Opioid and Other Substance Use Disorders Study Committee. Section 1 of the bill implements a voluntary designation process for recovery-friendly workplaces. Section 2 allows a school district to include in the annual pupil count a student who has transferred to a recovery high school before the pupil count date. Section 4 declares that recovery residences, sober living facilities, and sober homes are a residential use of land for zoning purposes. Sections 5 and 6 place restrictions on where liquor-licensed drugstores and fermented malt beverage and wine retailers may display alcohol beverages on the stores' licensed premises. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. In Colorado Revised Statutes, add part 3 to article2 2 of title 8 as follows:3 PART 34 RECOVERY-FRIENDLY WORKPLACES5 8-2-301. Definitions. A S USED IN THIS PART 3, UNLESS THE6 CONTEXT OTHERWISE REQUIRES :7 (1) "C ERTIFIED RECOVERY-READY WORKPLACE " MEANS A8 WORKPLACE THAT MEETS THE CRITERIA FOR CERTIFICATION AS9 ESTABLISHED BY THIS PART 3, ATTAINS DESIGNATION AS CERTIFIED BY THE10 RECOVERY-READY WORKPLACE PROGRAM , AND RECEIVES WRITTEN11 DOCUMENTATION FROM THE PROGRAM OF SUCH DESIGNATION .12 (2) "D EPARTMENT" MEANS THE DEPARTMENT OF LABOR AND13 EMPLOYMENT.14 (3) "E MPLOYEE" MEANS ANY PERSON WHO WORKS FOR SALARY ,15 WAGES, OR OTHER REMUNERATION FOR AN EMPLOYER SUBJECT TO THE16 PROVISIONS OF THIS PART 3 AND INCLUDES INDIVIDUALS IN MANAGERIAL17 POSITIONS, THOSE WORKING FOR OR ON BEHALF OF THE STATE ,18 CONTRACTORS, AND INDIVIDUALS IN WORK-FROM-HOME POSITIONS.19 (4) "E MPLOYER" MEANS ANY PUBLIC OR PRIVATE PERSON OR20 ENTITY THAT HAS ONE OR MORE EMPLOYEES WHO ARE RESIDENTS OF THE21 STATE AND WHO ARE COVERED BY THE "WORKERS' COMPENSATION ACT22 SB24-048-2- OF COLORADO", ARTICLES 40 TO 47 OF THIS TITLE 8, OR THAT CONDUCTS1 BUSINESS IN OR WITHIN THE STATE. "EMPLOYER" INCLUDES THE STATE2 AND ANY DEPARTMENT , AGENCY, OR INSTRUMENTALITY OF THE STATE ;3 ANY COUNTY; ANY MUNICIPAL CORPORATION; AND ANY EMPLOYER THAT4 IS SELF-INSURED. A SINGLE EMPLOYER MAY HAVE MULTIPLE WORKPLACES .5 (5) "P ARTICIPANT" MEANS A WORKPLACE THAT MEETS THE6 CRITERIA FOR PARTICIPANT STATUS AS ESTABLISHED BY THIS PART 3,7 ATTAINS DESIGNATION AS A PARTICIPANT BY THE RECOVERY -READY8 WORKPLACE PROGRAM , AND RECEIVES DOCUMENTATION FROM THE9 PROGRAM OF SUCH DESIGNATION .10 (6) "P REVENTION" MEANS THE PREVENTION OF SUBSTANCE MISUSE11 THROUGH STRATEGIES DESIGNED TO REDUCE THE RISK OF INJURY AND12 STRESS IN THE WORKPLACE AND ADDRESS OTHER FACTORS THAT MAY13 INCREASE THE RISK OF SUBSTANCE MISUSE AND THROUGH TRAINING AND14 EDUCATION TO BUILD SUBSTANCE USE DISORDER AND RECOVERY15 LITERACY.16 (7) "R ECOVERY" MEANS A PROCESS OF CHANGE THROUGH