13-SECTION 1. In Colorado Revised Statutes, add 43-1-136 as
14-follows:

22+Transportation Legislation Review Committee. Statewide
23+transit pass exploratory committee. Section 1 of the bill creates the
24+statewide transit pass exploratory committee (committee) within the
25+department of transportation (department) to produce a viable proposal
26+for the creation, implementation, and administration of a statewide transit
27+pass. The committee is required to meet as necessary to produce a viable
28+proposal by July 1, 2026, with the goal of implementing a statewide
29+transit pass by January 1, 2028.

52+director of the department and is required to include representatives of a
53+diverse group of transit agencies throughout the state, a representative of
54+an entity or interest group involved in passenger rail systems, a
55+representative of an organization with a statewide perspective regarding
56+transportation, and 2 representatives of the department, one who is
57+knowledgeable about the department's inter-city regional bus service and
58+one who is knowledgeable about innovative mobility.
59+In conducting its work and in producing a viable proposal for the
60+creation, implementation, and administration of a statewide transit pass
61+the committee is required to consider:
62+! Various specified logistics of creating a statewide transit
63+pass;
64+! A method for determining the price of a statewide transit
65+pass;
66+! A structure for the sale of the statewide transit pass to
67+individuals and to employers for their employees;
68+! The services that will be offered to statewide transit pass
69+holders;
70+! The types of statewide transit passes that would be offered,
71+including different options for the duration of the pass to
72+accommodate Colorado residents and visitors to Colorado;
73+! Additional opportunities for collaboration across transit
74+agencies in the state to make it easier and more appealing
75+for people to use transit;
76+! The technology that would be necessary to monitor the use
77+of the statewide transit pass and track ridership across
78+transit agencies;
79+! Local, tribal, state, and federal laws, rules, or regulations
80+that need to be considered in connection with the creation
81+of a statewide transit pass;
82+! The best method for advertising and marketing a statewide
83+transit pass;
84+! The potential impacts that a statewide transit pass will have
85+on transit pass programs that are currently offered by transit
86+agencies;
87+! The potential impacts of section 20 of article X of the state
88+constitution to local governments in connection with
89+revenue generated by the sale of a statewide transit pass;
90+! A proposal for the structure and composition of a
91+permanent advisory board to oversee the creation,
92+implementation, and administration of a statewide transit
93+pass; and
94+! Any other issues that need to be discussed or addressed, as
95+deemed necessary and appropriate by a majority vote of the
96+032
97+-2- members of the committee.
98+In producing a viable proposal for the creation, implementation,
99+and administration of a statewide transit pass, the committee is required
100+to solicit input from specified subject matter experts and interested parties
101+across the state.
102+The committee is required to submit its proposal for the creation,
103+implementation, and administration of a statewide transit pass, including
104+recommendations for any necessary legislation in connection with the
105+proposal, to the executive director and the members of the transportation
106+legislation review committee of the general assembly on or before July 1,
107+2026.
108+Ozone season transit grant program. The ozone season transit
109+grant program was created in the Colorado energy office in 2022. Section
110+2 makes the following changes to the ozone season transit grant program:
111+! Relocates the ozone season transit grant program to the
112+department;
113+! Requires the transit association that receives money from
114+the state and uses the money to make grants to transit
115+agencies to consider grants that have been or will be
116+awarded to the transit agency through the youth fare free
117+transit grant program, created in the bill, when making
118+grants to ensure that transit agencies do not receive grants
119+through the ozone season transit grant program for services
120+that are paid for with grants from the youth fare free transit
121+grant program;
122+! Requires the state treasurer to transfer $7 million to the
123+ozone season transit grant program fund on July 1, 2024,
124+and on July 1 of each year thereafter; and
125+! Makes the ozone season transit grant program permanent
126+by repealing the statute that would repeal the ozone season
127+transit grant program on July 1, 2024.
128+Youth fare free transit grant program. Section 3 creates the
129+youth fare free transit grant program in the department to provide grants
130+to the regional transportation district (RTD) and a transit association to
131+provide fare free year-round transit services for individuals who are 19
132+years of age or younger (youth).
133+To receive a grant, a transit association or the RTD must submit
134+an application to the department in accordance with the policies
135+established by the department. A transit association that receives a grant
136+may use the money to make grants to eligible transit agencies. The
137+eligible transit agencies and the RTD may use the grant money to provide
138+operating support for its transit operations and general transit programs,
139+so long as the eligible transit agency or the RTD provides uninterrupted
140+fare free year-round transit services for youth riders.
141+The RTD is required to report to the department and an eligible
142+032
143+-3- transit agency that receives a grant from a transit association is required
144+to report to the transit association regarding the estimated change in youth
145+ridership during the year in which fare free services were offered
146+compared to previous years, any changes that the RTD or the eligible
147+transit agency would make in how it provides fare free transit services to
148+youth or in its use of the grant money based on its experiences, and how
149+the RTD or the eligible transit agency marketed the fare free transit
150+services for youth. The transit association is required to submit to the
151+department a summary of the reported information for all eligible transit
152+agencies that received a grant through the transit association.
153+The bill creates the youth fare free transit grant program fund
154+(fund) and transfers $7 million from the general fund to the fund on July
155+1, 2024, and on July 1 of each year thereafter. The money in the fund is
156+continuously appropriated to the department for the youth fare free transit
157+grant program.
158+The department is required to establish policies governing the
159+youth fare free transit grant program and to report to the house of
160+representatives transportation, housing, and local government committee
161+and the senate transportation committee, or their successor committees,
162+by December 31 of each year of the program.
163+Income tax credit for the purchase of a transit pass. For income
164+tax years beginning on or after January 1, 2024, but before January 1,
165+2029, section 4 creates an income tax credit allowed to any taxpayer in
166+an amount equal to 30% of the amount spent by the taxpayer to purchase
167+one or more transit passes for use by the taxpayer during the income tax
168+year for which the credit is claimed.
169+To claim the credit a taxpayer is required to include a credit
170+certificate issued by the department with the income tax return filed with
171+the department of revenue. The credit certificate that the department
172+issues must identify the taxpayer and certify that the taxpayer purchased
173+one or more transit passes for the taxpayer's use during the income tax
174+year for which the credit is claimed.
175+The amount of the credit not used as an offset against income taxes
176+in the current income tax year is refunded to the taxpayer.
177+No later than January 1, 2025, and no later than January 1 of each
178+year thereafter through January 1, 2029, the department is required to
179+provide the department of revenue with an electronic report of the
180+taxpayers receiving a credit certificate.
