40	37		SECTION 1. In Colorado Revised Statutes, 12-155-103, add2
41	38		with relocated provisions (1.2) and (1.4); and add with amended and3
42	39		relocated provisions (1.6) as follows:4
43	40		12-155-103. Definitions. As used in this article 155, unless the5
44	41		context otherwise requires:6
45	42		(1.2) [Formerly 12-155-103 (6)] "Colorado fuel gas code" means7
46	43		a code adopted by rule of the board for the inspection of plumbing fuel8
47	44		gas pipe installations.9
48	45		(1.4) [Formerly 12-155-103 (5)] "Colorado plumbing code" or10
49	46		"the code" means a code established by the board that consists of11
50	47		standards for plumbing installation, plumbing materials, conservation,12
51	48		medical gas, sanitary drainage systems, and solar plumbing that could13
52	49		directly affect the potable water supply.14
53	50		(1.6) [Formerly 12-155-103 (7)] (a) "Conservation" means15
54	51		efficiency measures that meet national guidelines and standards and are16
55	52		tested and approved by a nationally recognized testing laboratory,17
56	53		including:18
57	54		(I) Water-efficient devices and fixtures; and19
58	55		(II) The use of locally produced materials, when practicable, to20
59	56		reduce transportation impacts.21
60	57		(b) When conservation conflicts with safety, the board shall give22
61	58		primary consideration to safety.23
62	59		(c) Nothing in this subsection (7) SUBSECTION (1.6) affects the24
63	60		board's authority to establish the Colorado plumbing code as specified in25
64	61		section 12-155-106.26
65	62		1306-2- SECTION 2. Repeal of relocated provisions in this act. In1
66	63		Colorado Revised Statutes, repeal 12-155-103 (5), (6), and (7).2
67	64		SECTION 3. In Colorado Revised Statutes, 12-155-106, amend3
68	65		(1) as follows:4
69	66		12-155-106. Colorado plumbing code - amendments -5
70	67		variances - Colorado fuel gas code. (1) In accordance with article 4 of6
71	68		title 24, the board shall establish a Colorado plumbing code, as defined7
72	69		in section 12-155-103 (5) (1.4). The code shall MUST represent the8
73	70		minimum standards for installation, alteration, and repair of plumbing9
74	71		equipment and systems throughout the state.10
75	72		SECTION 4. In Colorado Revised Statutes, 30-28-211, amend11
76	73		(2)(a.5) as follows:12
77	74		30-28-211. Energy efficient building codes - legislative13
78	75		declaration - definitions. (2) As used in this section, unless the context14
79	76		otherwise requires:15
80	77		(a.5) "Colorado plumbing code" has the meaning set forth in16
81	78		section 12-155-103 (5) (1.4).17
82	79		SECTION 5. In Colorado Revised Statutes, 31-15-602, amend18
83	80		(2)(a.5) as follows:19
84	81		31-15-602. Energy efficient building codes - legislative20
85	82		declaration - definitions - repeal. (2) As used in this section, unless the21
86	83		context otherwise requires:22
87	84		(a.5) "Colorado plumbing code" has the meaning set forth in23
88	85		section 12-155-103 (5) (1.4).24
89	86		SECTION 6. Act subject to petition - effective date. This act25
90	87		takes effect at 12:01 a.m. on the day following the expiration of the26
91	88		ninety-day period after final adjournment of the general assembly; except27

93	90		-3- that, if a referendum petition is filed pursuant to section 1 (3) of article V1
94	91		of the state constitution against this act or an item, section, or part of this2
95	92		act within such period, then the act, item, section, or part will not take3
96	93		effect unless approved by the people at the general election to be held in4
97	94		November 2026 and, in such case, will take effect on the date of the5
98	95		official declaration of the vote thereon by the governor.6