WHICH17 INDIVIDUALS IMPROVE THEIR HEALTH AND WELLNESS , LIVE A18 SELF-DIRECTED LIFE, AND STRIVE TO REACH THEIR FULL POTENTIAL .19 (8) "R ECOVERY-READY WORKPLACE ADVISOR " MEANS AN20 INDIVIDUAL WHO IS AN EMPLOYEE OF OR CONTRACTOR FOR THE21 RECOVERY-READY WORKPLACE PROGRAM AND WHOSE DUTIES INCLUDE22 ASSISTING EMPLOYERS THROUGH THE PROCESS OF BECOMING A23 RECOVERY-READY WORKPLACE PARTICIPANT OR A CERTIFIED24 RECOVERY-READY WORKPLACE.25 (9) "R ECOVERY-READY WORKPLACE PROGRAM " OR "PROGRAM"26 MEANS THE PROGRAM ESTABLISHED IN SECTION 8-2-302.27 SB24-048 -3- (10) "RECOVERY-READY WORKPLACE TASK FORCE " MEANS A TASK1 FORCE ESTABLISHED BY AN EMPLOYER OR ITS EMPLOYEES THAT REFLECTS2 DIFFERENT COMPONENTS OF THE WORKFORCE AND INCLUDES DIFFERENT3 LEVELS OF STAFF TO LEAD RECOVERY -READY WORKPLACE POLICY4 DEVELOPMENT AND IMPLEMENTATION AND TO CONTINUOUSLY REVIEW5 AND UPDATE THE EMPLOYER 'S POLICIES AND PRACTICES TO MAKE THEM6 MORE RECOVERY-READY.7 (11) "R ECOVERY SUPPORT SERVICES " MEANS NONCLINICAL8 SERVICES THAT ASSIST INDIVIDUALS IN ACHIEVING OR SUSTAINING9 RECOVERY FROM A SUBSTANCE USE DISORDER AND MAY INCLUDE10 MENTORSHIP, RECOVERY COACHING, INFORMATION SHARING, RECOVERY11 PLANNING, AND LINKAGE TO SERVICES OR OTHER RESOURCES .12 (12) "S UBSTANCE USE DISORDER" HAS THE SAME MEANING AS SET13 FORTH IN SECTION 27-50-101 (20).14 (13) "W ORKPLACE" MEANS ANY OFFICE, WAREHOUSE, BUILDING,15 OR OTHER LOCATION, WHETHER PERMANENT OR TEMPORARY , WHERE AN16 EMPLOYEE PERFORMS ANY WORK -RELATED DUTY OR DUTIES IN THE SCOPE17 AND COURSE OF THE EMPLOYEE 'S EMPLOYMENT. EMPLOYERS MAY HAVE18 MORE THAN ONE WORKPLACE . "WORKPLACE" DOES NOT INCLUDE AN19 EMPLOYEE'S RESIDENCE OR OTHER REMOTE WORK LOCATION . IF AN20 EMPLOYER OPERATES EXCLUSIVELY THROUGH TELEWORK , THE21 DESIGNATED WORKPLACE ADDRESS IS THE ADDRESS LISTED ON THE22 EMPLOYER'S ARTICLES OF INCORPORATION FILED WITH THE SECRETARY OF23 STATE, IF INCORPORATED IN THIS STATE, OR, IF NOT INCORPORATED IN THIS24 STATE, THE ADDRESS OF THE EMPLOYER 'S OFFICIAL HEADQUARTERS IN25 THIS STATE.26 8-2-302. Recovery-ready workplace program - creation -27 SB24-048 -4- duties. (1) T HERE IS HEREBY ESTABLISHED A RECOVERY -READY1 WORKPLACE PROGRAM . THE DEPARTMENT MAY CONTRACT WITH ONE OR2 MORE PUBLIC OR PRIVATE ENTITIES TO PERFORM SOME OR ALL OF THE3 DUTIES OUTLINED IN THIS PART 3 BUT SHALL MAINTAIN OVERSIGHT OF THE4 PROGRAM. ANY SUCH PUBLIC OR PRIVATE ENTITY SHALL BE REQUIRED TO5 MEET ALL REQUIREMENTS FOR CERTIFICATION AS A RECOVERY -READY6 WORKPLACE.7 (2) A T A MINIMUM, THE PROGRAM MUST:8 (a) D EVELOP OR ADOPT A PROCESS THROUGH WHICH EMPLOYERS9 MAY APPLY TO BECOME RECOVERY -READY WORKPLACE PARTICIPANTS OR10 CERTIFIED AS RECOVERY-READY AS SET FORTH IN SECTION 8-2-303;11 (b) D EVELOP OR ADOPT AN ORIENTATION PROCESS THAT INCLUDES12 TRAINING MATERIALS FOR NEW EMPLOYERS THAT PROVIDES A BASELINE13 INTRODUCTION TO SUBSTANCE USE DISORDERS , TREATMENT, AND14 RECOVERY, INCLUDING INFORMATION ON THE SCIENCE OF ADDICTION ,15 STIGMA, SUBSTANCE USE IN THE WORKFORCE , PREVENTION MEASURES,16 AVAILABLE LOCAL RESOURCES , AND THE WAYS IN WHICH EMPLOYERS CAN17 AMEND AND IMPLEMENT RECOVERY -READY POLICIES AND PRACTICES TO18 HELP THEIR EMPLOYEES WITH SUBSTANCE USE DISORDERS ;19 (c) P ROVIDE CONSULTATION, GUIDANCE, TECHNICAL ASSISTANCE,20 TRAINING AND EDUCATION, AND OTHER SUPPORT TO EMPLOYERS SEEKING21 TO BECOME PARTICIPANTS OR CERTIFIED RECOVERY -READY WORKPLACES,22 AS WELL AS TO CURRENT PARTICIPANTS AND CERTIFIED RECOVERY -READY23 EMPLOYERS AND KEY STAKEHOLDERS WITHIN THE WORKPLACE , SUCH AS24 HUMAN RESOURCES DIRECTORS AND UNION LEADERS ;25 (d) C ONDUCT OUTREACH TO KEY STAKEHOLDERS WITHIN THE26 STATE, INCLUDING EMPLOYERS THAT ARE NOT ENGAGED IN THE PROGRAM ,27 SB24-048 -5- LABOR UNIONS, AND RECOVERY SUPPORT SERVICES OR GANIZATIONS TO1 PROVIDE INFORMATION REGAR DING THE PROGRAM AND PROGRAM2 BENEFITS;3 (e) D EPENDENT ON FUNDING, HIRE OR CONTRACT WITH AT LEAST4 ONE RECOVERY-READY WORKPLACE ADVISOR FOR EVERY ONE HUNDRED5 PARTICIPANTS AND CERTIFIED RECOVERY -READY WORKPLACES;6 (f) A SSIGN A RECOVERY-READY WORKPLACE ADVISOR TO EACH7 EMPLOYER THAT HAS SUBMITTED A LETTER OF INTENT WHO WILL :8 (I) A SSIST EMPLOYERS THROUGH THE PROCESS OF BECOMING A9 PARTICIPANT OR CERTIFIED RECOVERY -READY WORKPLACE;10 (II) P ROVIDE INFORMATION TO EMPLOYERS REGARDING THE STATE11 AND FEDERAL LAWS AND REGULATIONS THAT IMPACT INDIVIDUALS WITH12 SUBSTANCE USE DISORDERS, INCLUDING THE FEDERAL "AMERICANS WITH13 D ISABILITIES ACT OF 1990", 42 U.S.C. SEC. 12101 ET. SEQ.; STATE14 DISABILITY LAWS; THE FEDERAL "FAMILY MEDICAL LEAVE ACT", 2915 U.S.C. SECS. 2601 TO 2654; 42 CFR 2; AND THE FEDERAL "HEALTH16 I NSURANCE PORTABILITY AND ACCOUNTABILITY ACT OF 1996", 42 U.S.C.17 SEC. 201 ET SEQ., THROUGH THE PROVISION OF WRITTEN MATERIALS ,18 TRAINING, OR REFERRAL TO AN INDIVIDUAL OR ENTITY WITH THE19 REQUISITE KNOWLEDGE;20 (III) P ROVIDE ONGOING ASSISTANCE TO EMPLOYERS BY :21 (A) W ORKING WITH EMPLOYERS TO REVIEW THE EMPLOYERS '22 POLICIES AND PROCEDURES AND PROVIDING SUGGESTIONS TO MAKE SUCH23 POLICIES AND PROCEDURES MORE RECOVERY -READY;24 (B) R EFERRING EMPLOYERS TO ORGANIZATIONS AND INDIVIDUALS25 WITH SPECIALIZED KNOWLEDGE AND EXPERTISE THAT MAY ASSIST THE26 EMPLOYER IN BECOMING OR MAINTAINING ITS STATUS AS27 SB24-048 -6- RECOVERY-READY OR IN REVISING ITS POLICIES OR PROCEDURES TO1 BETTER ASSIST EMPLOYEES WITH SUBSTANCE USE DISORDERS , ADDRESSING2 STIGMA AND BUILDING A RECOVERY -SUPPORTIVE