12-Be it enacted by the General Assembly of the State of Colorado:
13-SECTION 1. In Colorado Revised Statutes, 42-4-316, repeal (2)
14-and (3)(b) as follows:
15-42-4-316. AIR program - demonstration of compliance with
16-ambient air quality standards and transportation conformity. (2) The
17-legislative audit committee shall cause to be conducted performance audits
18-of the program, including the clean screen program. The audits must be
19-completed not later than January 1, 2018, and January 1 of each fifth year
20-thereafter. Upon completion of the audit report, the legislative audit
21-committee shall hold a public hearing to review the report.

29-the act. (3) (b) In such audits, the determination as to whether an ongoing
30-public need for the program has been demonstrated shall take into
31-consideration the following factors, among others:
32-(I) The demonstrable effect on ambient air quality of the program;
33-(II) The cost to the public of the program;
34-(III) The cost-effectiveness of the program relative to other air
35-pollution control programs;
36-(IV) The need, if any, for further reduction of air pollution caused
37-by mobile sources to attain or maintain compliance with national ambient
38-air quality standards;
39-(V) The application of the program to assure compliance with
40-legally required warranties covering air pollution control equipment.
41-SECTION 2. Act subject to petition - effective date. This act
42-takes effect at 12:01 a.m. on the day following the expiration of the
43-ninety-day period after final adjournment of the general assembly; except
44-that, if a referendum petition is filed pursuant to section 1 (3) of article V
45-of the state constitution against this act or an item, section, or part of this act
46-within such period, then the act, item, section, or part will not take effect
47-unless approved by the people at the general election to be held in
48-PAGE 2-HOUSE BILL 25-1054 November 2026 and, in such case, will take effect on the date of the official
49-declaration of the vote thereon by the governor.
