A person, including a corporation or governmental agency,
commits human trafficking of a minor for an abortion or gender-affirming
health-care services if the person transports an out-of-state minor who is

classifies human trafficking of a minor for an abortion or
gender-affirming health-care services as a class 2 felony.
Be it enacted by the General Assembly of the State of Colorado:1
SECTION 1. In Colorado Revised Statutes, add 18-3-504.5 as2
follows:3
18-3-504.5.  Human trafficking of a minor for abortion or4
gender-affirming health-care services. (1) (a)  A
 PERSON COMMITS5
HUMAN TRAFFICKING OF A MINOR FOR AN ABORTION OR6
GENDER-AFFIRMING HEALTH-CARE SERVICES IF THE PERSON TRANSPORTS7
AN OUT-OF-STATE MINOR INTO COLORADO FOR THE PURPOSE OF ASSISTING8
THE MINOR IN OBTAINING AN ABORTION, AS DEFINED IN SECTION 25-6-402,9
OR GENDER-AFFIRMING HEALTH-CARE SERVICES, AS DEFINED IN SECTION10
12-30-121.11
(b)  H
UMAN TRAFFICKING OF A MINOR FOR AN ABORTION OR12
GENDER-AFFIRMING HEALTH-CARE SERVICES IS A CLASS 2 FELONY.13
(2)  I
N ANY PROSECUTION BROUGHT PURSUANT TO SUBSECTION (1)14
OF THIS SECTION, IT IS NOT A DEFENSE THAT:15
(a)  T
HE MINOR CONSENTED TO BEING TRANSFERRED BY THE16
DEFENDANT FOR THE PURPOSE OF OBTAINING AN ABORTION OR17
GENDER-AFFIRMING HEALTH-CARE SERVICES;18
(b)  T
HE MINOR CONSENTED TO OBTAINING AN ABORTION OR19
GENDER-AFFIRMING HEALTH-CARE SERVICES;20
(c)  T
HE DEFENDANT DID NOT KNOW THE MINOR 'S AGE OR21
REASONABLY BELIEVED THE MINOR TO BE EIGHTEEN YEARS OF AGE OR22
OLDER; OR23

BE EIGHTEEN YEARS OF AGE OR OLDER .2
SECTION 2. Act subject to petition - effective date. This act3
takes effect at 12:01 a.m. on the day following the expiration of the4
ninety-day period after final adjournment of the general assembly; except5
that, if a referendum petition is filed pursuant to section 1 (3) of article V6
of the state constitution against this act or an item, section, or part of this7
act within such period, then the act, item, section, or part will not take8
effect unless approved by the people at the general election to be held in9
November 2026 and, in such case, will take effect on the date of the10
official declaration of the vote thereon by the governor.11
