11-SECTION 1. In Colorado Revised Statutes, 24-82-108, amend (1),
12-(2)(a)(I) introductory portion, (2)(a)(I)(D), (2)(d), (2)(e), (3), and (4); and
13-add (3.5) as follows:

17-HE GENERAL ASSEMBLY HEREBY FINDS AND DECLARES THAT :
18-(a) It is the intent of the general assembly to ensure that the historic
19-character and architectural integrity of the capitol building and grounds be
20-preserved and promoted;

23+The capitol building advisory committee (committee) advises the
24+general assembly regarding the protection of the historic character of the
25+capitol building and other buildings in the capitol annex. The bill
26+modifies the statute that creates and specifies the duties of the committee
27+as follows:

49+including its art, memorials, furniture, and architectural
50+fixtures;
51+! Clarifies that the ex officio members of the committee are
52+voting members of the committee in accordance with
53+current practice;
54+! Adds the capitol building annex to the list of buildings for
55+which the committee is required to review, advise, and
56+make recommendations to the capital development
57+committee regarding plans to restore, redecorate, and
58+reconstruct historic elements of the building;
59+! Specifies the buildings and areas within the capitol
60+complex for which the committee may engage in
61+long-range planning for modifications and improvements;
62+! Requires the committee to determine, based on consultation
63+with and the recommendations of history Colorado, which
64+art, memorials, architectural fixtures, and furniture that is
65+original to the state capitol building is part of the state's
66+collection of historic materials known as the Colorado
67+collection (Colorado collection); and
68+! Clarifies that the committee has authority over publications
69+on the history of the state capitol building and that the
70+committee may authorize other state capitol building
71+memorabilia for sale to the public.
72+In addition, history Colorado, at the direction and under the
73+supervision of the committee, is required to inventory all art, memorials,
74+architectural fixtures, and furniture that is original to the state capitol
75+building and make recommendations to the capitol building advisory
76+committee regarding which items are appropriate for inclusion in the
77+Colorado collection. The bill specifies that history Colorado holds in trust
78+for the people of Colorado any items original to the capitol building that
79+are part of the Colorado collection, but that the advisory committee
80+retains authority over the collection on behalf of the general assembly and
81+in accordance with the policies and requirements of the state register of
82+historic properties.
83+Be it enacted by the General Assembly of the State of Colorado:1

72-(3) Duties of the advisory committee. The advisory committee
73-shall have HAS the following duties SPECIFIED IN SUBSECTIONS (3)(a)
74-THROUGH (3)(i) OF THIS SECTION.
75-(a) Plans to restore, redecorate, and reconstruct space in
76-specified buildings and grounds. (I) The advisory committee shall review,
77-advise, and make recommendations to the capital development committee
78-with respect to
79- REGARDING plans to restore, redecorate, and reconstruct
80-space within the public and ceremonial areas of the state capitol buildings
81-group BUILDING, THE HISTORIC ELEMENTS OF THE INTERIOR AND EXTERIOR
82-OF THE CAPITOL BUILDING ANNEX AND THE SURROUNDING GROUNDS OF THE
83-CAPITOL BUILDING ANNEX
84-, the legislative services building and the
85-surrounding grounds of such building, and the surrounding grounds of the
86-state capitol building bounded by Colfax avenue on the north, Grant street
87-on the east, Fourteenth avenue on the south, and Broadway on the west, in
88-the city and county of Denver. This shall include but not be
89- INCLUDES BUT
90-IS NOT
91- limited to the corridors, rotundas, lobbies, entrance ways, stairways,
92-restrooms, porticos, steps, and elevators.
93-(II) The committee shall not have responsibility
94- IS NOT RESPONSIBLE
95-for reviewing, advising, or making recommendations concerning the outer
96-office of the executive suite and the areas used for office space, legislative
97-chambers, and legislative committee meeting rooms, except as to structural
98-modifications affecting the rose onyx, marble, granite, gold, oak woodwork,
99-or brass fixtures and trim as provided for in paragraph (b) of this subsection
100-(3) SPECIFIED IN SUBSECTION (3)(b) OF THIS SECTION.
101-(b) Projects affecting capitol building rose onyx, marble, granite,
102-gold, oak woodwork, and brass fixtures and trim. (I) The advisory
103-committee shall review all planned construction projects affecting the rose
104-onyx, marble, granite, gold, oak woodwork, and brass fixtures and trim of
105-the state capitol building, and shall submit a written report to the capital
106-development committee containing the advisory committee's findings. No
107-such project affecting AN AGENCY OR DEPARTMENT SHALL NOT BEGIN A
108-PROJECT THAT AFFECTS
109- the rose onyx, marble, granite, gold, oak woodwork,
110-and brass fixtures and trim shall be made
111- without review by said THE
112-advisory committee and the consent of the capital development committee.

