23	23	Statutory Revision Committee. Under current law, an individual
24	24	may request a self-pay estimate of the total cost of an anticipated
25	25	health-care service (self-pay estimate) from the designated billing or
26	26	patient services personnel representing the health-care provider or
27	27	health-care facility providing the service. Unless the patient suffers a

35	35	services provided, the statute states that the final cost of the health-care
36	36	service must be no more than 15% higher than the self-pay estimate or
37	37	$400, whichever is less.
38	38	The bill corrects a mistake in the statutory language by clarifying
39	39	that the $400 qualifier relates to the permissible dollar amount above the
40	40	cost estimated in the self-pay estimate rather than the maximum allowable
41	41	cost of the health-care service, regardless of the service provided.
42	42	Further, when referencing the exception in statute that, due to an
43	43	emergency or unforeseen circumstance, the total cost of services may
44	44	exceed the self-pay estimate by more than 15% or $400, the bill removes
45	45	the language "whichever is less", as that language is inapplicable when
46	46	the exception applies.
47	47	Be it enacted by the General Assembly of the State of Colorado:1
48	48	SECTION 1. In Colorado Revised Statutes, 25-49-106, amend2
49	49	(1)(b) as follows:3
50	50	25-49-106. Required disclosure to self-pay recipients - estimate4
51	51	of total cost of health-care services upon request - deceptive trade5
52	52	practice - definition. (1) (b) (I) Except as provided in subsection6
53	53	(1)(b)(II) of this section, the final cost of the health-care service for which7
54	54	the self-pay estimate was made must be no more than fifteen percent8
55	55	higher than the total estimated cost indicated in the self-pay estimate or9
56	56	NO MORE THAN four hundred dollars HIGHER THAN THE TOTAL ESTIMATED10
57	57	COST INDICATED IN THE SELF-PAY ESTIMATE, whichever is less.11
58	58	(II) The final cost of the health-care service for which the self-pay12
59	59	estimate was made may be more than fifteen percent
60	60	HIGHER OR MORE13
61	61	THAN FOUR HUNDRED DOLLARS higher than the self-pay estimate or four
62	62	14
63	63	hundred dollars if a medical emergency occurs that is associated with the15
64	64	health-care service or if an additional, unforeseen, medically necessary16
65	65	health-care service is required during the provision of the health-care17
66	66	service. The health-care provider or health-care facility shall make all18
67	67	HB25-1317-2- reasonable efforts to obtain the consent of the recipient or, if the recipient1
68	68	is incapacitated, the recipient's authorized agent prior to providing any2
69	69	emergency or unforeseen, medically necessary health-care service that3
70	70	will increase by more than fifteen percent

75	75	SECTION 2. Act subject to petition - effective date. This act7
76	76	takes effect at 12:01 a.m. on the day following the expiration of the8
77	77	ninety-day period after final adjournment of the general assembly; except9
78	78	that, if a referendum petition is filed pursuant to section 1 (3) of article V10
79	79	of the state constitution against this act or an item, section, or part of this11
80	80	act within such period, then the act, item, section, or part will not take12
81	81	effect unless approved by the people at the general election to be held in13
82	82	November 2026 and, in such case, will take effect on the date of the14
83	83	official declaration of the vote thereon by the governor.15
