Joint Budget Committee. The bill makes changes to programs funded with money the state received from the federal coronavirus state fiscal recovery fund (ARPA money). Transfers $1.1 million of ARPA money from the family and medical leave insurance fund (FAMLI fund) to the "American Rescue Plan Act of 2021" cash fund, transfers $400,000 from the general fund to the FAMLI fund as an advance payment of premiums for state employee coverage that the state is required to pay under the family and medical leave insurance program, and clarifies the recipient funds for transfers from the FAMLI fund required by current law; ! Extends the deadline to spend ARPA money from the judicial department information technology cash fund from the end of the 2024-25 state fiscal year to December 31, 2026; ! Extends the deadline for the judicial department to spend ARPA money for pretrial diversion programs from the end of the 2023-24 state fiscal year to December 31, 2026; ! Makes changes to the program to allocate money to institutions to support students who enrolled in higher education institutions but did not finish their academic program, commonly known as "Finish What You Started", to provide funds in the 2024-25 and 2025-26 state fiscal years to continue to support ongoing "Finish What You Started" program participants; ! Transfers $70,581.99 of ARPA money allocated for affordable housing projects from the affordable housing and home ownership cash fund to the "American Rescue Plan Act of 2021" cash fund; ! Reduces the required appropriation to the department of public health and environment from the economic recovery and relief cash fund for recruitment and re-engagement of workers in the health-care profession from $10 million to $6.12 million; ! Extends the deadline for the department of public health and environment to spend ARPA money for the practice-based health education grant program from the end of the 2024-25 state fiscal year to December 31, 2026; ! Changes the date that money from the rural provider access and affordability fund, which is used for the rural provider access and affordability stimulus grant program, reverts to the general fund from July 1, 2024, to December 31, 2024; ! Transfers $495,000 of ARPA money allocated for domestic violence, sexual assault, or culturally specific programs from the state domestic violence and sexual assault services fund to the behavioral and mental health cash fund; and ! Extends the repeal date of the statute requiring the 1465 -2- behavioral health administration to take certain actions related to the behavioral health-care provider workforce from September 1, 2024, to July 1, 2027, and continues required reports through the new repeal date. The bill makes changes to appropriations programs funded with ARPA money, including adjusting appropriated amounts and granting roll-forward spending authority. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. In Colorado Revised Statutes, 8-13.3-518, amend2 (4)(d)(III); and add (4)(a.5) as follows:3 8-13.3-518. Family and medical leave insurance fund -4 establishment and investment - repeal. (4) (a.5) O N JUNE 24, 2024, THE5 STATE TREASURER SHALL TRANSFER FOUR HUNDRED THOUSAND DOLLARS6 FROM THE GENERAL FUND TO THE FUND . THE MONEY IS AN ADVANCE7 PAYMENT OF PREMIUMS FOR STATE EMPLOYEE COVERAGE THAT THE STATE8 IS REQUIRED TO PAY UNDER THE FAMILY AND MEDICAL LEAVE INSURANCE9 PROGRAM ESTABLISHED IN SECTION 8-13.3-516 AND IS NOT A GRANT FOR10 PURPOSES OF SECTION 20 (2)(d) OF ARTICLE X OF THE STATE11 CONSTITUTION OR AS DEFINED IN SECTION 24-77-102 (7).12 (d) (III) (A) O N JUNE 30, 2024, THE STATE TREASURER SHALL13 TRANSFER ONE MILLION ONE HUNDRED THOUSAND DOLLARS FROM THE14 FUND TO THE "AMERICAN RESCUE PLAN ACT OF 2021" CASH FUND15 CREATED IN SECTION 24-75-226. THIS AMOUNT IS OF THE MONEY THAT16 ORIGINATED FROM THE MONEY THE STATE RECEIVED FROM THE FEDERAL17 CORONAVIRUS STATE FISCAL RECOVERY FUND THAT WAS TRANSFERRED TO18 THE FUND FROM THE REVENUE LOSS RESTORATION CASH FUND PURSUANT19 TO SUBSECTION (4)(a) OF THIS SECTION.20 (B) Notwithstanding any provision of this section to the contrary,21 on or as soon as possible after the date the state controller publishes the22 1465-3- comprehensive annual financial report of the state for state fiscal year1 2023-24, the state treasurer shall transfer any remaining amount of the2 fifty-seven million dollars transferred to the fund from the revenue loss3 restoration cash fund pursuant to subsection (4)(a) of this section, in4 addition to the thirty-five million dollars to be transferred pursuant to5 subsection (4)(d)(II) of this section, back to the revenue loss restoration6 cash fund TO THE "AMERICAN RESCUE PLAN ACT OF 2021" CASH FUND7 CREATED IN SECTION 24-75-226 OR TO THE GENERAL FUND, AS REQUIRED8 IN THIS SUBSECTION (4)(d)(III)(B), as repayment of the unexpended9 amount of the advance payment of premiums for state employee coverage10 made by the state pursuant to subsection (4)(a) of this section. T HE STATE11 TREASURER SHALL TRANSFER MONEY PURSUANT TO THIS SUBSECTION12 (4)(d)(III)(B) AS FOLLOWS: THE STATE TREASURER SHALL TRANSFER13 MONEY THAT ORIGINATED FROM THE MONEY THE STATE RECEIVED FROM14 THE FEDERAL CORONAVIRUS STATE FISCAL RECOVERY FUND TO THE15 "A MERICAN RESCUE PLAN ACT OF 2021" CASH FUND CREATED IN SECTION16 24-75-226 AND SHALL TRANSFER MONEY THAT ORIGINATED FROM THE17 GENERAL FUND TO THE GENERAL FUND .18 SECTION 2. In Colorado Revised Statutes, 13-32-114, amend19 (4) as follows:20 13-32-114. Judicial department information technology cash21 fund - creation - uses. (4) In addition to the money deposited in the fund22 pursuant to subsection (1) of this section, the fund consists of money23 transferred to