22	22	When a catalytic converter mechanically fails or is stolen from a
23	23	motor vehicle, current rules of the air quality control commission require
24	24	the replacement to comply with the rules of the California air resources
25	25	board. The bill creates a temporary exception that allows a person to use
26	26	a replacement catalytic converter that complies with the standards
27	27	established by rules of the federal environmental protection agency if:

40	40	The exception is repealed, effective July 1, 2027.
41	41	Be it enacted by the General Assembly of the State of Colorado:1
42	42	SECTION 1. In Colorado Revised Statutes, add 42-4-318 as2
43	43	follows:3
44	44	42-4-318. Exception to enforcement in cases of theft or4
45	45	mechanical failure of a catalytic converter - unavailability of5
46	46	replacement catalytic converter - rules - repeal.6

48	48	OTWITHSTANDING THIS PART 3, ARTICLE 7 OF TITLE 25, OR ANY RULE7
49	49	ADOPTED IN ACCORDANCE WITH ARTICLE 7 OF TITLE 25, AN INDIVIDUAL8
50	50	MAY OPERATE A MOTOR VEHICLE WITH A CATALYTIC CONVERTER THAT9
51	51	COMPLIES WITH THE STANDARDS ESTABLISHED BY RULES OF THE FEDERAL10
52	52	ENVIRONMENTAL PROTECTION AGENCY FOR CATALYTIC CONVERTERS IF :11

55	55	MECHANICALLY FAILS IN, THE MOTOR VEHICLE;13

62	62	A REASONABLE EFFORT TO OBTAIN A REPLACEMENT CATALYTIC18
63	63	CONVERTER THAT COMPLIES WITH THIS PART 3, ARTICLE 7 OF TITLE 25,19
64	64	AND ANY RULES ADOPTED IN ACCORDANCE WITH ARTICLE 7 OF TITLE 25,20
65	65	AND THE OWNER OR OPERATOR HAS BEEN UNABLE TO OBTAIN THE21
66	66	CATALYTIC CONVERTER.22

68	68	COMMISSION SHALL ADOPT RULES TO IMPLEMENT THIS SECTION .2

70	70	HIS SECTION IS REPEALED, EFFECTIVE JULY 1, 2027.3
71	71	SECTION 2. Act subject to petition - effective date. This act4
72	72	takes effect at 12:01 a.m. on the day following the expiration of the5
73	73	ninety-day period after final adjournment of the general assembly; except6
74	74	that, if a referendum petition is filed pursuant to section 1 (3) of article V7
75	75	of the state constitution against this act or an item, section, or part of this8
76	76	act within such period, then the act, item, section, or part will not take9
77	77	effect unless approved by the people at the general election to be held in10
78	78	November 2026 and, in such case, will take effect on the date of the11
79	79	official declaration of the vote thereon by the governor.12
