The bill prohibits a peace officer from asking a driver or passenger if they know the reason for the traffic stop, and requires the peace officer to inform the driver of the reason for the traffic stop unless it is unreasonable under the totality of the circumstances. In Colorado Revised Statutes, add 42-4-1704.5 as2 follows:3 42-4-1704.5. Peace officer questioning during a traffic stop.4 (1) A PEACE OFFICER WHO IS MAKING A TRAFFIC STOP SHALL NOT ASK THE5 VEHICLE OPERATOR OR A PASSENGER IF THE VEHICLE OPERATOR OR6 PASSENGER KNOWS THE REASON FOR THE TRAFFIC STOP .7 (2) A PEACE OFFICER WHO IS MAKING A TRAFFIC STOP SHALL8 INFORM THE VEHICLE OPERATOR OF THE REASON OR REASONS FOR THE9 TRAFFIC STOP, UNLESS INFORMING THE OPERATOR OF THE REASON OR10 REASONS FOR THE TRAFFIC STOP WOULD BE UNREASONABLE UNDER THE11 TOTALITY OF THE CIRCUMSTANCES .12 (3) A PEACE OFFICER'S FAILURE TO COMPLY WITH THIS SECTION IS13 NOT GROUNDS FOR THE EXCLUSION OF EVIDENCE OR DISMISSAL OF A14 CHARGE.15 SECTION 2. Safety clause. The general assembly finds,16 determines, and declares that this act is necessary for the immediate17 preservation of the public peace, health, or safety or for appropriations for18 the support and maintenance of the departments of the state and state19 institutions.20 HB25-1243-2-
