3434 SECTION 1. In Colorado Revised Statutes, 14-10-114, amend2
3535 (8)(c)(IV) as follows:3
3636 14-10-114. Spousal maintenance - advisory guidelines -4
3737 legislative declaration - definitions. (8) Definitions. As used in this5
3838 section, unless the context otherwise requires:6
3939 (c) (IV) If a party is voluntarily unemployed or underemployed,7
4040 maintenance shall MUST be calculated based on a determination of8
4141 potential income; except that a determination of potential income shall9
4242 MUST not be made for a party who is physically or mentally incapacitated10
4343 or is caring for a child under the age of thirty TWENTY-FOUR months for11
4444 whom the parties owe a joint legal responsibility or for an incarcerated12
4545 parent sentenced to one year or more.13
4646 SECTION 2. In Colorado Revised Statutes, 14-10-115, amend14

5151 14-10-115. Child support guidelines - purpose - determination19
5252 of income - schedule of basic child support obligations - adjustments20

5454 commission - definitions. (2) Duty of support - factors to consider.22
5555 (a) In a proceeding for dissolution of marriage, legal separation,23
5656 maintenance, or child support, the court may SHALL, TO THE EXTENT24

6565 (3) Definitions. As used in this section, unless the context7

6868 ELF-SUPPORT RESERVE" MEANS AN AMOUNT EQUAL TO THE9
6969 STATE HOURLY MINIMUM WAGE MULTIPLIED BY TWENTY -NINE HOURS PER10
7070 WEEK, MULTIPLIED BY FIFTY WEEKS PER YEAR , DIVIDED BY TWELVE11

7272 (h) "Shared physical care", for the purposes of the child support13
7373 guidelines and schedule of basic child support obligations specified in14
7474 this section, and as further specified in paragraph (b) of subsection (8)

7676 SUBSECTION (8)(b) of this section, means that each parent keeps the16
7777 children overnight for more than ninety-two overnights FOR AT LEAST ONE17
7878 OVERNIGHT each year and that both parents contribute to the expenses of18
7979 the children in addition to the payment of child support.19
8080 (i) "Split physical care", for the purposes of the child support20
8181 guidelines and schedule of basic child support obligations specified in21
8282 this section, and as further specified in paragraph (c) of subsection (8)22
8383 SUBSECTION (8)(c) of this section, means that each parent has physical23
8484 care of at least one of the children by means of that child or children24
8585 residing with that parent the majority MORE THAN FIFTY PERCENT of the25
8686 time.26
8787 (5) Determination of income. (a) For the purposes of the child27

8989 -3- support guidelines and schedule of basic child support obligations1
9090 specified in this section, the gross income of each parent shall be IS2
9191 determined according to the following guidelines:3
9292 (III) (B) "Ordinary and necessary expenses" does not include4
9393 amounts allowable by the internal revenue service for the accelerated5
9494 component of depreciation expenses or investment tax credits or any6
9595 other business expenses determined by the court to be inappropriate for7
9696 determining gross income for purposes of calculating child support;8
9797 EXCEPT THAT, THE COURT MAY CONSIDER STRAIGHT -LINE DEPRECIATION,9
9898 IF APPROPRIATE, EVEN IF ACCELERATED DEPRECIATION WAS USED IN THE10
9999 PARTY'S INCOME TAX FORMS.11
100100 (IV) If a preexisting court-ordered alimony or maintenance12
101101 obligation actually received
102102 PAID by a party does not involve the same13
103103 parties as the child support calculation and is not deductible for federal14
104104 income tax purposes by that party, then the amount of preexisting15
105105 court-ordered alimony or maintenance that is deducted from that party's16
106106 gross income is the amount actually received PAID by that party multiplied17
107107 by 1.25.18
108108 (7) Schedule of basic child support obligations. (a) (I) The19
109109 basic child support obligation shall MUST be determined using the20
110110 schedule of basic child support obligations contained in paragraph (b) of21
111111 this subsection (7) SUBSECTION (7)(b) OF THIS SECTION. The basic child22
112112 support obligation shall MUST be divided between the parents in23
113113 proportion to their EACH PARENT'S adjusted gross incomes INCOME.24
114114 (II) (A) For A combined gross income that falls between amounts25
115115 shown in the schedule of basic child support obligations, basic child26
116116 support amounts shall MUST be interpolated. The category entitled27

