4541 The bill makes modifications to several aspects of the regional
4642 transportation district (district), including modifications to increase transit
4743 ridership and to promote district transparency and accountability.
4844 Regional fixed guideway mass transit systems. In connection
4945 with the district's authority to implement regional fixed guideway mass
5046 transit systems, section 2 of the bill requires the district to:
5147 ! Submit its proposed fixed-route transit service plans to the
5248 Denver regional council of governments (DRCOG) for its
5349 review and input;
5450 ! Coordinate with DRCOG regarding the implementation of
5551 fixed-route transit service plans;
5652 ! Ensure that district service decisions are consistent with the
5753 DRCOG regional transportation plan;
5854 ! Coordinate transit and land use decisions to ensure that
5955 transit services will be provided to new and existing
6056 transit-oriented communities; and
6157 ! Acknowledge established transit centers and provide a
6258 preference for transit centers when determining transit
6359 services and routes.
6460 In addition, section 2 requires the department of transportation
6561 (department), in consultation with DRCOG, to contract with a third party
6662 to conduct a study regarding the size of the district and transit-reliant
6763 services and to submit the results of the study to specified entities by
6864 March 1, 2026. The district board of directors (board) is required to take
6965 into consideration the findings of the study in the creation of its 10-year
7066 strategic plan, which section 13 requires the board to create.
7167 Section 3 specifies that in operating a fixed guideway mass transit
7268 system, the district is required to coordinate its schedule with the
7369 schedules of other transit providers to facilitate the use of transit across
7470 the district and relevant transit entities.
7571 Current board through December 31, 2024. Currently, the board
7672 consists of 15 directors, each of whom is elected to serve a 4-year term by
7773 the eligible electors in one of 15 director districts. District elections are
7874 held in November of even-numbered years, and each director represents
7975 only the residents of the director district in which the director was elected.
8076 Of the 15 directors on the current board, 8 directors were elected in
8177 November 2020 for terms that expire on December 31, 2024, and 7
8278 directors were elected in November 2022 for terms that expire on
8379 December 31, 2026.

8581 -2- Section 4 terminates the current board on December 31, 2024, and
8682 specifies that the offices of the 8 directors whose terms expire on
8783 December 31, 2024, will not be filled at the district election in November
8884 2024. Section 4 also specifies that the offices of the 7 directors whose
8985 terms expire on December 31, 2026, will not be filled at the November
9086 2026 district election, and that those 7 directors will serve the last 2 years
9187 of their terms on a newly created transitional board that will govern the
9288 district from January 1, 2025, through December 31, 2026.
9389 Transitional board from January 1, 2025, through December
9490 31, 2026. Beginning January 1, 2025, through December 31, 2026, the
9591 district is governed by a board consisting of 11 voting directors and 3
9692 nonvoting ex officio directors (transitional board), each of whom serves
9793 the district at large. Section 5 specifies that the directors of the
9894 transitional board include:
9995 ! The 7 directors who were elected to the board at the district
10096 election in November 2022 who will serve the second 2
10197 years of their terms as voting directors on the transitional
10298 board; except that a vacancy caused on or after January 1,
10399 2025, by such a director will not be filled. In addition,
104100 beginning January 1, 2025, each director elected at the
105101 November 2022 district election represents the entire
106102 district rather than only the director district that the director
107103 was elected to represent at such election.
108104 ! 2 voting directors who are elected at large by the eligible
109105 electors of the district at the November 2024 district
110106 election for a 4-year term beginning on January 1, 2025.
111107 Such directors serve the first 2 years of their terms on the
112108 transitional board and serve the second 2 years of their
113109 terms on a newly created board (new board) that will
114110 govern the district beginning January 1, 2027.
115111 ! 2 voting directors who satisfy certain criteria who are
116112 appointed by the governor and confirmed by the senate for
117113 terms beginning January 1, 2025. Of such directors, one
118114 serves a 2-year term that expires on December 31, 2026,
119115 and one serves a 4-year term, the second 2 years of which
120116 the director serves on the new board.
121117 ! The executive director of the department or the director's
122118 designee, who is a nonvoting ex officio director; and
123119 ! 2 nonvoting directors who satisfy certain criteria and who
124120 are appointed by DRCOG for terms beginning January 1,
125121 2025. Of such directors, one serves a 2-year term that
126122 expires on December 31, 2026, and one serves a 4-year
127123 term, the second 2 years of which the director serves on the
128124 new board.
129125 New board beginning January 1, 2027. Beginning January 1,

