ONCERNING REQUIRING THE LABELING OF GAS -FUELED STOVES.101

The bill requires a wholesaler or supplier of a gas-fueled stove
(stove) to, prior to selling a stove to a consumer in the state, affix an
adhesive label to the stove with the phrase "This appliance should be
ventilated to the exterior when in use."
Before transacting an online sale of a stove to an address in the
state, a wholesaler or supplier is required to post the same phrase on the
internet website where the online sale occurs.
The bill specifies that a violation of the requirements of the bill is

SECTION 1. In Colorado Revised Statutes, add part 16 to article2

COOKTOP THAT DIRECTLY COMBUSTS A GASEOUS OR LIQUID FUEL , IS USED11
FOR INDOOR FOOD PREPARATION , AND PROVIDES AT LEAST ONE OF THE12
FOLLOWING FUNCTIONS:13

FOLLOWING STATEMENT IN BOLD -FACED, BLACK TYPE THAT IS CLEARLY22
LEGIBLE IN ENGLISH AND SPANISH:23

NDERSTAND THE AIR QUALITY IMPLICATIONS OF

HAVING AN INDOOR GAS STOVE .25

OF THIS SECTION, THE ADHESIVE LABEL MUST INCLUDE A WEBSITE LINK OR2
A QUICK RESPONSE (QR) CODE OR OTHER MACHINE-READABLE CODE THAT3
A POTENTIAL CONSUMER MAY USE TO ACCESS THE WEB PAGE ESTABLISHED4
BY THE DEPARTMENT PURSUANT TO SUBSECTION (4) OF THIS SECTION.5

 RETAILER SHALL AFFIX THE ADHESIVE LABEL DESCRIBED IN

SUBSECTION (1) OF THIS SECTION TO THE DISPLAY MODEL FOR A NEW7
GAS-FUELED STOVE ON A HORIZONTAL SURFACE IN A PROMINENT POSITION8
THAT IS CAPABLE OF BEING EASILY READ BY A POTENTIAL CONSUMER9
EXAMINING THE DISPLAY MODEL AND EASILY ACCESSIBLE BY A CELL10
PHONE CAMERA.11

EFORE TRANSACTING AN ONLINE SALE OF A NEW GAS -FUELED

STOVE TO AN ADDRESS IN THE STATE, A RETAILER SHALL PROMINENTLY13
POST ON THE INTERNET WEBSITE WHERE THE ONLINE SALE OCCURS THE14
CONTENT OF THE ADHESIVE LABEL DESCRIBED IN SUBSECTION (1) OF THIS15
SECTION FOR THE POTENTIAL CONSUMER .16

HE DEPARTMENT SHALL ESTABLISH A PAGE ON THE

DEPARTMENT'S PUBLIC WEBSITE WITH CREDIBLE, EVIDENCE-BASED18
INFORMATION ON THE HEALTH IMPACTS OF GAS -FUELED STOVES. THE19
DEPARTMENT MAY INCLUDE ON THE WEB PAGE LINKS TO TECHNICAL20
STUDIES OR OTHER RESOURCES TO ASSIST THE PUBLIC IN UNDERSTANDING21
THE HEALTH IMPACTS OF GAS-FUELED STOVES.22

SECTION 2. In Colorado Revised Statutes, 6-1-105, add (1)(iiii)27

6-1-105.  Unfair or deceptive trade practices - definitions.2
(1)  A person engages in a deceptive trade practice when, in the course of3
the person's business, vocation, or occupation, the person:4

SECTION 3. Act subject to petition - effective date -6
applicability. (1)  This act takes effect at 12:01 a.m. on the day following7
the expiration of the ninety-day period after final adjournment of the8
general assembly; except that, if a referendum petition is filed pursuant9
to section 1 (3) of article V of the state constitution against this act or an10
item, section, or part of this act within such period, then the act, item,11
section, or part will not take effect unless approved by the people at the12
general election to be held in November 2026 and, in such case, will take13
effect on the date of the official declaration of the vote thereon by the14
governor.15
(2)  This act applies to conduct occurring on or after the applicable16
effective date of this act.17