WORKPLACE CULTURE ,3 OR IN PROVIDING EMPLOYEES ACCESS TO ADDITIONAL SERVICES AND4 SUPPORTS; AND5 (C) E NCOURAGING EMPLOYEE INVOLVEMENT IN THE EMPLOYER 'S6 PROCESS OF BECOMING A PARTICIPANT OR CERTIFIED RECOVERY -READY7 WORKPLACE OR IN MAINTAINING SUCH STATUS , INCLUDING THROUGH8 ACTIVITIES SUCH AS PARTICIPATING IN A RECOVERY -READY WORKPLACE9 TASK FORCE, ORIENTING NEW EMPLOYEES ON THE EMPLOYER 'S10 RECOVERY-READY POLICIES, MONITORING THE IMPLEMENTATION PROCESS ,11 AND PROVIDING FEEDBACK ON THE EMPLOYER 'S RECOVERY-READY12 WORKPLACE EFFORTS; AND13 (IV) A SSIST EMPLOYERS IN RENEWING THEIR STATUS AS A14 PARTICIPANT OR CERTIFIED RECOVERY-READY WORKPLACE THROUGH THE15 COMPLETION OF AN ANNUAL REVIEW AS SET FORTH IN SECTION 8-2-30316 (5);17 (g) P ROVIDE EACH PARTICIPATING EMPLOYER WITH A CERTIFICATE18 OR OTHER DOCUMENTATION EVIDENCING THE EMPLOYER 'S STATUS AS A19 PARTICIPANT OR AS A CERTIFIED RECOVERY -READY WORKPLACE, WHICH20 MUST REFLECT THE NAME OF THE EMPLOYER , THE ADDRESS OF EACH21 WORKPLACE COVERED BY THE CERTIFICATE , THE DATE THE CERTIFICATE22 WAS ISSUED, AND THE DATE OF EXPIRATION;23 (h) D EVELOP A RECOVERY-READY WORKPLACE PROGRAM WEBSITE24 THAT PROVIDES RESOURCES AND INFORMATION ON SUBSTANCE USE IN THE25 WORKPLACE TO EMPLOYERS , EMPLOYEES, AND THE GENERAL PUBLIC OR26 INCORPORATE SUCH INFORMATION INTO THE DEPARTMENT 'S EXISTING27 SB24-048 -7- WEBSITE;1 (i) D EVELOP OR ADOPT ALREADY EXISTING EDUCATIONAL AND2 TRAINING RESOURCES FOR EMPLOYERS AND EMPLOYEES THAT MUST BE3 POSTED TO THE PROGRAM WEBSITE AND MUST INCLUDE MATERIALS SUCH4 AS GUIDELINE DOCUMENTS , FLYERS, POSTERS, WEBINARS, PANEL5 DISCUSSIONS, ONLINE INTERACTIVE MODULES , AND TRAINING MODULES6 TAILORED TO SPECIFIC EMPLOYERS OR INDUSTRIES AND MAY INCLUDE7 INTERACTIVE CLASSROOM-BASED TRAINING;8 (j) D EVELOP OR ADOPT ALREADY EXISTING MODEL9 RECOVERY-READY POLICIES AND PROCEDURES FOR USE BY EMPLOYERS ;10 AND11 (k) C OMPILE THE INFORMATION TO BE SUBMITTED TO THE12 DEPARTMENT PURSUANT TO SECTION 8-2-304 (2)(b).13 8-2-303. Recovery-ready workplace program - participants -14 certified recovery-ready workplaces - requirements - renewal -15 termination. (1) A N EMPLOYER SEEKING TO PARTICIPATE IN THE16 RECOVERY-READY WORKPLACE PROGRAM MAY CHOOSE TO DO SO AS A17 PARTICIPANT OR AS A CERTIFIED RECOVERY -READY WORKPLACE.18 (2) (a) T O BECOME A PARTICIPANT IN THE PROGRAM, AN EMPLOYER19 MUST:20 (I) S UBMIT OF A LETTER OF INTENT TO THE PROGRAM IN A FORM21 AND MANNER PRESCRIBED BY THE PROGRAM THAT MUST INCLUDE , AT A22 MINIMUM, THE NAME AND ADDRESS OF THE EMPLOYER AND , IF THE23 EMPLOYER HAS MORE THAN ONE WORKPLACE , THE STREET ADDRESS OF24 EACH WORKPLACE TO WHICH THE LETTER OF INTENT APPLIES ;25 (II) C OMPLETE THE ORIENTATION