In 2023, the general assembly authorized certain public hospitals to enter into collaborative agreements with other hospitals or hospital affiliates to engage in activities to increase access to health care. The bill authorizes private, nonprofit hospitals with fewer than 50 beds to also enter into collaborative agreements. In Colorado Revised Statutes, 25.5-1-1001, amend2 (2)(e) introductory portion, (2)(e)(II), and (2)(e)(III); and add (2)(e)(IV)3 as follows:4 25.5-1-1001. Hospital collaborative agreements - review of5 proposed collaborative agreements - immunity - legislative6 declaration - definitions - rules. (2) As used in this section, unless the7 context otherwise requires:8 (e) "Hospital" means a facility, with fewer than fifty beds that9 WHICH is NOT OWNED BY OR AFFILIATED WITH A HEALTH SYSTEM THAT IS10 COMPRISED OF THREE OR MORE HOSPITALS , THAT IS:11 (II) A hospital established, maintained, or operated directly or12 indirectly by a health service district; or13 (III) A hospital affiliate; OR14 (IV) A PRIVATE, NONPROFIT HOSPITAL.15 SECTION 2. In Colorado Revised Statutes, amend 25-3-304.516 as follows:17 25-3-304.5. Hospital collaborative agreements - additional18 powers. In addition to the powers specified in section 25-3-304, the board19 of trustees of a county public hospital may enter into a collaborative20 agreement with another county public hospital; A health service district;21 or A hospital affiliate; OR A PRIVATE, NONPROFIT HOSPITAL in accordance22 with section 25.5-1-1001.23 SECTION 3. In Colorado Revised Statutes, 32-1-1003, amend24 (1)(c.5) as follows:25 32-1-1003. Health service districts - additional powers. (1) In26 078-2- addition to the powers specified in section 32-1-1001, the board of any1 health service district has any or all of the following powers for and on2 behalf of such district:3 (c.5) To enter into a collaborative agreement with another health4 service district; A county public hospital; or A hospital affiliate; OR A5 PRIVATE, NONPROFIT HOSPITAL in accordance with section 25.5-1-1001;6 SECTION 4. Act subject to petition - effective date. This act7 takes effect at 12:01 a.m. on the day following the expiration of the8 ninety-day period after final adjournment of the general assembly; except9 that, if a referendum petition is filed pursuant to section 1 (3) of article V10 of the state constitution against this act or an item, section, or part of this11 act within such period, then the act, item, section, or part will not take12 effect unless approved by the people at the general election to be held in13 November 2026 and, in such case, will take effect on the date of the14 official declaration of the vote thereon by the governor.15 078 -3-