the fund from the revenue loss restoration cash fund24 pursuant to section 24-75-227 (3.5). Such transferred Money25 TRANSFERRED TO THE FUND FROM THE REVENUE LOSS RESTORATION CASH26 FUND is subject to annual appropriation by the general assembly to the27 1465 -4- judicial department for information technology infrastructure upgrades1 from the 2022-23 fiscal year through the 2024-25 fiscal year DECEMBER2 31, 2026; except that all such transferred money THAT ORIGINATED FROM3 MONEY THE STATE RECEIVED FROM THE FEDERAL CORONAVIRUS STATE4 FISCAL RECOVERY FUND must be expended or encumbered OBLIGATED by5 the judicial department prior to December 31, 2024.6 SECTION 3. In Colorado Revised Statutes, 18-1.3-101, amend7 (11) as follows:8 18-1.3-101. Pretrial diversion - appropriation - repeal.9 (11) (a) For the 2022-23 state fiscal year, the general assembly shall10 appropriate four million dollars from the behavioral and mental health11 cash fund created in section 24-75-230 to the judicial department for12 pretrial diversion programs. Any unexpended or unencumbered money13 appropriated pursuant to this subsection (11) remains available for14 expenditure UNTIL DECEMBER 31, 2026, for the same purpose in the 15 2023-24 state fiscal year without further appropriation AND THE16 DEPARTMENT SHALL OBLIGATE AND SPEND THE MONEY IN ACCORDANCE17 WITH SECTION 24-75-226 (4)(d). The judicial department may use up to18 five percent of the money appropriated pursuant to this section for19 administrative expenses. The judicial department shall allocate one20 million eight hundred thousand dollars of the money appropriated21 pursuant to this subsection (11) to recipients that provide diversion for22 individuals with behavioral health disorders.23 (b) This subsection (11) is repealed, effective July 1, 2024 JULY24 1, 2027.25 SECTION 4. In Colorado Revised Statutes, 23-3.3-1006, amend26 (2), (3)(a) introductory portion, and (4)(a) introductory portion; and add27 1465 -5- (1)(a.5), (1)(b.5), and (6.5) as follows:1 23-3.3-1006. Colorado opportunity scholarship initiative -2 federal money - institutional allocations - purposes - reporting - rules3 - definitions - repeal. (1) As used in this section, unless the context4 otherwise requires:5 (a.5) "O NGOING PROGRAM PARTICIPANT " MEANS AN ELIGIBLE6 STUDENT WHO PARTICIPATED IN THE PROGRAM DURING THE 2021-22,7 2022-23, OR 2023-24 STATE FISCAL YEAR WHO DID NOT COMPLETE THE8 STUDENT'S ACADEMIC PROGRAM, OR WHO WAS RECRUITED TO PARTICIPATE9 IN THE PROGRAM DURING THE 2023-24 STATE FISCAL YEAR, WHO AN10 INSTITUTION EXPECTS TO PARTICIPATE IN THE PROGRAM IN THE 2024-2511 STATE FISCAL YEAR AND, AS APPLICABLE, AN ELIGIBLE STUDENT WHO12 PARTICIPATED IN THE PROGRAM DURING THE 2024-25 STATE FISCAL YEAR13 WHO AN INSTITUTION EXPECTS TO PARTICIPATE IN THE PROGRAM IN THE14 2025-26 STATE FISCAL YEAR.15 (b.5) "P ROGRAM" MEANS THE PROGRAM TO ALLOCATE MONEY TO16 INSTITUTIONS TO SUPPORT ELIGIBLE STUDENTS THAT IS CREATED IN THIS17 SECTION AND IS COMMONLY KNOWN AS "FINISH WHAT YOU STARTED".18 (2) As soon as practicable after June 29, 2021, the board shall19 publish a request for proposals that allocates the money appropriated to20 the fund pursuant to section 23-3.3-1005 (6) to the public institutions of21 higher education as provided in subsection (3) of this section FOR THE22 2021-22 THROUGH 2023-24 ACADEMIC YEARS. Each institution may23 receive up to one hundred percent of its allocation over two academic24 years beginning in the 2021-22 academic year by submitting a student25 assistance plan to the board as provided in subsection (4) of this section26 to use the money to support eligible students directly through27 1465 -6- scholarships, financial assistance for the cost of attendance, and other1 direct student financial incentives or assistance. The plan must also2 include indirect support for eligible students through student support3 services. The goal of each institution's student assistance plan must be to4 increase eligible student enrollment, persistence, and completion and, for5 institutions other than area technical colleges, reduce student debt.6 (3) (a) The board shall allocate the money appropriated to the fund7 pursuant to section 23-3.3-1005 (6) to each public institution of higher8 education FOR THE 2021-22 THROUGH 2023-24 ACADEMIC YEARS as9 follows:10 (4) (a) To receive a distribution of the money allocated pursuant11 to subsection (3) of this section FOR THE 2021-22 THROUGH 2023-2412 ACADEMIC YEARS, a public institution of higher education must submit to13 the board a student assistance plan describing the institution's intended14 use of the money to support eligible students. Each plan must be15 student-centered and, at a minimum, must specify:16 (6.5) (a) F OR THE 2024-25 AND 2025-26 ACADEMIC YEARS, THE17 BOARD SHALL ALLOCATE PROGRAM MONEY , INCLUDING MONEY18 APPROPRIATED TO THE FUND PURSUANT TO SECTION 23-3.3-1005 (6) AND19 NEED-BASED GRANT MONEY AS DESCRIBED IN SUBSECTION (6.5)(b) OF THIS20 SECTION, TO EACH PUBLIC INSTITUTION OF HIGHER EDUCATION AS21 NECESSARY, AS DETERMINED BY THE BOARD , TO CONTINUE TO SUPPORT22 ONGOING PROGRAM PARTICIPANTS THROUGH THE COMPLETION OF THE23 PARTICIPANTS' ACADEMIC PROGRAM.24 (b) I N ORDER TO SUPPORT ONGOING PROGRAM PARTICIPANTS25 THROUGH THE COMPLETION OF THE PARTICIPANTS ' ACADEMIC PROGRAM,26 THE DEPARTMENT SHALL USE MONEY APPROPRIATED FOR NEED -BASED27 1465 -7- GRANTS FOR THE PROGRAM . THROUGH JUNE 30, 2026, THE DEPARTMENT1 MAY USE UP TO FOUR MILLION FIVE HUNDRED THOUSAND DOLLARS OF2 MONEY APPROPRIATED FOR NEED -BASED GRANTS FOR THE PROGRAM .3 (c) (I) O N OR BEFORE MAY 31, 2024, AN INSTITUTION THAT4 RECEIVED AN ALLOCATION PURSUANT TO THIS SECTION AND THAT WILL5 NOT HAVE EXPENDED ITS