PROCESS AS REQUIRED BY THE26 PROGRAM, INCLUDING COMPLETION OF THE ORIENTATION TRAINING27 SB24-048 -8- MODULE;1 (III) P REPARE A RECOVERY -READY WORKPLACE PLEDGE OR2 STATEMENT, OR USE A FORM PROVIDED BY THE PROGRAM, THAT IDENTIFIES3 THE VALUES OR PRINCIPLES INFORMING THE COMMITMENT AND BRIEFLY4 DESCRIBES THE KEY RECOVERY-READY WORKPLACE STEPS THE EMPLOYER5 MUST COMPLETE AS A PARTICIPANT ; AND6 (IV) N OTIFY ALL EMPLOYEES AND THE MEMBERS OF THE7 EMPLOYER'S BOARD OF DIRECTORS, IF ANY, IN WRITING OF THE INTENT TO8 BECOME A PARTICIPANT, WHICH THE EMPLOYER MUST SUBMIT TO THE9 PROGRAM.10 (b) U PON SUBMISSION OF THE LETTER OF INTENT , THE PROGRAM11 MUST ASSIGN THE EMPLOYER A RECOVERY -READY WORKPLACE ADVISOR .12 (c) A FTER AN EMPLOYER COMPLETES THE MINIMUM13 REQUIREMENTS AS SET FORTH IN SUBSECTION (2)(a) OF THIS SECTION, THE14 PROGRAM MUST:15 (I) L IST THE EMPLOYER AS A PARTICIPANT ON THE PROGRAM16 WEBSITE; AND17 (II) P ROVIDE THE EMPLOYER WITH A CERTIFICATE OR OTHER18 DOCUMENTATION VERIFYING THE EMPLOYER 'S STATUS AS A PARTICIPANT19 IN THE RECOVERY-READY WORKPLACE PROGRAM , WHICH CERTIFICATE OR20 DOCUMENTATION MUST INCLUDE THE DATE OF ISSUANCE , THE EXPIRATION21 DATE, AND THE ADDRESS OF EACH WORKPLACE COVERED BY THE22 CERTIFICATE. THE CERTIFICATE MUST BE VALID FOR A PERIOD OF AT LEAST23 ONE YEAR AFTER THE DATE OF ISSUANCE .24 (3) (a) T O BECOME CERTIFIED AS A RECOVERY-READY WORKPLACE,25 AN EMPLOYER MUST:26 (I) C OMPLETE ALL STEPS SET FORTH IN SUBSECTION (2)(a) OF THIS27 SB24-048 -9- SECTION FOR BECOMING A PARTICIPANT ;1 (II) W ITH THE EMPLOYER'S RECOVERY-READY WORKPLACE2 ADVISOR, COMPLETE A STANDARDIZED ASSESSMENT OF THE EMPLOYER 'S3 CURRENT POLICIES, PROCEDURES, AND PRACTICES THAT IMPACT CURRENT4 AND PROSPECTIVE EMPLOYEES WITH SUBSTANCE USE DISORDERS AND5 DETERMINE WHERE IMPROVEMENTS CAN BE MADE ; AND6 (III) W ITH THE RECOVERY-READY WORKPLACE ADVISOR , SET7 TIME-LIMITED GOALS TO MAKE SELECT IMPROVEMENTS IDENTIFIED IN8 SUBSECTION (3)(a)(II) OF THIS SECTION, WHICH MUST BE COMPLETED9 WITHIN THE ONE-YEAR TERM OF THE CERTIFICATION , UNLESS AN10 EXTENSION OF TIME IS GRANTED BY THE PROGRAM .11 (b) T HE PROGRAM SHALL LIST ON THE PROGRAM WEBSITE EACH12 EMPLOYER THAT COMPLETES THE MINIMUM REQUIREMENTS AS SET FORTH13 IN SUBSECTION (3)(a) OF THIS SECTION AS A CERTIFIED RECOVERY-READY14 WORKPLACE. IF THE EMPLOYER HAS A LOGO , THE PROGRAM SHALL15 INCLUDE THE LOGO IN THE LISTING.16 (c) U PON COMPLETION OF THE MINIMUM REQUIREMENTS AS SET17 FORTH IN SUBSECTION (3)(a) OF THIS SECTION, THE PROGRAM SHALL18 PROVIDE AN EMPLOYER WITH A CERTIFICATE OR OTHER DOCUMENTATION19 SUITABLE FOR DISPLAY THAT VERIFIES THE EMPLOYER 'S STATUS AS A20 CERTIFIED RECOVERY-READY WORKPLACE. THE CERTIFICATE OR