21	21		Statutory Revision Committee. The bill repeals obsolete
22	22		references to the teacher residency expansion program (program), which
23	23		was repealed in 2023.
24	24		Current law continues to reference the definition for
25	25		"paraprofessional" as it appeared in the program. The bill recreates the
26	26		definition of "paraprofessional" for the current statutory uses of the term.

46	43		SECTION 1. In Colorado Revised Statutes, 22-60.3-201, add2
47	44		(5.5) as follows:3
48	45		22-60.3-201. Definitions. As used in this part 2, unless the4
49	46		context otherwise requires:5
50	47		(5.5) "P
51	48		ARAPROFESSIONAL" MEANS A PERSON WHO IS TRAINED TO6
52	49		ASSIST A LICENSED TEACHER.7
53	50		SECTION 2. In Colorado Revised Statutes, 22-60.3-204, amend8
54	51		(2)(b)(II) as follows:9
55	52		22-60.3-204. Program eligibility - financial assistance - funding10
56	53		- report. (2) The department shall review each application received and11
57	54		determine whether the applicant meets the following criteria for12
58	55		participation in the program:13
59	56		(b) (II) The applicant is currently employed as a paraprofessional14
60	57		as defined in section 22-60.3-102,
61	58		in a school district, charter school, or15
62	59		board of cooperative services and is working toward a baccalaureate16
63	60		degree as required to pursue a professional teaching license; or17
64	61		SECTION 3. In Colorado Revised Statutes, 22-60.5-209.1,18
65	62		amend (1)(a)(III); and repeal (1)(a)(II) as follows:19
66	63		22-60.5-209.1. Department of education - adjunct instructor20
67	64		authorization - alternative teacher programs - information.21
68	65		(1) (a) The department shall direct resources toward publicizing the22
69	66		existence of:23
70	67		(II) The teacher residency programs available through the teacher24
71	68		residency expansion program created in part 1 of article 60.3 of this title25
72	69		22;26
73	70		(III) Programs to support paraprofessionals, as defined in section27

75	72		-2- 22-60.3-102 SECTION 22-60.3-201, who are seeking a baccalaureate1
76	73		degree to pursue a professional teaching license;2
77	74		SECTION 4. In Colorado Revised Statutes, 24-51-1101, amend3
78	75		(1.9)(a)(I), (1.9)(a)(II)(B), and (1.9)(a)(II)(C) as follows:4
79	76		24-51-1101. Employment after service retirement - report -5
80	77		definitions - repeal. (1.9) (a) (I) Subject to the provisions of subsection6
81	78		(1.9)(h) of this section, a service retiree who is a superintendent, a7
82	79		principal, a teacher, a school bus driver, a school food services cook, a8
83	80		school nurse, or a paraprofessional, as defined in section 22-60.3-102 (9)9
84	81		SECTION 22-60.3-201, and is hired pursuant to subsection (1.9)(b) of this10
85	82		section by an employer in the school division of the association that11
86	83		satisfies the criteria specified in subsection (1.9)(a)(II) of this section may12
87	84		receive salary without reduction in benefits for any length of employment13
88	85		in a calendar year if the service retiree has not worked for any AN14
89	86		employer, as defined in section 24-51-101 (20), during the month of the15
90	87		effective date of retirement. A service retiree described in this subsection16
91	88		(1.9)(a) who works for any AN employer, as defined in section 24-51-10117
92	89		(20), during the month of the effective date of retirement shall be IS18
93	90		subject to a reduction in benefits as provided in section 24-51-1102 (2).19
94	91		(II) The provisions of this subsection (1.9) apply only if:20
95	92		(B) The school district, board of cooperative services, or charter21
96	93		school hires the service retiree for the purpose of providing classroom22
97	94		instruction or school bus transportation to students enrolled by the district,23
98	95		enrolled by one or more of the districts served by the board of cooperative24
99	96		services, or enrolled by the charter school, or for the purpose of being a25
100	97		superintendent, a principal, a school food services cook, a school nurse,26
101	98		or a paraprofessional, as defined in section 22-60.3-102 (9) SECTION27

104	101		(C) The school district, board of cooperative services, or charter2
105	102		school determines that there is a critical shortage of qualified3
106	103		superintendents, principals, teachers, school bus drivers, school food4
107	104		services cooks, school nurses, or paraprofessionals, as defined in section5
108	105		22-60.3-102 (9) SECTION 22-60.3-201, as applicable, and that the service6
109	106		retiree has specific experience, skills, or qualifications that would benefit7
110	107		the district, board of cooperative services, or charter school.8
111	108		SECTION 5. Act subject to petition - effective date. This act9
112	109		takes effect at 12:01 a.m. on the day following the expiration of the10
113	110		ninety-day period after final adjournment of the general assembly; except11
114	111		that, if a referendum petition is filed pursuant to section 1 (3) of article V12
115	112		of the state constitution against this act or an item, section, or part of this13
116	113		act within such period, then the act, item, section, or part will not take14
117	114		effect unless approved by the people at the general election to be held in15
118	115		November 2026 and, in such case, will take effect on the date of the16
119	116		official declaration of the vote thereon by the governor.17