ALLOCATION BY THE END OF THE 2023-24 STATE6 FISCAL YEAR SHALL INFORM THE BOARD WHETHER THE INSTITUTION7 EXPECTS CURRENT PROGRAM PARTICIPANTS AT THE INSTITUTION TO8 PARTICIPATE IN THE PROGRAM DURING THE 2024-25 STATE FISCAL YEAR,9 AND, IF SO, PROVIDE THE INSTITUTION 'S ESTIMATE OF THE COSTS10 ASSOCIATED WITH PROVIDING SCHOLARSHIPS AND SUPPORT SERVICES TO11 ONGOING PROGRAM PARTICIPANTS IN THE 2024-25 STATE FISCAL YEAR12 AND, IF APPLICABLE, THE 2025-26 STATE FISCAL YEAR.13 (II) F OR THE 2024-25 STATE FISCAL YEAR, THE BOARD SHALL14 ALLOCATE PROGRAM MONEY AS NECESSARY , AS DETERMINED BY THE15 BOARD, TO EACH INSTITUTION THAT EXPECTS TO ENROLL ONGOING16 PROGRAM PARTICIPANTS DURING THE 2024-25 STATE FISCAL YEAR TO17 SUPPORT ONGOING PROGRAM PARTICIPANTS DIRECTLY THROUGH18 SCHOLARSHIPS, FINANCIAL ASSISTANCE FOR THE COST OF ATTE NDANCE ,19 AND OTHER DIRECT STUDENT FINANCIAL INCENTIVES OR ASSISTANCE AND20 TO PROVIDE INDIRECT SUPPORT FOR ONGOING PROGRAM PARTICIPANTS21 THROUGH STUDENT SUPPORT SERVICES IN THE SAME MANNER AS DURING22 PRIOR ACADEMIC YEARS.23 (d) (I) O N OR BEFORE MAY 31, 2025, AN INSTITUTION THAT24 RECEIVED AN ALLOCATION PURSUANT TO THIS SECTION DURING THE25 2024-25 STATE FISCAL YEAR SHALL INFORM THE BOARD WHETHER THE26 INSTITUTION EXPECTS CURRENT PROGRAM PARTICIPANTS AT THE27 1465 -8- INSTITUTION TO PARTICIPATE IN THE PROGRAM DURING THE 2025-261 STATE FISCAL YEAR, AND IF SO, PROVIDE THE INSTITUTION'S ESTIMATE OF2 THE COSTS ASSOCIATED WITH PROVIDING SCHOLARSHIPS AND SUPPORT3 SERVICES TO ONGOING PROGRAM PARTICIPANTS IN THE 2025-26 STATE4 FISCAL YEAR.5 (II) F OR THE 2025-26 STATE FISCAL YEAR, THE BOARD SHALL6 ALLOCATE PROGRAM MONEY AS NECESSARY , AS DETERMINED BY THE7 BOARD, TO EACH INSTITUTION THAT EXPECTS TO ENROLL ONGOING8 PROGRAM PARTICIPANTS DURING THE 2025-26 STATE FISCAL YEAR TO9 SUPPORT ONGOING PROGRAM PARTICIPANTS DIRECTLY THROUGH10 SCHOLARSHIPS, FINANCIAL ASSISTANCE FOR THE COST OF ATTENDANCE ,11 AND OTHER DIRECT STUDENT FINANCIAL INCENTIVES OR ASSISTANCE AND12 TO PROVIDE INDIRECT SUPPORT FOR ONGOING PROGRAM PARTICIPANTS13 THROUGH STUDENT SUPPORT SERVICES IN THE SAME MANNER AS DURING14 PRIOR ACADEMIC YEARS.15 (e) U PON REQUEST OF THE BOARD, AN INSTITUTION SHALL RETURN16 TO THE BOARD ANY UNSPENT MONEY IT RECEIVED PURSUANT TO THIS17 SECTION. THE BOARD MAY REALLOCATE UNSPENT MONEY FROM THE18 APPROPRIATION MADE FOR THE PROGRAM , EXCLUDING FUNDING FROM19 NEED-BASED GRANTS AUTHORIZED PURSUANT TO SUBSECTION (6.5)(b) OF20 THIS SECTION, TO INSTITUTIONS THAT CAN SUPPORT ADDITIONAL ELIGIBLE21 ONGOING PROGRAM PARTICIPANTS .22 (f) N OTHING IN THIS SUBSECTION (6.5) OR ANY OTHER PROVISION23 OF THIS SECTION REQUIRES THE DEPARTMENT OR THE BOARD TO PROVIDE24 MORE MONEY TO AN INSTITUTION THAN THE AMOUNT IN THE INSTITUTION 'S25 ORIGINAL CONTRACT FOR THE PROGRAM . AN INSTITUTION THAT HAS26 EXHAUSTED ITS PROGRAM ALLOCATION , INCLUDING ANY REALLOCATION,27 1465 -9- SHALL SUPPORT AN ONGOING PROGRAM PARTICIPANT WHO QUALIFIES FOR1 NEED-BASED FINANCIAL AID THROUGH COMPLETION OF THE ONGOING2 PROGRAM PARTICIPANT'S ACADEMIC PROGRAM USING STATE , FEDERAL,3 AND INSTITUTIONAL FINANCIAL AID.4 SECTION 5. In Colorado Revised Statutes, 23-3.3-103, add (21)5 as follows:6 23-3.3-103. Annual appropriations - repeal. (21) (a) T HE7 PROVISIONS OF SUBSECTION (1) OF THIS SECTION CONCERNING8 APPROPRIATIONS FOR STUDENT FINANCIAL ASSISTANCE PURSUANT TO THIS9 ARTICLE 3.3 DO NOT APPLY TO APPROPRIATIONS MADE FOR ALLOCATION10 TO PUBLIC INSTITUTIONS OF HIGHER EDUCATION TO SUPPORT ELIGIBLE11 STUDENTS DESCRIBED IN SECTION 23-3.3-1006.12 (b) T HIS SUBSECTION (21) IS REPEALED, EFFECTIVE JULY 1, 2027.13 SECTION 6. In Colorado Revised Statutes, 24-75-229, add14 (4)(c) as follows:15 24-75-229. Affordable housing and home ownership cash fund16 - creation - allowable uses - task force - legislative declaration -17 definitions - repeal. (4) (c) O N JUNE 30, 2024, THE STATE TREASURER18 SHALL TRANSFER FROM THE FUND TO THE "AMERICAN RESCUE PLAN ACT19 OF 2021" CASH FUND CREATED IN SECTION 24-75-226, SEVENTY20 THOUSAND FIVE HUNDRED EIGHTY -ONE DOLLARS AND NINETY-NINE CENTS21 THAT ORIGINATED FROM MONEY THE STATE RECEIVED FROM THE FEDERAL22 CORONAVIRUS STATE FISCAL RECOVERY FUND .23 SECTION 7. In Colorado Revised Statutes, 25-1.5-102, amend24 (1)(e) as follows:25 25-1.5-102. Epidemic and communicable diseases - powers and26 duties of department - rules - definitions. (1) The department has, in27 1465 -10- addition to all other powers and duties imposed upon it by law, the1 powers and duties provided in this section as follows:2 (e) For fiscal year 2022-23, the general assembly shall appropriate3 ten million SIX MILLION ONE HUNDRED TWENTY THOUSAND dollars from4 the economic recovery and relief cash fund created in section 24-75-2285 to the department. The department shall use this appropriation for6 recruitment and re-engagement efforts of workers in the health-care7 profession with current or expired licenses and staffing. Any money8 remaining at the end of the 2022-23 state fiscal year from this9 appropriation is further appropriated to the department for the purposes10 of this section. Any money that is not expended or obligated by December11 30, 2024, reverts to the "American Rescue Plan Act of 2021" cash fund12 created in section 24-75-226 (2) THE DEPARTMENT SHALL OBLIGATE AND13 SPEND THE MONEY RECEIVED PURSUANT TO THIS SUBSECTION (1)(e) in14 accordance with section 24-75-226 (4)(d). Any money obligated by15 December 30, 2024, must be expended by December 31, 2026.16 SECTION 8. In Colorado Revised Statutes, 25-1.5-407, amend17 (5)(b); and repeal (5)(a) as follows:18 25-1.5-407. Practice-based health education grant program -19 creation - primary care office to administer. (5) The general