OTHER21 DOCUMENTATION MUST INCLUDE THE DATE OF ISSUANCE , THE EXPIRATION22 DATE, AND THE ADDRESS OF EACH WORKPLACE COVERED BY THE23 CERTIFICATE. THE CERTIFICATE MUST BE VALID FOR ONE YEAR AFTER THE24 DATE OF ISSUANCE.25 (4) T HE DEPARTMENT SHALL RECOGNIZE EACH CERTIFIED26 RECOVERY-READY WORKPLACE EMPLOYER THROUGH PROGRAM PRESS27 SB24-048 -10- RELEASES AND PROGRAM -SPONSORED EVENTS THROUGHOUT THE YEAR .1 (5) A T LEAST THIRTY DAYS PRIOR TO THE EXPIRATION OF A2 CERTIFICATE DESIGNATING AN EMPLOYER AS A PARTICIPANT OR AS A3 CERTIFIED RECOVERY-READY WORKPLACE, THE EMPLOYER SHALL:4 (a) M EET WITH THE RECOVERY-READY WORKPLACE ADVISOR TO5 COMPLETE A REVIEW OF THE EMPLOYER 'S RECOVERY-READY-RELATED6 ACTIVITIES FOR THE PAST YEAR , INCLUDING REVISING WORKPLACE7 POLICIES TO BETTER ASSIST EMPLOYEES WITH SUBSTANCE USE DISORDERS ,8 IMPLEMENTING POLICIES TO ENCOURAGE THE HIRING OF INDIVIDUALS IN9 RECOVERY FROM SUBSTANCE USE DISORDERS , DECREASING OR10 ELIMINATING BARRIERS FOR EMPLOYEES SEEKING TREATMENT ,11 ESTABLISHING A RECOVERY-READY WORKPLACE TASK FORCE , AND TAKING12 STEPS TO REDUCE STIGMA IN THE WORKPLACE ;13 (b) I N CONSULTATION WITH THE RECOVERY -READY WORKPLACE14 ADVISOR, SET GOALS FOR THE UPCOMING YEAR ; AND15 (c) C OMPLETE A WRITTEN OR ELECTRONIC PROGRAM SATISFACTION16 SURVEY.17 (6) A N EMPLOYER MAY CHOOSE TO TERMINATE ITS PARTICIPATION18 IN THE PROGRAM IF THE TERMINATION:19 (a) T AKES EFFECT PRIOR TO THE EXPIRATION OF THE EMPLOYER 'S20 CURRENT DESIGNATION AND THE EMPL OYER PROVIDES WRITTEN NOTICE21 TO THE PROGRAM OF THE INTENT TO TERMINATE PARTICIPATION WITHIN22 THIRTY DAYS PRIOR TO THE PROPOSED DATE OF TERMINATION ; OR23 (b) T AKES EFFECT ON THE EXPIRATION OF THE EMPLOYER 'S24 CURRENT DESIGNATION AND THE EMPL OYER PROVIDES WRITTEN NOTICE25 TO THE PROGRAM OF THE EMPLOYER 'S INTENT NOT TO RENEW ITS26 DESIGNATION AS A PARTICIPANT OR A CERTIFIED RECOVERY -READY27 SB24-048 -11- WORKPLACE.1 (7) T HE PROGRAM MAY REVOKE OR DECLINE TO RENEW THE2 DESIGNATION AS A PARTICIPANT OR CERTIFIED RECOVERY -READY3 WORKPLACE FOR ANY EMPLOYER THAT :4 (a) V IOLATES ANY OF THE REQUIREMENTS OF THIS PART 3;5 (b) V IOLATES ANY RULES IMPLEMENTED BY THE DEPARTMENT IN6 RELATION TO THIS PART 3; OR7 (c) F AILS TO TAKE THE NECESSARY STEPS TO RENEW ITS8 PARTICIPATION OR CERTIFICATION WITHIN THE TIME ALLOWED BY THE9 PROGRAM.10 (8) T HE PROGRAM SHALL REMOVE ALL PARTICIPANTS AND11 CERTIFIED RECOVERY-READY WORKPLACES WHOSE DESIGNATION IS12 REVOKED OR WHO DO NOT SEEK RENEWAL FROM THE PROGRAM WEBSITE13 AND TERMINATE ALL BENEFITS ASSOCIATED WITH SUCH DESIGNATION .14 (9) T HE PROGRAM SHALL BE FLEXIBLE IN GRANTING EXTENSIONS15 TO PARTICIPANTS AND CERTIFIED RECOVERY -READY WORKPLACES THAT16 BEGIN THE PROCESS OF