3936 SECTION 1. In Colorado Revised Statutes, 12-280-402, repeal2
4037 (2); and add (5) as follows:3
4138 12-280-402. Definitions. As used in this part 4, unless the context4

4340 (2) "Drug abuse" or "abuse" means utilization of a controlled6
4441 substance for nonmedical purposes or in a manner that does not meet7
4542 generally accepted standards of medical practice.8

4744 UBSTANCE USE DISORDER" MEANS A CHRONIC RELAPSING9
4845 BRAIN DISEASE, CHARACTERIZED BY RECURRENT USE OF ALCOHOL , DRUGS,10
4946 OR BOTH, CAUSING CLINICALLY SIGNIFICANT IMPAIRMENT , INCLUDING11
5047 HEALTH PROBLEMS , DISABILITY, AND FAILURE TO MEET MAJOR12
5148 RESPONSIBILITIES AT WORK, SCHOOL, OR HOME.13
5249 SECTION 2. Act subject to petition - effective date. This act14
5350 takes effect at 12:01 a.m. on the day following the expiration of the15
5451 ninety-day period after final adjournment of the general assembly; except16
5552 that, if a referendum petition is filed pursuant to section 1 (3) of article V17
5653 of the state constitution against this act or an item, section, or part of this18
5754 act within such period, then the act, item, section, or part will not take19
5855 effect unless approved by the people at the general election to be held in20
5956 November 2026 and, in such case, will take effect on the date of the21
6057 official declaration of the vote thereon by the governor.22
