13-SECTION 1. In Colorado Revised Statutes, 40-4-106, add (5) and

22+The bill requires the public utilities commission (commission) to
23+adopt rules requiring that, unless the applicable road authority is a local
24+government, the total costs to maintain an existing railroad crossing (total
25+costs) are shared equally between the railroad, railroad corporation, rail
26+fixed guideway, transit agency, or owner of the track (railroad) and the
27+applicable road authority. If the applicable road authority is a local

129-applicability. (1) This act takes effect at 12:01 a.m. on the day following

131-general assembly; except that, if a referendum petition is filed pursuant to
132-section 1 (3) of article V of the state constitution against this act or an item,
133-section, or part of this act within such period, then the act, item, section, or
134-part will not take effect unless approved by the people at the general
135-election to be held in November 2026 and, in such case, will take effect on
136-the date of the official declaration of the vote thereon by the governor.

138-this act unless the costs accrue pursuant to an agreement entered into by the