RENEWING THEIR DESIGNATION BUT FAIL TO17 COMPLETE THE PROCESS BEFORE THEIR CURRENT DESIGNATION EXPIRES .18 8-2-304. Program evaluation and reports. (1) T HE19 DEPARTMENT MAY CONDUCT AN EVALUATION OF THE EFFECTIVENESS OF20 THE RECOVERY-READY WORKPLACE PROGRAM AND IDENTIFY WAYS TO21 IMPROVE THE PROGRAM . THE DEPARTMENT MAY HIRE AN OUTSIDE22 CONTRACTOR TO PERFORM THE EVALUATION .23 (2) (a) B EGINNING ONE YEAR AFTER THE EFFECTIVE DATE OF THIS24 PART 3, AND ON AN ANNUAL BASIS THEREAFTER , THE PROGRAM SHALL25 COLLECT AND AGGREGATE THE SATISFACTION DATA OBTAINED AS THE26 RESULT OF THE RENEWAL PROCESS AND SHALL PRESENT SUCH27 SB24-048 -12- INFORMATION IN THE FORM OF A REPORT TO THE HOUSE OF1 REPRESENTATIVES BUSINESS AFFAIRS AND LABOR COMMITTEE AND THE2 SENATE BUSINESS, LABOR, AND TECHNOLOGY COMMITTEE , OR THEIR3 SUCCESSOR COMMITTEES , FOR THE PURPOSE OF PROGRAM REVIEW . Rules. T HE DEPARTMENT SHALL PROMULGATE SUCH2 RULES AS ARE NECESSARY TO EFFECTUATE THIS PART 3.3 SECTION 2. In Colorado Revised Statutes, 22-54-103, add4 (10)(i) as follows:5 22-54-103. Definitions. As used in this article 54, unless the6 context otherwise requires:7 (10) (i) (I) F OR THE 2024-25 BUDGET YEAR AND EACH BUDGET8 YEAR THEREAFTER, A DISTRICT MAY INCLUDE IN ITS PUPIL ENROLLMENT9 PUPILS WHO WERE ENROLLED IN THE DISTRICT PRIOR TO THE PUPIL10 ENROLLMENT COUNT DAY AND THEN TRANSFERRED OUT OF THE DISTRICT11 PRIOR TO THE PUPIL ENROLLMENT COUNT DAY FOR THE PURPOSE OF12 ATTENDING A RECOVERY HIGH SCHOOL .13 (II) A S USED IN THIS SUBSECTION (10)(i), "RECOVERY HIGH14 SCHOOL" MEANS A SCHOOL THAT:15 (A) E DUCATES AND SUPPORTS STUDENTS IN RECOVERY FROM16 SUBSTANCE USE OR CO-OCCURRING DISORDERS, INCLUDING SELF-HARM17 AND DISORDERED EATING;18 (B) I NTENDS THAT ALL STUDENTS ENROLLED ARE WORKING IN AN19 ACTIVE AND ABSTINENCE -FOCUSED PROGRAM OF RECOVERY AS20 DETERMINED BY THE STUDENT AND THE SCHOOL ;21 (C) P ROVIDES SUPPORT FOR FAMILIES LEARNING HOW TO LIVE22 WITH, AND PROVIDE SUPPORT FOR, THEIR TEENS WHO ARE ENTERING INTO23 THE RECOVERY LIFESTYLE; AND24 (D) M EETS STATE REQUIREMENTS FOR AWARDING A HIGH SCHOOL25 DIPLOMA.26 SECTION 3. In Colorado Revised Statutes, 27-80-126, amend27 SB24-048 -14- (3)(b) as follows:1 27-80-126. Recovery support services grant program -2 creation - eligibility - reporting requirements - appropriation - rules3 - definitions. (3) A recovery community organization that receives a4 grant from the grant program may use the money to:5 (b) Provide guidance to individuals with a substance use disorder6 or co-occurring substance use and mental health disorder and their family7 members on THE MANY PATHWAYS FOR RECOVERY , navigating treatment,8 social service SERVICES, and recovery support systems;9 