118118 -4- "number of children due support" in the schedule of basic child support1
119119 obligations shall have the meaning defined in subsection (3) of this2
120120 section.3

136136 THE SELF-SUPPORT RESERVE but more than six hundred fifty dollars, the17
137137 obligor is required to pay a child support payment of OBLIGOR'S BASIC18
138138 CHILD SUPPORT OBLIGATION is REDUCED TO fifty dollars per month for19
139139 one child, seventy dollars per month for two children, ninety dollars per20
140140 month for three children, one hundred ten dollars per month for four21
141141 children, one hundred thirty dollars per month for five children, and one22
142142 hundred fifty dollars per month for six or more children. The minimum23
143143 order amount shall not apply when each parent keeps the children more24
144144 than ninety-two overnights each year as defined in subsection (3)(h) of25
145145 this section. In no case, however, shall the amount of child support26
146146 ordered to be paid exceed the amount of child support that would27

149149 custody. THE REDUCED LOW-INCOME ADJUSTMENT DOES NOT APPLY IF, AS2

164164 subsection (11)(c)(III) of this section. The obligor's child support amount15
165165 may be further adjusted to include a share of the work-related and16
166166 education-related child care costs, health insurance, extraordinary medical17
167167 expenses, and other extraordinary adjustments as described in subsections18
168168 (9), (10), (11)(a), and (11)(b) of this section. However, if at the time the19
169169 child support obligation is calculated, adjustments made pursuant to20
170170 subsections (9), (10), (11)(a), and (11)(b) of this section, together with the21
171171 REDUCED low-income adjustment amount, exceed twenty
172172 TEN percent of22
173173 the obligor's adjusted gross income, the child support obligation must be23
174174 capped at twenty TEN percent of the obligor's adjusted gross income. The24
175175 low-income adjustment does not apply when each parent keeps the25
176176 children more than ninety-two overnights each year as defined in26
177177 subsection (8) of this section. In no case, however, shall the amount of27

179179 -6- child support ordered to be paid exceed the amount of child support that1
180180 would otherwise be ordered to be paid if the parents did not share2
181181 physical custody. THE AMOUNT OF CHILD SUPPORT OWED BY A PARENT3
182182 WITH SHARED PARENTING TIME MUST NOT EXCEED THE AMOUNT OWED BY4
183183 THAT SAME PARENT IF THE PARENT HAD NO OVERNIGHTS .5
184184 (D) In any circumstance in which the obligor's monthly adjusted6
185185 gross income is less than or equal to six hundred fifty dollars, regardless7
186186 of the monthly adjusted gross income of the obligee, the obligor must be8
187187 ordered to pay the minimum monthly order amount in child support. The9
188188 minimum order amount is ten dollars per month, regardless of the number10
189189 of children between these parties. The ten-dollar minimum monthly order11
190190 amount is not adjusted by the number of the obligor's overnights with12
191191 children.13
192192 (E) The judge may use discretion to determine child support in14
193193 circumstances where combined adjusted gross income exceeds the15
194194 uppermost levels of the schedule of basic child support obligations;16
195195 except that the presumptive basic child support obligation shall not be17
196196 less than it would be based on the highest level of adjusted gross income18
197197 set forth in the schedule of basic child support obligations.19

26462646 parenting time for the written report. In the written report, the evaluator21
26472647 shall provide to the court, for the court to consider, options that serve the22
26482648 best interests of the child.23

29052905 order directing the obligor to pay such sums for support as may be22
29062906 reasonable under the circumstances, taking into consideration the factors23
29072907 found DESCRIBED in section 19-4-116 (6) The court or delegate child24
29082908 support enforcement unit may also enter an order directing the25
29092909 appropriate party to pay for support of the child, in an amount as may be26
29102910 determined by the court or delegate child support enforcement unit to be27

29132913 occurred prior to the month the child support obligation begins pursuant2
29142914 to section 19-6-104.3
29152915 SECTION 15. Effective date. This act takes effect upon passage;4
29162916 except that section 7 and section 12 of this act take effect on February 1,5
29172917 2026; and section 14-10-115 (3), (7), and (8), as amended in section 2 of6
29182918 this act, takes effect on March 1, 2026.7
29192919 SECTION 16. Safety clause. The general assembly finds,8
29202920 determines, and declares that this act is necessary for the immediate9
29212921 preservation of the public peace, health, or safety or for appropriations for10
29222922 the support and maintenance of the departments of the state and state11