132128 directors and 3 nonvoting directors, all of whom serve 4-year terms.
133129 Section 6 specifies that the directors on the new board include:

135131 of the district. Of the first 5 elected directors to serve on the
136132 new board, 2 directors represent the district at large and are
137133 the directors who were elected at the November 2024
138134 district election and served the first 2 years of their terms
139135 on the transitional board, and 3 are elected by the eligible
140136 electors of one of 3 director districts at the November 2026
141137 district election for terms beginning January 1, 2027.
142138 ! 2 voting directors who represent the district at large, satisfy
143139 certain criteria, and are appointed by the governor and
144140 confirmed by the senate. Of the first directors appointed by
145141 the governor, one director is the director who served the
146142 first 2 years of the director's term on the transitional board,
147143 and one director is appointed by the governor by January 1,
148144 2027, for a term beginning on January 1, 2027.
149145 ! The executive director of the department or the director's
150146 designee, who is a nonvoting ex officio director; and
151147 ! 2 nonvoting directors who represent the district at large,
152148 satisfy certain criteria, and are appointed by DRCOG. Of
153149 the directors appointed by DRCOG, one director is the
154150 director who served the first 2 years of the director's term
155151 on the transitional board and one director is appointed by
156152 DRCOG by January 1, 2027, for a term beginning on
157153 January 1, 2027.
158154 Section 6 also requires the board, in cooperation with district staff
159155 and with community input, to develop an onboarding program for
160156 incoming directors and requires each incoming director to complete the
161157 onboarding program.
162158 District elections. Section 7 specifies that the last district election
163159 held pursuant to current law, where directors were elected by the eligible
164160 electors in one of 15 director districts, was the district election in
165161 November 2022.
166162 Section 8 specifies election procedures for the new board. Of the
167163 5 elected directors, 2 directors, who are first elected at the November
168164 2024 district election, must reside in the district but may reside anywhere
169165 in the district and 3 directors, who are first elected at the November 2026
170166 district election, must reside in and be elected by the eligible electors who
171167 reside in one of 3 new director districts.
172168 Based on information from the 2020 federal decennial census,
173169 section 8 requires the director of research of the legislative council, with
174170 the assistance of the director of the office of legislative legal services, to
175171 apportion the population of the district into 3 compact and contiguous

177173 -4- director districts so that the 3 directors who are required to live in and be
178174 elected by the eligible electors in a particular director district will
179175 represent, to the extent practicable, a director district that is equal in
180176 population to the other 2 director districts. The director of research of the
181177 legislative council must complete the apportionment by August 31, 2025,
182178 and submit the recommended apportionment to the Colorado supreme
183179 court. The Colorado supreme court is required to amend or approve the
184180 recommended apportionment by October 31, 2025. The director of
185181 research of the legislative council, with the assistance of the office of
186182 legislative legal services, is required to reapportion the district after the
187183 2030 federal decennial census and after each federal decennial census
188184 thereafter.
189185 Section 8 also specifies that:
190186 ! The regular district election is held jointly with the state
191187 general election in every even-numbered year;
192188 ! The district is required to use instant runoff voting for
193189 district elections;
194190 ! The regular term of office of elected directors is 4 years;
195191 ! Nominations for the election of directors for the
196192 transitional board and the new board are made by petition
197193 in accordance with the general election laws of the state
198194 and signed by at least 250 eligible electors residing within
199195 the district; and
200196 ! A write-in candidate for director is not allowed.
201197 Additional modifications to statutes governing the board. In
202198 addition, the bill makes the following changes in connection with the
203199 expiration of the current board and the creation of the transitional board
204200 and the new board:
205201 ! Section 1 modifies the definition of "director district" as
206202 applicable to the current board, the transitional board, and
207203 the new board;
208204 ! Section 9 specifies that a vacancy caused on or after
209205 January 1, 2025, by a director elected at the November
210206 2022 district election, will not be filled. Section 10
211207 specifies that a vacancy caused by an elected director of the
212208 transitional board or the new board is filled by appointment
213209 by the governor and that a vacancy of an appointed member
214210 of the transitional board or the new board is filled by the
215211 appointing authority.
216212 ! Section 11 specifies that any action of the transitional
217213 board or the new board requires a majority vote by the
218214 directors entitled to vote who are present and voting; and
219215 ! Section 12 specifies that the annual compensation for
220216 directors of the transitional board and new board is an
221217 amount equal to 20% of the salary paid to a county judge;