assembly20 shall appropriate twenty million dollars from the economic recovery and21 relief cash fund created in section 24-75-228 to the department to22 implement the grant program. Any unexpended money remaining at the23 end of the 2022-23 state fiscal year from this appropriation:24 (a) Does not revert to the general fund or any other fund;25 (b) May be used by the department in the 2023-24 or 2024-2526 state fiscal year REMAINS AVAILABLE FOR EXPENDITURE UNTIL DECEMBER27 1465 -11- 31, 2026, without further appropriation; and1 SECTION 9. In Colorado Revised Statutes, 25.5-1-207, amend2 (6)(c) as follows:3 25.5-1-207. Rural provider access and affordability stimulus4 grant program - advisory committee - fund - reporting - rules -5 definitions - repeal. (6) Fund. (c) Except as otherwise required by this6 subsection (6)(c), all money not expended or encumbered, and all interest7 earned on the investment or deposit of money in the fund, must remain in8 the fund and shall not revert to the general fund or any other fund at the9 end of any fiscal year. The money in the fund is continuously10 appropriated to the state department for the purposes of this section. Any11 money in the fund not expended or encumbered by July 1 DECEMBER 31,12 2024, must revert to the economic recovery and relief cash fund created13 in section 24-75-228 (2)(a) REVERTS TO GENERAL FUND.14 SECTION 10. In Colorado Revised Statutes, 26-7.5-105, add15 (4)(c.7) as follows:16 26-7.5-105. Funding of domestic violence, sexual assault, or17 culturally specific programs - funding coalitions - state domestic18 violence and sexual assault services fund - appropriation - repeal.19 (4) (c.7) (I) O N JUNE 18, 2024, THE STATE TREASURER SHALL TRANSFER20 FROM THE FUND TO THE BEHAVIORAL AND MENTAL HEALTH CASH FUND ,21 CREATED IN SECTION 24-75-230, FOUR HUNDRED NINETY-FIVE THOUSAND22 DOLLARS THAT ORIGINATED FROM MONEY THE STATE RECEIVED FROM THE23 FEDERAL CORONAVIRUS STATE FISCAL RECOVERY FUND .24 (II) T HIS SUBSECTION (4)(c.7) IS REPEALED, EFFECTIVE JUNE 30,25 2025.26 SECTION 11. In Colorado Revised Statutes, 27-60-304, amend27 1465 -12- (1) and (2) as follows:1 27-60-304. Reports. (1) In 2023, and 2024, 2025, 2026, AND2 2027 the state department of human services shall include an overview of3 the BHA's progress toward addressing the behavioral health-care provider4 workforce shortage during the hearings held prior to the regular session5 of the general assembly under the "State Measurement for Accountable,6 Responsive, and Transparent (SMART) Government Act", part 2 of7 article 7 of title 2.8 (2) On or before January 1, 2023, and on or before EACH January9 1 2024, THEREAFTER the community college system shall submit a report10 to the BHA. At a minimum, the report must include a summary of the11 behavioral health career pathway and its implementation, including an12 accounting of how money was used to expand or support training,13 education, and certifications in the behavioral health career pathway to14 increase employment in the behavioral health sector.15 SECTION 12. In Colorado Revised Statutes, amend 27-60-30516 as follows:17 27-60-305. Repeal of part. This part 3 is repealed, effective18 September 1, 2024 JULY 1, 2027.19 SECTION 13. Appropriation to the department of higher20 education for the fiscal year beginning July 1, 2021. In Session Laws21 of Colorado 2021, amend section 2 (1) of chapter 318 (SB 21-232), as22 section 2 (1) was amended by chapter 10 (HB 22-1192), Session Laws of23 Colorado 2022, as follows:24 Section 2. Appropriation. (1) (b) For the 2021-22 state fiscal25 year, $13,050,000 $12,386,281 is appropriated to the department of26 higher education for use by the Colorado opportunity scholarship27 1465 -13- initiative advisory board. This appropriation is from the workers,1 employers, and workforce centers cash fund created in section 24-75-2312 (2)(a), C.R.S., and is of money the state received from the federal3 coronavirus state fiscal recovery fund. The advisory board may use this4 appropriation for the Colorado opportunity scholarship initiative's5 displaced workers grant. Any money appropriated in this section not6 expended prior to July 1, 2022, is further appropriated to the department7 of higher education for use by the advisory board for the 2022-23 and8 2023-24 state fiscal years for the same purpose.9 SECTION 14. Appropriation to the department of natural10 resources for the fiscal year beginning July 1, 2022. In Session Laws11 of Colorado 2022, amend section 3 (2) of chapter 211, (SB 22-028), as12 follows:13 Section 3. Appropriation. (2) For the 2022-23 state fiscal year,14 $60,000,000 is appropriated to the department of natural resources for use15 by the Colorado water conservation board. This appropriation is from16 reappropriated funds from the groundwater compact compliance and17 sustainability fund under subsection (1) of this section. To implement this18 act, the board may use this appropriation for compact compliance and19 groundwater resource sustainability and conservation pursuant to section20 37-60-134, C.R.S. Any money appropriated in this section not expended21 prior to July 1, 2023, is further appropriated to the board from July 1,22 2023, through December 30, 2024, DECEMBER 31, 2026, for the same23 purpose.24 SECTION 15. Appropriation to the department of education25 for the fiscal year beginning July 1, 2022. In Session Laws of Colorado26 2022, amend section 5 (1) and (2) of chapter 175, (SB 22-147), as27 1465 -14- follows:1 Section 5. Appropriation. (1) For the 2022-23 state fiscal year,2 $4,600,000 is appropriated to the department of higher education for use3 by the regents of the university of Colorado. This appropriation is from4 