that requests that the individual completing the form disclose the

Be it enacted by the General Assembly of the State of Colorado:1
SECTION 1. In Colorado Revised Statutes, add article 18.2 to2
title 24 as follows:3

CONTEXT OTHERWISE REQUIRES , "STATE" MEANS THE GOVERNMENT OF8
THIS STATE, AND EVERY STATE DEPARTMENT , AGENCY, BOARD,9
COMMISSION, INSTITUTION OF HIGHER EDUCATION , SPECIAL PURPOSE10
AUTHORITY, AS DEFINED IN SECTION 24-77-102 (15), OR AUTHORIZED11
AGENT OF THE STATE.12

FORM ISSUED BY THE STATE OR A STATE AGENCY THAT13
REQUESTS THAT THE INDIVIDUAL COMPLETING THE FORM DISCLOSE THE14
INDIVIDUAL'S RACE OR ETHNICITY MUST INCLUDE, IN ADDITION TO SPACES15
FOR ANY OTHER RACIAL OR ETHNIC CATEGORIES REQUIRED BY THE16
FEDERAL OFFICE OF MANAGEMENT AND BUDGET , A SPACE TO INDICATE17
THAT THE INDIVIDUAL'S RACE OR ETHNICITY IS MIDDLE EASTERN, NORTH18

SECTION 2. In Colorado Revised Statutes, add article 11.2 to20

STATE;6
(b) A
N AGENCY, INSTITUTION, AUTHORITY, OR AUTHORIZED AGENT7
OF SUCH A COUNTY, CITY AND COUNTY, MUNICIPALITY, SCHOOL DISTRICT,8
SPECIAL DISTRICT, OR OTHER POLITICAL SUBDIVISION; AND9
(c) A
N AUTHORIZED AGENT OF ANY ENTITY LISTED IN SUBSECTION10
(1)(a)
OR (1)(b) OF THIS SECTION.11

SECTION 3. Act subject to petition - effective date -19
applicability. (1) This act takes effect September 1, 2025; except that,20
if a referendum petition is filed pursuant to section 1 (3) of article V of21
the state constitution against this act or an item, section, or part of this act22
within the ninety-day period after final adjournment of the general23
assembly, then the act, item, section, or part will not take effect unless24
approved by the people at the general election to be held in November25
2026 and, in such case, will take effect on the date of the official26
declaration of the vote thereon by the governor.27

-3- (2) This act applies to state and local government forms that1
request that the individual completing the form disclose the individual's2
race or ethnicity and that are provided to individuals for completion on or3
after the applicable effective date of this act.4
