9-ONCERNING THE REQUIREMENT THAT CERTAIN BUILDING CODES HAVE

13-Be it enacted by the General Assembly of the State of Colorado:
14-SECTION 1. Legislative declaration. (1) The general assembly
15-finds and declares that:
16-(a) Accessibility in building design is a fundamental right that
17-fosters inclusivity and equal opportunity for all individuals, particularly
18-those with disabilities. In alignment with article 9 of the United Nations
19-Convention on the Rights of Persons with Disabilities, which emphasizes
20-the need for persons with disabilities to live independently and participate
21-fully in all aspects of life, Colorado recognizes the importance of creating

30-(b) It is crucial that Colorado's building codes incorporate
31-"Americans with Disabilities Act" and "Architectural Barriers Act"
32-standards, which require that buildings and facilities be accessible to
33-persons with disabilities;
34-(c) Aligning local building codes with the internationally recognized
35-standards set forth by the International Building Code and existing federal
36-laws is crucial to ensure that all new constructions, renovations, and
37-alterations adhere to minimum accessibility requirements;
38-(d) This House Bill 25-1030 requires local governments to adopt or
39-amend local building codes to meet or exceed these necessary international
40-building code accessibility standards;
41-(e) By identifying and eliminating obstacles to accessibility, the
42-general assembly can create a built environment that is welcoming and
43-accessible to everyone; and
44-(f) By prioritizing accessibility in Colorado building codes, state and
45-local governments can promote the participation of persons with disabilities
46-in all aspects of community life, thereby enhancing the quality of life for all
47-Colorado residents.
48-(2) Therefore, the general assembly declares that establishing
49-uniform accessibility standards in building codes is of mixed local and
50-statewide concern to ensure that all individuals may access the physical
51-environment, transportation, information, and communications on an equal
52-basis.
53-SECTION 2. In Colorado Revised Statutes, amend 30-28-204 as
54-follows:
55-30-28-204. Amendment of building code. (1) The board of county
56-commissioners from time to time by resolution may alter and amend any
57-county building code after public hearing, notice of which hearing shall be
58-given by at least one publication in a newspaper of general circulation in the
59-county at least fourteen days prior to said hearing. In no case shall the area
60-covered by the building code be extended or changed unless the same has
61-PAGE 2-HOUSE BILL 25-1030 been proposed by or is first submitted for the approval, disapproval, or
62-suggestions of the county planning commission. Unless the county planning
63-commission acts within thirty days, approval shall be assumed. The opinion
64-of the county planning commission shall be advisory only and not binding
65-upon the board of county commissioners.

23+Beginning January 1, 2026, the bill requires a local government
24+that adopts or substantially amends a building code to ensure that the
25+building code meets or exceeds the accessibility standards in international
26+building codes.

50+substantially amended, the codes meet or exceed accessibility standards
51+in international building codes.
52+The bill requires the state housing board to ensure that, when the
53+uniform construction and maintenance standards for hotels, motels, and
54+multiple dwellings in jurisdictions with no local building code are
55+substantially updated, the standards meet or exceed the accessibility
56+standards in international building codes. The bill also requires the state
57+housing board to ensure that, when the recommendations for uniform
58+housing standards and building codes to the general assembly and local
59+governments are substantially updated, the codes meet or exceed the
60+accessibility standards in international building codes.
61+Be it enacted by the General Assembly of the State of Colorado:1