SECTION 4. In Colorado Revised Statutes, 30-28-115, add10 (2)(b.7) as follows:11 30-28-115. Public welfare to be promoted - legislative12 declaration - construction. (2) (b.7) T HE GENERAL ASSEMBLY FINDS13 AND DECLARES THAT IT IS THE POLICY OF THE STATE TO ENCOURAGE ,14 PROMOTE, AND ASSIST PERSONS WHO ARE IN RECOVERY FROM SUBSTANCE15 USE DISORDERS TO LIVE IN RESIDENTIAL NEIGHBORHOODS . FURTHER, THE16 GENERAL ASSEMBLY DECLARES THAT THE USE OF RECOVERY RESIDENCES ,17 SOBER LIVING FACILITIES, AND SOBER HOMES, AS DEFINED IN SECTION18 27-80-129 (1)(b), BY PERSONS IN RECOVERY FROM SUBSTANCE USE19 DISORDERS IS A MATTER OF STATEWIDE CONCERN AND THAT RECOVERY20 RESIDENCES, SOBER LIVING FACILITIES, AND SOBER HOMES ARE A21 RESIDENTIAL USE OF PROPERTY FOR ZONING PURPOSES AND SUBJECT ONLY22 TO THE REGULATIONS OF LIKE DWELLINGS IN THE SAME ZONE .23 SECTION 5. In Colorado Revised Statutes, 44-3-410, add (5.5)24 as follows:25 44-3-410. Liquor-licensed drugstore license - multiple licenses26 permitted - requirements - rules. (5.5) O N AND AFTER JANUARY 1,27 SB24-048 -15- 2025, A LIQUOR-LICENSED DRUGSTORE LICENSED UNDER SUBSECTION1 (1)(a)(I) OF THIS SECTION SHALL:2 (a) (I) D ISPLAY ALL ALCOHOL BEVERAGES ACCESSIBLE BY AND3 VISIBLE TO A CONSUMER IN NO MORE THAN ONE LOCATION ON THE RETAIL4 SALES FLOOR, WHICH LOCATION IS NOT ADJACENT TO A DISPLAY OF5 NONALCOHOL BEVERAGES AND MUST NOT EXCEED ONE PERCENT OF THE6 LICENSEE'S TOTAL RETAIL SPACE, UNLESS THE LOCATION IS A COOLER WITH7 A DOOR FROM WHICH THE NONALC OHOL BEVERAGES ARE NOT ACCESSIBLE ;8 OR9 (II) S EPARATE THE DISPLAY OF ALCOHOL BEVERAGES FROM THE10 NONALCOHOL BEVERAGES WITH A DISPLAY OF ONE OR MORE11 NONBEVERAGE PRODUCTS OR ANOTHER PHYSICAL DIVIDER ; AND12 (b) D ISPLAY A SIGN IN THE AREA DESCRIBED IN SUBSECTION13 (5.5)(a) OF THIS SECTION THAT:14 (I) I S PROMINENT;15 (II) I S EASILY READABLE BY CONSUMERS ;16 (III) M EETS ALL REQUIREMENTS FOR FORMAT ESTABLISHED BY THE17 EXECUTIVE DIRECTOR BY RULE; AND18 (IV) R EADS IN PRINT THAT IS NO SMALLER THAN ONE-HALF INCH,19 BOLD-FACED TYPE, "THESE BEVERAGES CONTAIN ALCOHOL . This act20 takes effect at 12:01 a.m. on the day following the expiration of the21 ninety-day period after final adjournment of the general assembly; except22 that, if a referendum petition is filed pursuant to section 1 (3) of article V23 of the state constitution against this act or an item, section, or part of this24 act within such period, then the act, item, section, or part will not take25 effect unless approved by the people at the general election to be held in26 SB24-048 -17- November 2024 and, in such case, will take effect on the date of the1 official declaration of the vote thereon by the governor.2 SB24-048 -18-