223219 -5- except that any director of the new board that is a full-time
224220 state or local government official or a full-time state or
225221 local government employee serves as a director without
226222 additional compensation.
227223 10-year strategic plan. By September 1, 2026, section 13 requires
228224 the current board to develop and submit to the general assembly a 10-year
229225 strategic plan that addresses the district's plans and strategies to increase
230226 ridership, improve transparency, use district-owned land to prioritize
231227 certain types of development, and update parking policies to achieve
232228 specified goals; support state and regional climate, housing, and
233229 transportation goals; and identify funding opportunities to expand transit
234230 and improve system efficiency and equity.
235231 In addition, the current board is required to continue working to
236232 implement the recommendations of the 2021 "RTD Accountability
237233 Committee Final Report" created by DRCOG and the 2020 performance
238234 audit of the district and to report its progress to specified entities by
239235 December 31, 2025.
240236 Opportunities to increase ridership. Section 14 requires the
241237 district to pursue and take advantage of opportunities to increase and
242238 build ridership by working with entities that are hosting special events to
243239 facilitate increased ridership to and from the events; working with entities
244240 to facilitate increased ridership among youth; considering
245241 recommendations and requests for changes in service routes or schedules
246242 that would result in increased ridership; and identifying land use policies,
247243 strategies, and financial tools to enable the development of affordable
248244 housing and dense, walkable, mixed-use communities near transit stations
249245 and routes.
250246 District budget and planning. Section 15 requires the district to
251247 make its annual budget and other specified budget information available
252248 to the public on its website in a format that is easy to access, understand,
253249 and navigate.
254250 Section 15 also requires the district to create, maintain, and
255251 regularly update on its website information regarding the district's
256252 financial plan that includes specified information about district capital
257253 projects and to create 3 public accountability dashboards, the first of
258254 which provides financial information regarding each district capital
259255 project, the second of which shows ridership by route and reliability of
260256 service, and the third of which shows specified district workforce
261257 statistics.
262258 Fair market value for use of district transfer facilities. Current
263259 law requires that a person using any portion of a transfer facility for the
264260 provision of retail or commercial goods or services or for the provision
265261 of residential uses pay rent at fair market value. Section 16 repeals the
266262 requirement that a person pay rent at fair market value for such use of a
267263 transfer facility.

269265 -6- Mass transit bus driver training program. Section 17 requires
270266 the department to establish a mass transit bus driver training program to
271267 assist in the development and placement of public mass transit bus
272268 operators for department-sponsored mass transit services and for other
273269 public mass transit operators.
274270 Coordination between transit providers and metropolitan
275271 planning organizations. Section 18 requires a transportation provider to:
276272 ! Submit its proposed fixed-route transit service plans to the
277273 metropolitan planning organization (MPO) in which it is
278274 located for its review and input;
279275 ! Coordinate with the MPO regarding the implementation of
280276 fixed-route transit service plans;
281277 ! Ensure that the transit provider's service decisions are
282278 consistent with the MPO's regional transportation plan;
283279 ! Coordinate transit and land use decisions to ensure that
284280 transit services will be provided to new and existing
285281 transit-oriented communities; and
286282 ! Acknowledge established transit centers and provide a
287283 preference for transit centers when determining transit
288284 services and routes.
289285 Instant runoff voting for district elections. Sections 19, 20, and
290286 21 modify the "Uniform Election Code of 1992" to implement instant
291287 runoff voting for district elections.
292288 Money transferred to the department in connection with the
293289 Burnham Yard rail property. On July 1, 2022, the state treasurer
294290 transferred $6,500,000 from the general fund to the state highway fund
295291 for an environmental study on relocating the consolidated main rail line
296292 away from interstate highway 25 in connection with the development of
297293 the Burnham Yard rail property. Section 22 authorizes the department to
298294 instead use the money for site preparation, site enhancements, planning,
299295 and facilitating a track alignment that preserves buildable land while
300296 promoting transit and rail capacity and increasing safety in connection
301297 with the development of the Burnham Yard rail property.

796792 based on an assumption that the council will require an additional 0.312

799795 SECTION 12. Safety clause. The general assembly finds,15
800796 determines, and declares that this act is necessary for the immediate16
801797 preservation of the public peace, health, or safety or for appropriations for17
