10-ONCERNING THE AUTHORIZATION OF CERTAIN NONPROFIT HOSPITALS TO

15-Be it enacted by the General Assembly of the State of Colorado:
16-SECTION 1. In Colorado Revised Statutes, 25.5-1-1001, amend
17-(2)(e) introductory portion, (2)(e)(II), and (2)(e)(III); and add (2)(e)(IV) as
18-follows:
19-25.5-1-1001. Hospital collaborative agreements - review of
20-proposed collaborative agreements - immunity - legislative declaration
21-- definitions - rules. (2) As used in this section, unless the context
22-otherwise requires:
23-NOTE: This bill has been prepared for the signatures of the appropriate legislative

31-WHICH is NOT OWNED BY OR AFFILIATED WITH A HEALTH SYSTEM THAT IS
32-COMPRISED OF THREE OR MORE HOSPITALS

34-(II) A hospital established, maintained, or operated directly or
35-indirectly by a health service district; or
36-(III) A hospital affiliate; OR
37-(IV) A PRIVATE, NONPROFIT HOSPITAL.
38-SECTION 2. In Colorado Revised Statutes, amend 25-3-304.5 as
39-follows:
40-25-3-304.5. Hospital collaborative agreements - additional
41-powers. In addition to the powers specified in section 25-3-304, the board
42-of trustees of a county public hospital may enter into a collaborative

23+In 2023, the general assembly authorized certain public hospitals
24+to enter into collaborative agreements with other hospitals or hospital
25+affiliates to engage in activities to increase access to health care. The bill
26+authorizes private, nonprofit hospitals with fewer than 50 beds to also
27+enter into collaborative agreements.

48-(1)(c.5) as follows:

50-addition to the powers specified in section 32-1-1001, the board of any
51-health service district has any or all of the following powers for and on
52-behalf of such district:
53-(c.5) To enter into a collaborative agreement with another health

59-SECTION 4. Act subject to petition - effective date. This act
60-takes effect at 12:01 a.m. on the day following the expiration of the
61-ninety-day period after final adjournment of the general assembly; except
62-that, if a referendum petition is filed pursuant to section 1 (3) of article V
63-of the state constitution against this act or an item, section, or part of this act
64-within such period, then the act, item, section, or part will not take effect
65-PAGE 2-SENATE BILL 25-078 unless approved by the people at the general election to be held in
66-November 2026 and, in such case, will take effect on the date of the official
67-declaration of the vote thereon by the governor.
