REGISTRATIONS OF THE PERSON S INCLUDED ON THE REPORTS .101 Bill Summary (Note: This summary applies to this bill as introduced and does not reflect any amendments that may be subsequently adopted. The secretary of state must maintain the computerized statewide voter registration list on as current a basis as possible, including in a manner that ensures that the names of electors who are not eligible to vote are removed from the list. In furtherance of this responsibility, the department of state regularly and securely exchanges information with the department of revenue (DOR), the department of public health and environment (CDPHE), and the department of corrections (DOC) to enable the transfer and verification of voter registration information. Section 1 of the bill requires that, on and after July 1, 2025, the secretary of state, on behalf of the department of state, modify its agreements with DOR, CDPHE, and DOC to expressly include access to any available citizenship-related information in the databases already subject to shared access between the department of state and DOR, CDPHE, and DOC, respectively. Section 2 requires the executive director of DOR to furnish 2 separate quarterly reports to the secretary of state of all persons who are not citizens based on: ! Information contained in the database of the division of motor vehicles subject to the existing sharing agreement with the department of state as modified in section 1; and ! Information obtained from the federal commissioner of social security and required to be made accessible to the department of state for verification of a person's name, date of birth, and the last 4 digits of the person's social security number. Section 2 requires the executive directors of CDPHE and DOC, respectively, to furnish the same type of quarterly report to the secretary of state based on the information in the databases of CDPHE and DOC subject to existing information-sharing agreements with the department of state and as modified in section 1. Section 2 also requires the state court administrator to provide the secretary of state with a quarterly report of all persons who report as ineligible to serve as a trial or grand juror because they are not citizens. Section 2 requires the secretary of state to forward quarterly to each county clerk and recorder the information received from the SB25-057-2- executive directors of DOR, CDPHE, DOC, and the state court administrator, and requires a county clerk and recorder to cancel the voter registration of any elector who is not a citizen according to the information received from the secretary of state. Additionally, the secretary of state may electronically cancel the voter registration of any elector who is not a citizen and who the secretary of state has received notice of from the executive directors of DOR, CDPHE, or DOC, or the state court administrator. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. In Colorado Revised Statutes, 1-2-302, add (6.5)(d)2 as follows:3 1-2-302. Maintenance of computerized statewide voter4 registration list - confidentiality. (6.5) (d) A T THE EARLIEST PRACTICAL5 TIME AFTER THE EFFECTIVE DATE OF THIS SUBSECTION (6.5)(d), THE6 SECRETARY OF STATE, ACTING ON BEHALF OF THE DEPARTMENT OF STATE ,7 SHALL MODIFY THE AGREEMENTS ENTERED INTO PURSUANT TO8 SUBSECTIONS (6.5)(a) AND (6.5)(b) OF THIS SECTION TO EXPRESSLY9 INCLUDE ACCESS TO INFORMATION IN THE DATABASES OF THE DIVISION OF10 MOTOR VEHICLES , THE DEPARTMENT OF PUBLIC HEALTH AND11 ENVIRONMENT, AND THE DEPARTMENT OF CORRECTIONS TO THE EXTENT12 REQUIRED TO ENABLE THE VERIFICATION OF THE ACCURACY OF THE13 CITIZENSHIP STATUS OF ALL PERSONS AS PROVIDED ON THEIR14 APPLICATIONS FOR VOTER REGISTRATION TO CONFORM TO THE15 REQUIREMENTS OF SECTIONS 1-2-301, 1-2-101 (1)(a), AND 1-2-204 (2)(c).16 SECTION 2. In Colorado Revised Statutes, add 1-2-607 as17 follows:18 1-2-607. Cancellation of registrations of electors who are not19 qualified by reason of noncitizenship - reports. (1) (a) A S SOON AS20 PRACTICABLE AFTER THE END OF EACH QUARTER OF A CALENDAR YEAR ,21 SB25-057-3- THE EXECUTIVE DIRECTOR OF THE DEPARTMENT OF REVENUE , AS THE1 OFFICIAL RESPONSIBLE FOR THE DIVISION OF MOTOR