the behavioral and mental health cash fund created in section 24-75-2305 (2)(a), C.R.S., and is of money the state received from the federal6 coronavirus state fiscal recovery fund. To implement this act, the regents7 may use this appropriation for the Colorado pediatric psychiatry8 consultation and access program. Any money appropriated in this section9 not expended prior to July 1, 2023, is further appropriated to the regents10 from July 1, 2023, through December 30, 2024, DECEMBER 31, 2026, for11 the same purpose.12 (2) For the 2022-23 state fiscal year, $5,000,000 is appropriated13 to the department of education. This appropriation is from the behavioral14 and mental health cash fund created in section 24-75-230 (2)(a), C.R.S.,15 is of money the state received from the federal coronavirus state fiscal16 recovery fund, and is based on an assumption that the department will17 require an additional 0.4 FTE. To implement this act, the department may18 use this appropriation for the behavioral health care professionals19 matching grant program. Any money appropriated in this section not20 expended prior to July 1, 2023, is further appropriated to the department21 from July 1, 2023, through December 30, 2024, DECEMBER 31, 2026, for22 the same purpose.23 SECTION 16. Appropriation to the department of human24 services for the fiscal year beginning July 1, 2022. In Session Laws of25 Colorado 2022, amend section 3 of chapter 217, (SB 22-148), as follows:26 Section 3. Appropriation. For the 2022-23 state fiscal year,27 1465 -15- $5,000,000 is appropriated to the department of human services for use1 by the behavioral health administration. This appropriation is from the2 behavioral and mental health cash fund created in section 24-75-2303 (2)(a), C.R.S., and is of money the state received from the federal4 coronavirus state fiscal recovery fund. To implement this act, the5 administration may use this appropriation for the Colorado land-based6 tribe behavioral health services grant program. Any money appropriated7 in this section not expended prior to July 1, 2023, is further appropriated8 to the administration from July 1, 2023, through December 30, 2024,9 D ECEMBER, 31, 2026, for the same purpose.10 SECTION 17. Appropriation to the department of human11 services for the fiscal year beginning July 1, 2022. In Session Laws of12 Colorado 2022, amend section 3 of chapter 223, (SB 22-177), as follows:13 Section 3. Appropriation. For the 2022-23 state fiscal year,14 $12,200,000 is appropriated to the department of human services for use15 by the behavioral health administration. This appropriation is from the16 behavioral and mental health cash fund created in section 24-75-23017 (2)(a), C.R.S., and is of money the state received from the federal18 coronavirus state fiscal recovery fund. The administration may use this19 appropriation for care coordination infrastructure. Any money20 appropriated in this section not expended prior to July 1, 2023, is further21 appropriated to the administration from July 1, 2023, through December 22 30, 2024, DECEMBER 31, 2026, for the same purpose. These23 appropriations are based on the assumption that the administration will24 require 3.0 FTE in the 2022-23 state fiscal year and 3.0 FTE in the25 2023-24 state fiscal year to implement this act.26 SECTION 18. Appropriation to the department of human27 1465 -16- services for the fiscal year beginning July 1, 2022. In Session Laws of1 Colorado 2022, amend section 6 (1) introductory portion and (1)(d), and2 section 8 (1) introductory portion of chapter 452, (SB 22-181), as follows:3 Section 6. Appropriation. (1) For the 2022-23 state fiscal year,4 $36,806,984 $35,087,650 is appropriated to the department of human5 services for use by the behavioral health administration. This6 appropriation is from the behavioral and mental health cash fund created7 in section 24-75-230 (2)(a), C.R.S., and is of money the state received8 from the federal coronavirus state fiscal recovery fund. Any money9 appropriated in this section not expended prior to July 1, 2023, is further10 appropriated to the department from July 1, 2023, through December 30,11 2024, DECEMBER 31, 2026, for the same purpose. To implement this act,12 the administration may use this appropriation as follows:13 (d) $4,735,319 $3,015,985 for the behavioral health-care14 educational program as specified in section 27-60-302 (5), C.R.S.;15 Section 8. Appropriation. (1) For the 2022-23 state fiscal year,16 $15,193,018 is appropriated to the department of higher education. This17 appropriation is from the behavioral and mental health cash fund created18 in section 24-75-230 (2)(a), C.R.S., and is of money the state received19 from the federal coronavirus state fiscal recovery fund. Any money20 appropriated in this section not expended prior to July 1, 2023, is further21 appropriated to the department from July 1, 2023, through December 30,22 2024, DECEMBER 31, 2026, for the same purpose. To implement this act,23 the department may use this appropriation as follows:24 SECTION 19. Appropriation to the department of human25 services, the judicial department, the department of public safety,26 and the offices of the governor, lieutenant governor, and state27 1465 -17- planning and budgeting for the fiscal year beginning July 1, 2022. This appropriation is from the7 behavioral and mental health cash fund created in section 24-75-2308 (2)(a), C.R.S., and is of money that the state received from the federal9 coronavirus state fiscal recovery fund. Any money appropriated in this10 section not expended prior to July 1, 2023, is further appropriated to the11 department from July 1, 2023, through December 30, 2024, DECEMBER12 