117- THE project is reviewed by the advisory committee and approved

119-(II) Notwithstanding the provisions of this paragraph (b)
120-SUBSECTION (3)(b)(I) OF THIS SECTION, the department of personnel shall
121-have the authority to MAY perform emergency repairs where the safety of
122-persons or the well-being of the building would be jeopardized by delay.
123-Such emergency repairs shall be undertaken

132-the department of personnel and with the approval of the capital
133-development committee, may engage in long-range planning for
134-modifications and improvements to the state capitol building and its
135-surrounding grounds SPACE WITHIN THE PUBLIC AND CEREMONIAL AREAS OF
136-THE STATE CAPITOL BUILDING

151-STEPS, AND ELEVATORS.
152-(d) Determination of items in the Colorado collection. The
153-advisory committee shall identify all furniture original to the state capitol
154-building and create an inventory of such furniture. Any costs associated
155-with identifying and inventorying furniture original to the state capitol
156-building shall be paid with moneys raised through private sources and shall
157-not be paid from the general fund. The department of personnel is hereby
158-granted the authority to collect and use such moneys raised by private
159-PAGE 4-HOUSE BILL 24-1442 sources for the purpose of identifying and inventorying all furniture original
160-to the state capitol building. The possession of all furniture original to the
161-state capitol building shall be retained by the department of administration
162-and shall be made available for use in the state capitol building. The
163-furniture original to the state capitol building shall remain in the state
164-capitol building at all times. THE ADVISORY COMMITTEE SHALL DETERMINE ,
165-BASED ON CONSULTATION WITH AND THE RECOMMENDATIONS OF HISTORY
166-COLORADO PURSUANT TO SUBSECTION (3.5) OF THIS SECTION, WHICH ART,
167-MEMORIALS, ARCHITECTURAL FIXTURES, AND FURNITURE THAT IS ORIGINAL
168-TO THE STATE CAPITOL BUILDING IS PART OF THE STATE
169-'S COLLECTION OF
170-HISTORIC MATERIALS KNOWN AS THE
171-COLORADO COLLECTION.

