearm other26 than a handgun to a juvenile - penalty. (3) With regard to firearms27 1292 -17- other than handguns, no INCLUDING ASSAULT WEAPONS , AS DEFINED IN1 SECTION 18-12-602, A person shall NOT sell, rent, or transfer ownership2 or allow unsupervised possession of a firearm, INCLUDING AN ASSAULT3 WEAPON AS PROHIBITED PURSUANT TO PART 6 OF THIS ARTICLE 12, with4 or without remuneration to any juvenile without the consent of the5 juvenile's parent or legal guardian. Unlawfully providing a firearm,6 INCLUDING AN ASSAULT WEAPON, AS DEFINED IN SECTION 18-12-602, other7 than a handgun to a juvenile in violation of this subsection (3) is a class8 1 misdemeanor.9 SECTION 3. Safety clause. The general assembly finds,10 determines, and declares that this act is necessary for the immediate11 preservation of the public peace, health, or safety or for appropriations for12 the support and maintenance of the departments of the state and state13 institutions.14 1292 -18-