31, 2026, for the same purpose. To implement this act, the administration13 may use this appropriation as follows:14 (2) For the 2022-23 state fiscal year, $4,000,000 is appropriated15 to the judicial department. This appropriation is from the behavioral and16 mental health cash fund created in section 24-75-230 (2)(a), C.R.S., and17 is of money that the state received from the federal coronavirus state18 fiscal recovery fund. Any money appropriated in this section not19 expended prior to July 1, 2023, is further appropriated to the department20 from July 1, 2023, through December 30, 2024, DECEMBER 31, 2026, for21 the same purpose. To implement this act, the department may use this22 appropriation for adult district attorney pretrial diversion programs.23 (3) For the 2022-23 state fiscal year, $3,500,000 is appropriated24 to the department of public safety. This appropriation is from the25 behavioral and mental health cash fund created in section 24-75-23026 (2)(a), C.R.S., and is of money that the state received from the federal27 1465 -18- coronavirus state fiscal recovery fund. ANY MONEY APPROPRIATED IN THIS1 SECTION NOT EXPENDED PRIOR TO JULY 1, 2023, IS FURTHER2 APPROPRIATED TO THE DEPARTMENT FROM JULY 1, 2023, THROUGH3 D ECEMBER 31, 2026, FOR THE SAME PURPOSE. To implement this act, the4 department may use this appropriation as follows:5 (4) For the 2022-23 state fiscal year, $1,760,709 is appropriated6 to the office of the governor for use by the office of information7 technology. This appropriation is from reappropriated funds received8 from the department of public safety under subsection (3)(c) of this9 section. A NY MONEY APPROPRIATED IN THIS SECTION NOT EXPENDED10 PRIOR TO JULY 1, 2023, IS FURTHER APPROPRIATED TO THE OFFICE FROM11 J ULY 1, 2023, THROUGH DECEMBER 31, 2026, FOR THE SAME PURPOSE. To12 implement this act, the office may use this appropriation to provide13 information technology services for the department of public safety.14 SECTION 20. Appropriation to the department of local affairs15 for the fiscal year beginning July 1, 2022. In Session Laws of Colorado16 2022, amend section 4 (1) of chapter 288, (SB 22-211), as follows:17 Section 4. Appropriation. (1) For the 2022-23 state fiscal year,18 $45,000,000 is appropriated to the department of local affairs for use by19 the division of housing. This appropriation is from the economic recovery20 and relief cash fund created in section 24-75-228 (2)(a), C.R.S., is of21 money the state received from the federal coronavirus state fiscal22 recovery fund, and is based on an assumption that the division will23 require an additional 2.3 FTE. To implement this act, the division may24 use this appropriation for ridge view campus. Any money appropriated in25 this section not expended prior to July 1, 2023, is further appropriated to26 the division from July 1, 2023, through December 30, 2024, DECEMBER27 1465 -19- 31, 2026, for the same purpose.1 SECTION 21. Appropriation to the department of public2 health and environment for the fiscal year beginning July 1, 2022. (1) For the 2022-23 state fiscal year,6 $35,000,000 $31,120,000 is appropriated to the department of public7 health and environment. This appropriation is from the economic8 recovery and relief cash fund created in section 24-75-228 (2)(a), C.R.S.,9 and is of money the state received from the coronavirus state fiscal10 recovery fund. To implement this act, the department may use this11 appropriation as follows:12 (b) $10,000,000 $6,120,000 for use by disease control and public13 health response for immunization operating expenses; and14 SECTION 22. Appropriation to the department of higher15 education for the fiscal year beginning July 1, 2021. The24 department of higher education is responsible for the accounting related25 to this appropriation. To implement this act, the department may use this26 appropriation to implement section 23-3.3-1006, C.R.S.27 1465 -20- SECTION 23. Appropriation to the department of higher1 education for the fiscal year beginning July 1, 2022. In Session Laws2 of Colorado 2022, amend section 9 (2)(b) of chapter 239, (HB 22-1220),3 as follows:4 Section 9. Appropriation. Appropriation to the department of education9 for the fiscal year beginning July 1, 2022. The department may17 use this appropriation for the behavioral health care professional18 matching grant program. Any money appropriated in this section not19 expended prior to July 1, 2023, is further appropriated to the department20 from July 1, 2023, through December 30, 2024, DECEMBER 31, 2026, for21 the same purpose.22 (4) For the 2022-23 state fiscal year, $6,000,000 $5,545,370 is23 appropriated to the department of human services for use by the24 behavioral health administration. This appropriation is from the25 behavioral and mental health cash fund created in section 24-75-230,26 C.R.S., is of money the state received from the federal coronavirus state27 1465 -21- fiscal recovery fund, and is based on an assumption that the1 administration will require an additional 1.0 FTE. To implement this act,2 the administration may use this appropriation for the temporary youth3 mental health services program. Any money appropriated in this section4 not expended prior to July 1, 2023, is further appropriated to the5 administration from July 1, 2023, through June 30, 2024, for the same6 purpose.7 SECTION 25. Appropriation to the department of human8 services for the fiscal year beginning July 1, 2022. This appropriation is from the14 behavioral and mental health cash fund created in section 24-75-23015 (2)(a), C.R.S., and is of money the state received from the federal16 coronavirus state fiscal recovery fund. Any amount appropriated