These changes include extending programs and providing roll-forward spending authority to state agencies, as well as the “recapture” of previously allocated ARPA funds that remain unspent. Appropriation Summary: The bill makes numerous adjustments to appropriations and state agency spending authority. See State Appropriations section. Page 2 April 25, 2024 HB 24-1465 Summary of Legislation The bill makes changes to programs and appropriations originally funded with money received by the state from the federal Coronavirus State Fiscal Recovery Fund pursuant to the American Rescue Plan Act of 2021 (ARPA money). These changes include extending programs and providing roll-forward spending authority, as well as the “recapture” of previously allocated ARPA funds that remain unspent. The bill works in tandem with House Bill 24-1466. Additional detail on these bills can be found in this Joint Budget Committee Staff memo. Family and Medical Leave Insurance Fund—CDLE. The bill transfers $1.1 million of ARPA money from the Family and Medical Leave Insurance Fund (FAMLI Fund) to the American Rescue Plan Act of 2021 Cash Fund (ARPA Cash Fund), transfers $400,000 from the General Fund to the FAMLI Fund as an advance payment of premiums for state employee coverage that the state is required to pay under the family and medical leave insurance program, and clarifies the recipient funds (funds originating from ARPA funds to the ARPA Cash Fund and funds originating from the General Fund to the General Fund) for transfers from the FAMLI Fund required by current law. Information Technology Cash Fund—Judicial Department. The bill extends the deadline to spend ARPA money from the Judicial Department Information Technology Cash Fund from June 30, 2025, to December 31, 2026. Pretrial Diversion Programs—Judicial Department. The bill extends the deadline for the Judicial Department to spend ARPA money for pretrial diversion programs from June 30, 2024, to December 31, 2026. Finish What You Started—Higher Education. The bill makes changes to a program operated by the Colorado Opportunity Scholarship Initiative which supports students who enrolled in higher education institutions but did not finish their academic program, commonly known as the Finish What You Started program, to continue fund availability in FY 2024-25 and FY 2025-26 to support ongoing program participants, as detailed in the bill. Affordable Housing. The bill transfers $70,582 of ARPA money allocated for affordable housing projects from the Affordable Housing and Home Ownership Cash Fund to the ARPA Cash Fund. Recruitment and Reengagement of Health Care Workers—CDPHE. The bill reduces the required FY 2022-23 appropriation to the Department of Public Health and Environment (CDPHE) from the Economic Recovery and Relief Cash Fund for recruitment and re-engagement of workers in the health care profession from $10 million to $6.12 million. Practice-based Health Education Grant Program—CDPHE. The bill extends the deadline for CDPHE to spend ARPA money for the Practice-based Health Education Grant Program from June 30, 2025, to December 31, 2026. Rural Provider Access and Affordability Stimulus Grant Program. The bill changes the date that money from the Rural Provider Access and Affordability Fund, which is used for the Rural Provider Access and Affordability Stimulus Grant Program, reverts to the Economic Recovery and Relief Cash Fund from July 1, 2024, to December 31, 2024. Page 3 April 25, 2024 HB 24-1465 Behavioral Health-care Provider Workforce. The bill extends the repeal date of the statute requiring the Behavioral Health Administration (BHA) to take certain actions related to the behavioral health care provider workforce from September 1, 2024, to July 1, 2027, and continues required reports through the new repeal date. State Transfers The bill makes the following transfers in FY 2023-24: FAMLI $400,000 from the General Fund to the FAMLI Fund on June 24, 2024; and $1,100,000 from the FAMLI Fund to the ARPA Cash Fund on June 30, 2024. Affordable Housing $70,582 from the Affordable Housing and Home Ownership Cash Fund to the ARPA Cash Fund on June 30, 2024 State Domestic Violence and Sexual Assault Services $495,000 from the State Domestic Violence and Sexual Assault Services Fund to Behavioral and Mental Health Cash Fund on June 18, 2024.
