2323 Statutory Revision Committee. Under current law, an individual
2424 may request a self-pay estimate of the total cost of an anticipated
2525 health-care service (self-pay estimate) from the designated billing or
2626 patient services personnel representing the health-care provider or
2727 health-care facility providing the service. Unless the patient suffers a

3636 service must be no more than 15% higher than the self-pay estimate or
3737 $400, whichever is less.
3838 The bill corrects a mistake in the statutory language by clarifying
3939 that the $400 qualifier relates to the permissible dollar amount above the
4040 cost estimated in the self-pay estimate rather than the maximum allowable
4141 cost of the health-care service, regardless of the service provided.
4242 Further, when referencing the exception in statute that, due to an
4343 emergency or unforeseen circumstance, the total cost of services may
4444 exceed the self-pay estimate by more than 15% or $400, the bill removes
4545 the language "whichever is less", as that language is inapplicable when
4646 the exception applies.
4747 Be it enacted by the General Assembly of the State of Colorado:1
4848 SECTION 1. In Colorado Revised Statutes, 25-49-106, amend2
4949 (1)(b) as follows:3
5050 25-49-106. Required disclosure to self-pay recipients - estimate4
5151 of total cost of health-care services upon request - deceptive trade5
5252 practice - definition. (1) (b) (I) Except as provided in subsection6
5353 (1)(b)(II) of this section, the final cost of the health-care service for which7
5454 the self-pay estimate was made must be no more than fifteen percent8
5555 higher than the total estimated cost indicated in the self-pay estimate or9
5656 NO MORE THAN four hundred dollars HIGHER THAN THE TOTAL ESTIMATED10
5757 COST INDICATED IN THE SELF-PAY ESTIMATE, whichever is less.11
5858 (II) The final cost of the health-care service for which the self-pay12
5959 estimate was made may be more than fifteen percent

7575 SECTION 2. Act subject to petition - effective date. This act7
7676 takes effect at 12:01 a.m. on the day following the expiration of the8
7777 ninety-day period after final adjournment of the general assembly; except9
7878 that, if a referendum petition is filed pursuant to section 1 (3) of article V10
7979 of the state constitution against this act or an item, section, or part of this11
8080 act within such period, then the act, item, section, or part will not take12
8181 effect unless approved by the people at the general election to be held in13
8282 November 2026 and, in such case, will take effect on the date of the14
8383 official declaration of the vote thereon by the governor.15