150+INTERIOR AND EXTERIOR OF THE CAPITOL BUILDING ANNEX AND THE27

152+-4- SURROUNDING GROUNDS OF THE CAPITOL BUILDING ANNEX , the legislative1
153+services building and the surrounding grounds of such building, and the2
154+surrounding grounds of the state capitol building bounded by Colfax3
155+avenue on the north, Grant street on the east, Fourteenth avenue on the4
156+south, and Broadway on the west, in the city and county of Denver. This5
157+shall include but not be INCLUDES BUT IS NOT limited to the corridors,6
158+rotundas, lobbies, entrance ways, stairways, restrooms, porticos, steps,7
159+and elevators.8
160+(II) The committee shall not have responsibility IS NOT9
161+RESPONSIBLE for reviewing, advising, or making recommendations10
162+concerning the outer office of the executive suite and the areas used for11
163+office space, legislative chambers, and legislative committee meeting12
164+rooms, except as to structural modifications affecting the rose onyx,13
165+marble, granite, gold, oak woodwork, or brass fixtures and trim as14
166+provided for in paragraph (b) of this subsection (3) SPECIFIED IN15
167+SUBSECTION (3)(b) OF THIS SECTION.16
168+(b) Projects affecting capitol building rose onyx, marble,17
169+granite, gold, oak woodwork, and brass fixtures and trim. (I) The18
170+advisory committee shall review all planned construction projects19
171+affecting the rose onyx, marble, granite, gold, oak woodwork, and brass20
172+fixtures and trim of the state capitol building, and shall submit a written21
173+report to the capital development committee containing the advisory22
174+committee's findings. No such project affecting AN AGENCY OR23
175+DEPARTMENT SHALL NOT BEGIN A PROJECT THAT AFFECTS the rose onyx,24
176+marble, granite, gold, oak woodwork, and brass fixtures and trim shall be25
177+made without review by said THE advisory committee and the consent of26
178+the capital development committee. No Alteration to the above listed27

180+-5- items shall be ITEMS LISTED IN THIS SUBSECTION (3)(b) IS NOT permitted1
181+in any area of the state capitol building until such THE project is reviewed2
182+by the advisory committee and approved by the capital development3
183+committee.4
184+(II) Notwithstanding the provisions of this paragraph (b)5
185+SUBSECTION (3)(b)(I) OF THIS SECTION, the department of personnel shall6
186+have the authority to MAY perform emergency repairs where the safety of7
187+persons or the well-being of the building would be jeopardized by delay.8
188+Such emergency repairs shall be undertaken THE DEPARTMENT OF9

212+(d) Determination of items in the Colorado collection. The3
213+advisory committee shall identify all furniture original to the state capitol4
214+building and create an inventory of such furniture. Any costs associated5
215+with identifying and inventorying furniture original to the state capitol6

218+hereby granted the authority to collect and use such moneys raised by9
219+private sources for the purpose of identifying and inventorying all10
220+furniture original to the state capitol building. The possession of all11
221+furniture original to the state capitol building shall be retained by the12
222+department of administration and shall be made available for use in the13
223+state capitol building. The furniture original to the state capitol building14
224+shall remain in the state capitol building at all times. THE ADVISORY15
225+COMMITTEE SHALL DETERMINE , BASED ON CONSULTATION WITH AND THE16
226+RECOMMENDATIONS OF HISTORY COLORADO PURSUANT TO SUBSECTION17
227+(3.5)
228+ OF THIS SECTION, WHICH ART, MEMORIALS, ARCHITECTURAL18

176-development committee regarding such furniture

181-elements of the state capitol building, the advisory committee shall
182-formulate a plan for publishing HAS AUTHORITY OVER publications on the

184-other state capitol building memorabilia for sale to the public. This plan
185-shall be presented to the capital development committee no later than
186-October 1, 1991. All moneys MONEY received from the sale of such items

188-fund established by section 8 of the "Enabling Act of Colorado", which

245-a procedure for such evaluations, which procedure

280-procedure developed by the advisory committee pursuant to subparagraph
281-(I) of this paragraph (h) SUBSECTION (3)(h)(I) OF THIS SECTION. This
282-subparagraph (III) shall SUBSECTION (3)(h)(III) DOES not apply to objects
283-of art or memorials placed prior to the formation of the advisory committee.
284-(i) Duties of former fallen heroes memorial commission. (I) The
285-advisory committee shall be IS responsible for any remaining duties of the
286-former fallen heroes memorial commission as it existed in section
287-24-80-1402 prior to its repeal. The advisory committee shall perform any
288-remaining duties with the assistance of the department of personnel and a
289-Colorado 501(c)(3) organization created for the purpose of raising funds for
290-the construction of the fallen heroes memorial.
291-(II) This subsection (3)(i) is repealed, effective July 1 of the year

293-executive director of the department of personnel that the appropriate
