12-Be it enacted by the General Assembly of the State of Colorado:
13-SECTION 1. In Colorado Revised Statutes, amend 40-18-104 as
14-follows:
15-40-18-104. Confidential investigative reports - rules. Investigative
16-reports of the commission compiled under this article shall be confidential
17-and shall not be discoverable nor used as evidence in any court or
18-administrative action THE COMMISSION MAY ADOPT RULES MAKING

23+requires investigative reports of railroads made for the public utilities
24+commission to be kept confidential. The bill repeals this requirement and
25+replaces it with a grant of rule-making authority to make ongoing
26+investigations and security information confidential. The confidentiality

3765 SECTION 2. Act subject to petition - effective date. This act
38-takes effect at 12:01 a.m. on the day following the expiration of the
39-ninety-day period after final adjournment of the general assembly; except
40-that, if a referendum petition is filed pursuant to section 1 (3) of article V
41-of the state constitution against this act or an item, section, or part of this act
42-within such period, then the act, item, section, or part will not take effect
43-unless approved by the people at the general election to be held in
44-PAGE 2-SENATE BILL 25-052 November 2026 and, in such case, will take effect on the date of the official
45-declaration of the vote thereon by the governor.