in this17 section not expended prior to July 1, 2023, is further appropriated to the18 administration from July 1, 2023, through December 30, 2024,19 D ECEMBER 31, 2026, for the same purpose. To implement this act, the20 administration may use this appropriation as follows:21 SECTION 26. Appropriation to the department of human22 services for the fiscal year beginning July 1, 2022. In Session Laws of23 Colorado 2022, amend section 7, section 8 (1) introductory portion,24 section 9, and section 10 of chapter 185, (HB 22-1283), as follows:25 Section 7. Appropriation. For the 2022-23 state fiscal year,26 $11,628,023 $3,828,023 is appropriated to the department of human27 1465 -22- services for use by the division of child welfare. This appropriation is1 from the behavioral and mental health cash fund created in section2 24-75-230 (2)(a), C.R.S., and is of money the state received from the3 federal coronavirus state fiscal recovery fund. The division may use this4 appropriation for respite and residential programs. Any money5 appropriated in this section not expended prior to July 1, 2023, is further6 appropriated to the division from July 1, 2023, through December 30,7 2024, for the same purpose. These appropriations are based on the8 assumption that the office will require 4.0 FTE in the 2022-23 state fiscal9 year and 4.0 FTE in the 2023-24 state fiscal year to implement the act. 10 Section 8. Appropriation. (1) For the 2022-23 state fiscal year,11 $7,500,000 is appropriated to the department of human services for use12 by the behavioral health administration. This appropriation is from the13 behavioral and mental health cash fund created in section 24-75-23014 (2)(a), C.R.S., and is of money the state received from the federal15 coronavirus state fiscal recovery fund. A NY MONEY APPROPRIATED IN16 SUBSECTION (1)(a) OF THIS SECTION THAT IS NOT EXPENDED PRIOR TO17 J ULY 1, 2023, IS FURTHER APPROPRIATED TO THE ADMINISTRATION FROM18 J ULY 1, 2023, THROUGH DECEMBER 31, 2026, FOR THE SAME PURPOSE.19 Any money appropriated in this section SUBSECTION (1)(b) OF THIS20 SECTION THAT IS not expended prior to July 1, 2023, is further21 appropriated to the administration from July 1, 2023, through December22 30, 2024, for the same purpose. To implement this act, the department23 may use this appropriation as follows:24 Section 9. Appropriation. For the 2022-23 state fiscal year,25 $539,926 is appropriated to the department of human services for use by26 the office of behavioral health. This appropriation is from the behavioral27 1465 -23- and mental health cash fund created in section 24-75-230 (2)(a), C.R.S.,1 and is of money the state received from the federal coronavirus state2 fiscal recovery fund. The office may use this appropriation for building3 maintenance costs associated with the youth neuro-psych facility at the4 Colorado mental health institute at Fort Logan established pursuant to5 section 27-94-107, C.R.S. Any money appropriated in this section not6 expended prior to July 1, 2023, is further appropriated to the7 administration from July 1, 2023, through December 30, 2024,8 D ECEMBER 31, 2026, for the same purpose.9 Section 10. Capital construction appropriation. For the 2022-2310 state fiscal year, $35,000,000 is appropriated to the department of human11 services. This appropriation is from the behavioral and mental health cash12 fund created in section 24-75-230 (2)(a), C.R.S., and is of money the state13 received from the federal coronavirus state fiscal recovery fund. To14 implement this act, the department may use this appropriation for capital15 construction related to the construction of a neuro-psych facility at the16 Colorado mental health institute at Fort Logan. Any money appropriated17 in this section not expended prior to July 1, 2023, is further appropriated18 to the administration from July 1, 2023, through December 30, 2024, 19 D ECEMBER 31, 2026, for the same purpose.20 SECTION 27. Appropriation to the department of human21 services for the fiscal year beginning July 1, 2022. In Session Laws of22 Colorado 2022, amend section 4 (1) introductory portion and (2), section23 5 (1), section 7, and section 8; and repeal section 6 of chapter 183, (HB24 22-1303), as follows:25 Section 4. Appropriation. (1) For the 2022-23 state fiscal year,26 $728,296 is appropriated to the department of human services for use by27 1465 -24- administration and finance. This appropriation is from the behavioral and1 mental health cash fund created in section 24-75-230 (2)(a), C.R.S., and2 is of money the state received from the federal coronavirus state fiscal3 recovery fund. Any money appropriated in this section not expended prior4 to July 1, 2023, is further appropriated to the department from July 1,5 2023, through December 30, 2024, DECEMBER 31, 2025, for the same6 purpose. To implement this act, the department may use this appropriation7 as follows:8 (2) For the 2022-23 state fiscal year, $9,992 is appropriated to the9 department of personnel for use by the division of capital assets. This10 appropriation is from reappropriated funds received from the department11 of human services under subsection (1)(c) of this section. To implement12 this act, the department of personnel may use this appropriation to13 provide vehicles to the department of human services. Any money14 appropriated in this section not expended prior to July 1, 2023, is further15 appropriated to the department from July 1, 2023, through December 30,16 2024, DECEMBER 31, 2025, for the same purpose.17 Section 5. Appropriation. (1) For the 2022-23 state fiscal year,18 $39,854,179 $13,745,437 is appropriated to the department of human19 services for use by the office of