VEHICLES , SHALL, IN2 ACCORDANCE WITH THE EXCHANGE OF INFORMATION AUTHORIZED3 PURSUANT TO SECTION 1-2-302 (6), (6.5)(a), AND (6.5)(d), FURNISH THE4 SECRETARY OF STATE WITH A REPORT OF ALL PERSONS WHO ARE NOT5 CITIZENS AS INDICATED BY THE INFORMATION IN THE DATABASE OF THE6 DIVISION OF MOTOR VEHICLES.7 (b) A S SOON AS PRACTICABLE AFTER THE END OF EACH QUARTER8 OF A CALENDAR YEAR, THE EXECUTIVE DIRECTOR OF THE DEPARTMENT OF9 REVENUE SHALL, IN ACCORDANCE WITH THE EXCHANGE OF INFORMATION10 AUTHORIZED PURSUANT TO SECTION 1-2-302 (6.7), FURNISH THE11 SECRETARY OF STATE WITH A REPORT OF ALL PERSONS WHO ARE NOT12 CITIZENS AS INDICATED BY THE INFORMATION PROVIDED TO THE13 DEPARTMENT OF STATE FOR VERIFICATION OF A PERSON 'S NAME, DATE OF14 BIRTH, AND THE LAST FOUR DIGITS OF THE PERSON 'S SOCIAL SECURITY15 NUMBER, OR THE ABSENCE OF SUCH SOCIAL SECURITY NUMBER .16 (2) A S SOON AS PRACTICABLE AFTER THE END OF EACH QUARTER17 OF A CALENDAR YEAR, THE EXECUTIVE DIRECTORS OF THE DEPARTMENT18 OF PUBLIC HEALTH AND ENVIRONMENT AND THE DEPARTMENT OF19 CORRECTIONS SHALL, IN ACCORDANCE WITH THE EXCHANGE OF20 INFORMATION AUTHORIZED UNDER SECTION 1-2-302 (6.5)(b) AND (6.5)(d),21 FURNISH THE SECRETARY OF STATE WITH REPORTS OF ALL PERSONS WHO22 ARE NOT CITIZENS AS INDICATED BY THE INFORMATION IN THE DATABASES23 OF THE DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT AND THE24 DEPARTMENT OF CORRECTIONS , RESPECTIVELY.25 (3) A S SOON AS PRACTICABLE AFTER THE END OF EACH QUARTER26 OF A CALENDAR YEAR, THE STATE COURT ADMINISTRATOR SHALL FURNISH27 SB25-057 -4- THE SECRETARY OF STATE WITH A REPORT OF ALL PERSONS WHO REPORT1 AS INELIGIBLE TO SERVE AS A TRIAL OR GRAND JUROR BECAUSE THEY ARE2 NOT CITIZENS.3 (4) E ACH QUARTER OF A CALENDAR YEAR , THE SECRETARY OF4 STATE SHALL FORWARD TO EACH COUNTY CLERK AND RECORDER THE5 INFORMATION RECEIVED PURSUANT TO SUBSECTIONS (1) THROUGH (3) OF6 THIS SECTION.7 (5) A COUNTY CLERK AND RECORDER SHALL CANCEL THE8 REGISTRATION OF ANY ELECTOR WHO IS NOT A CITIZEN AND WHO THE9 COUNTY CLERK AND RECORDER HAS RECEIVED NOTICE OF PURSUANT TO10 SUBSECTION (4) OF THIS SECTION.11 (6) T HE SECRETARY OF STATE MAY , BY ELECTRONIC MEANS ,12 CANCEL THE REGISTRATION OF ANY ELECTOR WHO IS NOT A CITIZEN AND13 WHO THE SECRETARY OF STATE HAS RECEIVED NOTICE OF PURSUANT TO14 SUBSECTIONS (1) THROUGH (3) OF THIS SECTION.15 (7) T HE REPORTS REQUIRED TO BE FURNISHED TO THE SECRETARY16 OF STATE PURSUANT TO SUBSECTIONS (1) THROUGH (3) OF THIS SECTION17 AND ANY OTHER RECORDS EXCHANGED PURSUANT TO THIS SECTION ARE18 PUBLIC RECORDS NOT SUBJECT TO DISCLOSURE IN ACCORDANCE WITH19 SECTION 24-72-204 (1)(a), (1)(b), AND (2)(a)(VI).20 (8) T HE SECRETARY OF STATE SHALL PROVIDE ADEQUATE21 TECHNOLOGICAL SECURITY MEASURES TO PREVENT UNAUTHORIZED22 ACCESS TO THE REPORTS AND ANY OTHER RECORDS EXCHANGED23 PURSUANT TO THIS SECTION . THE SECRETARY OF STATE SHALL ALSO24 ESTABLISH ADEQUATE AND REASONABLE TECHNOLOGICAL SECURITY25 REQUIREMENTS FOR THE EXCHANGE OR TRANSFER OF THE REPORTS OR ANY26 DATA RELATED TO THE REPORTS BETWEEN THE SECRETARY OF STATE AND27 SB25-057 -5- ANY OTHER STATE AGENCY OR COUNTY CLERK AND RECORDER . THE1 SECRETARY OF STATE, THE DEPARTMENT OF REVENUE, THE DEPARTMENT2 OF PUBLIC HEALTH AND ENVIRONMENT , THE DEPARTMENT OF3 CORRECTIONS, THE STATE COURT ADMINISTRATOR , AND EACH COUNTY4 CLERK AND RECORDER SHALL ADHERE TO THE TECHNOLOGICAL SECURITY5 REQUIREMENTS ESTABLISHED BY THE SECRETARY OF STATE , AND SHALL6 NOT SELL, DISCLOSE, OR OTHERWISE RELEASE THE REPORTS OR ANY7 INFORMATION CONTAINED IN THE REPORTS . 8 SECTION 3. Act subject to petition - effective date. This act9 takes effect at 12:01 a.m. on the day following the expiration of the10 ninety-day period after final adjournment of the general assembly; except11 that, if a referendum petition is filed pursuant to section 1 (3) of article V12 of the state constitution against this act or an item, section, or part of this13 act within such period, then the act, item, section, or part will not take14 effect unless approved by the people at the general election to be held in15 November 2026 and, in such case, will take effect on the date of the16 official declaration of the vote thereon by the governor.17 SB25-057 -6-