behavioral health. This appropriation is20 from the behavioral and mental health cash fund created in section21 24-75-230 (2)(a), C.R.S., and is of money the state received from the22 federal coronavirus state fiscal recovery fund. Any money appropriated23 in this section not expended prior to July 1, 2023, is further appropriated24 to the office from July 1, 2023, through December 30, 2024, DECEMBER25 31, 2025, for the same purpose. To implement this act, the department26 may use this appropriation as follows:27 1465 -25- (a) $2,559,676 for oversight costs related to mental health1 residential facilities, which amount is based on an assumption that the2 office will require 7.0 FTE in the 2022-23 state fiscal year and 7.0 FTE3 in the 2023-24 state fiscal year; AND4 (b) $3,809,582 for costs associated with mental health residential 5 facilities located in department-owned properties, which amount is based6 on an assumption that the office will require 14.8 FTE in the 2023-247 state fiscal year; and8 (c) (b) $33,484,921 $11,185,761 for contract beds in and the9 renovation of mental health residential facilities.10 Section 6. Appropriation. For the 2022-23 state fiscal year,11 $6,578,266 is appropriated to the department of human services for use12 by the office of behavioral health. This appropriation is from the13 behavioral and mental health cash fund created in section 24-75-23014 (2)(a), C.R.S., and is of money the state received from the federal15 coronavirus state fiscal recovery fund. The office may use this16 appropriation for costs associated with the operation of additional beds17 at the Colorado mental health institute at Fort Logan established pursuant18 to section 27-94-107, C.R.S. Any money appropriated in this section not19 expended prior to July 1, 2023, is further appropriated to the office from20 July 1, 2023, through December 30, 2024, for the same purpose. These21 appropriations are based on the assumption that the office will require an22 additional 59.2 FTE in the 2023-24 state fiscal year to implement this act.23 Section 7. Capital construction appropriation. For the 2022-2324 state fiscal year, $6,991,567 is appropriated to the department of human25 services. This appropriation is from the behavioral and mental health cash26 fund created in section 24-75-230 (2)(a), C.R.S. To implement this act,27 1465 -26- the department may use this appropriation for capital construction related1 to the renovation for additional inpatient beds at the Colorado mental2 health institute at Fort Logan. Any money appropriated in this section not3 expended prior to July 1, 2023, is further appropriated to the department4 from July 1, 2023, through December 30, 2024, DECEMBER 31, 2025, for5 the same purpose.6 Section 8. Capital construction appropriation. For the 2022-237 state fiscal year, $3,692,111 is appropriated to the department of human8 services. This appropriation is from the behavioral and mental health cash9 fund created in section 24-75-230 (2)(a), C.R.S. To implement this act,10 the department may use this appropriation for capital construction related11 to the renovation of three existing department properties to create mental12 health residential facilities pursuant to section 27-71-103 (1)(a), C.R.S.13 Any money appropriated in this section not expended prior to July 1,14 2023, is further appropriated to the department from July 1, 2023, through15 December 30, 2024, DECEMBER 31, 2025, for the same purpose.16 SECTION 28. Appropriation to the departments of human17 services and public health and environment for the fiscal year18 beginning July 1, 2022. In Session Laws of Colorado 2022, amend19 section 56 (1)(f) of chapter 225, (HB 22-1326), as follows:20 Section 56. Appropriation. (1) (f) $3,000,000 from the21 behavioral and mental health cash fund created in section 24-75-23022 (2)(a), C.R.S., for jail-based behavioral health services related to23 integrated behavioral health services. Any money appropriated in this24 subsection (1)(d) SUBSECTION (1)(f) not expended prior to July 1, 2023,25 is further appropriated to the administration from July 1, 2023, through26 December 30, 2024, DECEMBER 31, 2026, for the same purpose.27 1465 -27- SECTION 29. Appropriation to the department of local affairs1 for the fiscal year beginning July 1, 2022. In Session Laws of Colorado2 2022, amend section 2 of chapter 351, (HB 22-1356), as follows:3 Section 2. Appropriation. For the 2022-23 state fiscal year,4 $35,000,000 is appropriated to the department of local affairs for use by5 the division of local government. This appropriation is from the economic6 recovery and relief cash fund created in section 24-75-228 (2)(a), C.R.S.,7 is of money the state received from the federal coronavirus state fiscal8 recovery fund, and is based on an assumption that the division will9 require an additional 0.5 FTE. To implement this act, the division may10 use this appropriation for small community-based nonprofit infrastructure11 grants. Any money appropriated in this section not expended prior to July12 1, 2023, is further appropriated to the division from July 1, 2023, through13 December 30, 2024, DECEMBER 31, 2026, for the same purpose.14 SECTION 30. Appropriation to the department of natural15 resources for the fiscal year beginning July 1, 2022. In Session Laws16 of Colorado 2022, amend section 3 of chapter 306, (HB 22-1379), as17 follows:18 Section 3. Appropriation. For the 2022-23 state fiscal year,19 $15,000,000 is appropriated to the department of natural resources for use20 by the Colorado water conservation board. This appropriation is from the21 Colorado water conservation board construction fund created in section22 37-60-121 (1)(a), C.R.S.
